Initial Business Response / [redacted] (1000, 14, 2015/10/08) */ I will respond to each accusation from [redacted] 's complaint belowI will also send you what has now become a large packet from the last two complaints I've responded to with the Attorney General's office and the DOLI Payment: This is correct She paid us this amount for the addition, sunroom remodel, full master in marble, and second bath remodelI don't know what she paid on her own for the allowance items we credited her backShe wanted to buy her own allowance items to get miles on her credit cardI'm not sure why she brings this up as she was happy and more than fine with the total costsQuite honestly is was a very good deal Problems: We had a leak in the shower when it was complete due to the incorrect install of a trough drainWe recognized it and went the extra mile and completely re-installed the shower to ensure it never happened againWe gave her several marble tiles to choose from and she numbered them and labeled them on how she wanted them reinstalledAfter it was completed she asked us to change some of the marble again because she didn't like themWe were willing to do that at the time until threats to our company were made to our tile installerWe were not made aware of any other problems other than a piece of kickout flashing on the exterior that we missed and we installed itIf there are any settling issues at the moment it would be minor and cracking in sheetrock and grout linesThis is common in any new construction area and we were not made aware of any of these items in the year warranty periodIn fact this is the first I am hearing about itOur last 100+ projects are not falling apart and I would guess this one isn't either The kitchen and gutter issues really have nothing to do with us [redacted] had a leak in her kitchen window (we were not a part of anything near the kitchen)We went and took a look for her just to help out and saw very large gaps above quite a few windows due to old stucco gaps with insufficient caulkingWe showed her these and even caulked the gap for her at no charge to help outThe gutters were the original gutters we just rehung for her after the addition was completeGutters were not in our scope or contract as [redacted] did not want to pay for new ones on the old part of the houseThe gutters really have nothing to do with the leaky window anywayAgain, just trying to help out I told her she should have the caulking checked every couple years on the old part of the house as the caulking can crack over time, but she told me that was ridiculousThe window, leak, gutters, and caulking had nothing to do with the additionThese were just items we tried to educate her about after her water issue in the kitchenAgain, I'm not sure why this is a complaint about PDW? License: My license has NEVER been revokedI have paid one minor fine of $in my years because my egress window guy used my license number onceThis is an incorrect statement and a flat out lie Warranty work: We were not notified of any warranty work that needed repair other than the kitchen she wanted us to remodel at no cost due to her pain and suffering because the shower leakedWe gave her a bid on the kitchen work, but after several threats were made to "destroy you on social media" and she is a "professional social media person" I was forced to look into social media watchdogs and also had any future communication go through him and myself to avoid any more misrepresentations by [redacted] This was only done after threats were made by [redacted] as her response to not wanting to do the kitchen work for freeThis is how I support not only my family, but the families of everyone who does work for us and I do not take that lightlyPDW did everything they could to make [redacted] happy short of working for free to fix a kitchen that was damaged due to homeowner neglectThe reason I told her we didn't want to do any more work for her was because of the threats and the kitchen bid we had given herWe did not want to take on any new projects on her home, it had nothing to do with warranty issuesTurning down another project on her home does not violate state law Sagging: We built the addition according to all laws codes and rulesAll proper permits were pulled, inspected and passed by the city of MinneapolisIf there were warranty covered cracks in the tile [redacted] should have emailed us with the attorney included and we would have covered those warranty issues with a third party presentI am not sure why she said they have to tear up there bathroom due to some settling cracksThis does not make any sense and again is the first I am hearing about it Desired Resolution: This is the most ridiculous request I've ever seeNot only did we do a high end bathroom addition which she loved when we were done and her dad said she was so happy at that time she was referring friends to usNow she wants not only all the money into the work, but another $11,just becauseThe reason I believe [redacted] is upset is because marble is a natural product and doesn't always match 100% (this is what most people love about natural stone)I have wasted many hours dealing with these accusation and I am growing tired of defending myself against accusations because she has a personal problem with me Please call me with any questions at any time! 2. Most homeowners are aware that there are minor settling issues the any new structure. They are usually noticed within the 1 year warranty and taken care of by PDW. This is very typical especially considering ur freeze/thaw climate.
3. Cost was actually a really good deal for the work that was completed.

1,2 The problem is not gutters (which by the way were not ever in our scope because you didn't want them. There are many houses that don't even have gutters but their kitchens are fine) The problem is giant gaps above her old windows where caulk had deteriorated. I've told [redacted] and her dad (who doesn't even have gutters on his own house) this about a thousand times. I don't know why she keeps talking about it.

This is true, we did have a sheetrock worker stop later than he should have to finish the sheetrock repair from the shower. I called him immediately and told him to leave. He said she told him to go ahead and it wasn't a big deal because they were going to dinner. I believe this permit was pulled before the new work hour rules were put in place by the city of Minneapolis so I don't think we needed an after hours permit, but it would have been nice for him not to come that late in the afternoon. [redacted] seems to be grasping at straws if this is what she is talking about for not having proper permits.
The rest of the complaints have been addressed several times and do not hold any new submittal information. I never said I wouldn't carry out a warranty and asking for $60,000 or whatever she was asking for is ridiculous.
If [redacted] is going to file a lawsuit I will be countersuing and have all the time and emails saved. I also have several witnesses to every situation we dealt with on [redacted]'s project. I have proof and several filed complaints with no fault found on behalf of PDW.

Dear Revdex.com:
I filed a complaint with the Revdex.com and Paul [redacted] responded by sending the Revdex.com a letter that is all lies. I pointed out the lies, sentence-by-sentence, and explained there is written proof that each sentence is a lie. His response to that letter is to repeat the lies.

Paul [redacted] may be tried of this. But I am more tired. I am the one who paid him for work that was not completed, work that is falling apart, work that caused damage to my house, work that I now have to pay others to redo, and damages I have to pay others to correct, all of which should have been covered by the warranty in the contract he refused to honor, which is a breach of contract.
Every time I raise an issue, his response is the same. He tries to bully me and threatens to sue me if I don't keep quiet and let him steal money and time from me.
PDW made a mess, and according to the state mandated warranty, Paul [redacted] is responsible for paying to correct it. Stating, in writing, that he will not do so, is a breach of contract, for which he should be held liable. Paul [redacted] is like a bank robber who threatens to sue the bank manager for calling the police and preventing him from getting away with the money.
Following is Paul [redacted]'s latest response to my claim.

Once again we have been in business for many years with this one and only complaint from [redacted]. She has complained to City of Minneapolis (called and asked for inspector to look at it and PDW was cleared of any wrongdoing), DOLI (Wayne said she went up the entire ladder there and no penalty or action was taken against PDW for any wrongdoing), Attorney General (haven't heard anything, but I suspect they closed the case since she is now complaining with Revdex.com), and now the Revdex.com with a second submittal. So far every complaint she has filed has turned up with no fault and no action taken against PDW for any wrongdoing in any possible way.
(I did not complain to the City of Minneapolis. When the City Inspector looked at the work after Paul [redacted] said he was finished, the Inspector pointed out a number of things he thought were not good. Then, after talking with Paul [redacted], he changed his story.)
(I was told by Mr. Charles Durenberger at DOLI that DOLI had revoked Paul [redacted]'s license in the past. I have no idea why he would say that to my father and me if it were not true.)
(I did not make a second submittal to the Revdex.com. I simply answered the lies in his response.)
I guess I will respond once again to each number [redacted] has in her response letter.

Problems-1:
1. Incorrect, When we saw the leak we thought it could be coming from the flashing kick out. We installed the flashing kick out, but we suspect the shower was the source of the leaking. They were in the same location.
(Not true, again. The sheetrock was ripped out because of the water damage from the failure to install flashing.)
2. I would consider us trying to get it right and not just put a band aid over it and completing it as fast as we did going the extra mile. I don't think [redacted] has a lot of experience with other builders who handle things quite differently. We hold ourselves to a higher standard.
(I never asked for a band-aid. That is the last thing I would want, given the quality I paid for.)
3. [redacted] had actually once asked why we had to rip so much of it apart. My point was, we ripped up the pan and part way up the wall and did not settle for caulking hoping it would hold.
(I asked because it was scary to see so much being torn apart. Why would I, or anyone else, not want it repaired? I only wanted it to be repaired to look like it looked before they had to rip it apart because of their errors.)
3. I agree, it was repaired.
Problems-2
1. We install natural marble very often. Almost never does it match. We had actually agreed to let her pick again because she was unhappy even after she picked and labeled the exact placement and direction of how she wanted them laid.
(The marble matched perfectly before it was ripped out because of Paul [redacted]'s errors. As I explained, I picked the pieces I thought were best, from what I was shown. Four of the six pieces are fine. Two are not. I still do not understand why replacing two pieces of marble was such a big deal to Mr. [redacted], especially given how much I paid him for his work.)
2. The city inspector said the place looked good and good luck with that one, to us.
(The city inspector said the marble looked like crap and should be replaced. Then he changed his story.)
3. It wouldn't have been a fix, it would have been to make [redacted] happy.
(I do not think I should pay for work that does not meet the quality standards I paid for, when the mistakes and problems were not my fault.)

1. There was most definitely a threat made before we had a chance to give [redacted] more marble to choose from. [redacted] made a threat to DESTROY PDW through social media. She said she was a social media expert and we had no idea who we were messing with. She 100% threatened the livelihood of the entire company and it's employees and their families. Needless to say we were not interested in making her happy at this point. The threat was made to a tile installer at her home. He is a witness, ex-police officer, and now a firefighter for the city of Minneapolis.
(This is a total lie. I never told anyone I was a social media expert. I am not. I do know Paul [redacted] bullies and threatens those who work for him so they will say and do what he says if they want to work for him.)
2. After the threat was made my attorney was contacted and an email was sent to [redacted] that any further contact would have to include him. I said I had no interest in doing any more work at [redacted]'s home referring to the second marble install we were going to do because she didn't like two of the pieces and the kitchen estimate we gave her to repair damage to her kitchen from a gap above her old windows. It said nothing about warranty work as far as I can recall.
(I never received an email from Mr. [redacted]'s attorney. Mr. [redacted] continues to imply something happened that did not happen. I was not angry before Paul [redacted] refused to correct his errors and fix the mess he made. Why would anyone threaten someone who is promising to make everything right.)

2. We are pretty sure it was the shower all along. They are within about 1' from each other if I remember correctly and I would say pouring is an exaggeration. We had to replace some sheetrock.
(He knows what happened, but he is trying to lie his way out of his responsibility by making up a time line that does not meet the facts. Sheetrock on two walls and the ceiling was torn out and replaced. After the sheetrock was torn out, it was discovered that the shower was also leaking into the sunroom.)
3. I don't recall the response time, but I'm sure it wasn't more than 48 hours if it was on a weekend and 24 hours if it was during the week. I am not going to take the time to dig up the emails to show response time because I am tired of wasting my time on this, but I can because I save all my emails.
(Mr. [redacted] does not have to dig up anything, because there are email records of how long I had to wait for one of his people to even look at the problem and the damage. I am more tired of wasting my time than he is.)

(Of course he knows, because when his people finally showed up, they immediately saw they had failed to install the flashing, which is where the water was coming from. They also know they discovered the shower leak after tearing out the sheetrock.)
