Thank you returning the rent money for October 2014 along with the key deposit I am once again seeking the return of the rent money for September 2014 as outlined below.I spent approximately eight days cleaning the studio apartment located at 103 South Street, Northampton, MA and it was still uninhabitable, even after my efforts. I reported this to your agent, [redacted] and she left various voice mail messages (saved to my phone) to resolve this major cleanliness issue as follows: on September 10, 2014 ( 5:30 PM) [redacted] stated the landlord agreed to send in a paint crew but not for a "month or so" (yielding an October date still not reached) and on September 11, 2014 (-3:00 PM) [redacted] said a professional cleaning crew can come in and clean the studio apartment with no date given. She also stated they were unaware that I had not moved in yet due to the apartment filth. If painted, I would have not been able to stay in my apartment for 30 plus days. Both solutions as presented, meant the apartment could not be used until properly cleaned and painted. The fact that your agent offered to bring in professionals, demonstrates a lack of cleanliness in the apartment. This should have been addressed before the keys were given to me. I was unable to stay any nights in this apartment due to the filth to the point where I could not even use the bathroom or the kitchenette. I paid you for a service of housing that I never received.I expect a check of $675.00 to be sent to the following address by October 14, 2014.[redacted] XXXXXRespectfully,[redacted]Cc: Attorney General Office Springfield MA Office - Complaint also filed on line Revdex.com[redacted]Desired SettlementI expect a check of $675.00 to be sent to the following address by [redacted], 2014.Business Response Thank you for the opportunity to respond to Ms. [redacted]'s complaint.With all due respect to Ms. [redacted], she has greatly exaggerated not only the condition of the unit in question, but also our response.She took possession of the unit on September 1st of this year. The first time she reported any issue with the conditions was approximately 9 or 10 days into the month. At that time she stated that although she had been cleaning the unit for two weeks she was unable to clean it to her satisfaction.To put things in perspective we are talking about a one room efficiency apartment. I is difficult to understand how a unit that size could have been so dirty that it couldn't have been cleaned in two days let alone two weeks.However, we accept that some peoples idea of clean can run to the extreme and in the interest of good customer relations we made several offer's to try and satisfy Ms. [redacted],First we offered to paint the unit. We did say that our painter was on vacation and it would have to wait until he returned. Ms. [redacted] said it was not an issue of just painting. So we offered to send a professional cleaning crew in right away and she turned that offer down.It was explained to her that we had sent someone in tq clean before she took possession and that if she wasn't satisfied it would have been better if she had let us know before moving some of her belongings into the unit. Although she claims that she had not actually been living In the unit she had moved in some of her things.When Ms. [redacted] rejected all of our offers to rectify the problem she demanded we return two months' rent. It was explained to here that because she had taken passion of the unit and waited almost two weeks to make us aware of the problem we could not return Septembers rent.We did return Octobers rent, the key deposit and reimbursed the rental agent who had returned their fee to Ms. [redacted].In our opinion the real issue was that Ms. [redacted] changed her mind after renting and exaggerated the conditions In order justify her demands. We examined the unit once Ms. [redacted] left and found none of the problems she claimed. We have sense rented the unit with no problems or complaints about conditions.We believe that we went far beyond what we legally needed to do to satisfy Ms.[redacted]. There will be no further attempts made. Management
