Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.
Regards,
[redacted]
My son did not purchase this fountain based on its price and/or value, but rather because he liked it so much. He easily could have purchased a more expensive one. I believe you knowingly sold a fountain that had been used by your bussiness for 2 seasons, with little or no maintenance.Yes, the fountain was purchased almost a year ago, however I contacted you very soon after that purchase.I will accept the $50 gift, valid through August 2018, as I am very tired of this matter. I would appreciate the new pump, with the short hose.  Mine is brittle and  cracking.

I have reviewed the response made by the business in reference to complaint ID [redacted], and want to make the following comment:
Tim has been focused on the idea that an animal has caused the issues we experienced.  Shortly after the planting of the tree, there did seem to be an area where an animal may have disturbed the mulch.  However the animal did not dig out the entire hole in which the 7 ft tree was sitting.  The tree was not properly backfilled during installation.  During Tim's visit, we did find ONE egg, NOT several, NOT a nest.  We have domestic ducks in this area that will leave a lone egg in bush beds quite frequently.  THIS FINDING HAD ABSOLUTELY NOTHING TO DO WITH OUR COMPLAINT.
Tim did remove the rope and burlap from the tree and bent down the wire cage.  However this was after TWO visits by his installer PLUS the Revdex.com complaint.  The issue is resolved but I have to say that the response Tim gave has ruined some of the goodwill that was reinstated by his visit.

I am addressing the complaint filed against us. I did talk to the customer a few times, and I told her she could bring the fountain back with her receipt for a full refund. The fountains never have green stickers, and the 20 percent off that her son received was a reduced price. I asked to talk to...

her son, who purchased the fountain, and she told me that was not possible. When I told her she could bring it back, she asked me how to clean it up, and I told her how, and also that it is a regular thing to have to clean fountains, as they have running water in them and water reservoirs. Anything like that needs to be cleaned regularly. All in all I tried to work with the customer as best we could, but she was very difficult to work with. We are willing to give her a $50 gift card to use on whatever she would like in the store, for her trouble in having to clean the fountain. Let me know if that works.ThanksTim

Hello,We believe that Maria Gardens did not do anything wrong in the transaction that occurred between us and your son. The fountain was discounted, and your son saw the value in that, and purchased it for you. Like I said before, We are prepared to offer you $50 Maria Gardens Gift card, and I will even give you a new pump for the fountain, as a back up. This is a fair offer considering the fountain was purchased so long ago, and there was nothing wrong with the functionality of the fountain. Thanks,Maria Gardens

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Regards,
[redacted] Here is my response, I was unable to attach all 7 photos.Revdex.com case number  #[redacted]I am responding to Maria Garden Center’s response to my claim. I am numbering my responses so that are no misunderstandings and attaching 7 photos as well. 1.        The price label on the fountain did indeed have a green sticker on it when son picked it out, and the cashier rang it up as such. Again, Maria’s Garden Center regularly sells many brand new sealed items with that same sticker. See image ft1 and ft2.2.        I spoke to Tim a total of two times. My son works 10hr night shifts and is not available to speak on the phone during the day, furthermore, as I had explained to Tim both times; my son is embarrassed that he purchased a gift for me in such filthy condition.3.        As my son spent a lot of time and effort on purchasing the fountain, it would not have been proper for me to return it. I was willing to exchange it for the same model in better condition, but my suggestion was ignored. 4.        When I spoke to Tim, he assured me that cleaning off the algae was relatively easy. I had no idea what awaited me under that top layer of dirt. See image ft3 and ft4. (There is no sign of the manufacturer’s stamp in either image.)5.        Due to a year of serious health problems, the fountain stayed indoors until May, when I put it on our porch under a roof. There I began the long cleaning process. Removing the algae was much harder that Tim had told me.6.        In August, I finally got the fountain as clean as I could, and it was placed in its spot in our backyard. I filled it with water, but did not yet turn it on. A couple of hours later, I discovered that the water in the fountain had turned all murky/muddy.7.        I then dumped out the water to discover a very dark brown thick and slimy substance on the walls and bottom in the lower basin. My research indicated that this was sludge or silt as a result of poor maintenance. I spent several more days trying to scrape/wipe/brush out this muck. Finally it was as good as I could get it, with much of this substance still in corners, crevices and sides, but you could finally see the manufacturer’s stamp. See images ft5, ft6 and ft7. I called Maria’s Garden Center to speak to Tim, the cashier told me he was unavailable, and proceeded to rudely give me her advice.8.        During the 2 months that the fountain was actually run, it was meticulously maintained, and there was no sign of any new algae or silt. It has been very difficult dealing with Maria’s Garden Center making this; a ridiculous and upsetting experience for me. Every time I called; I got different information from a different person. It took Tim a very long time to return my 2nd call. This debacle has been a huge waste of my time, energy and effort. I am consequently still requesting a $100 store credit, valid until August 31, 2018. The fact that a business with such a high volume of sales would have such blatant disregard of the condition of their products , is completely inconceivable to me.

From: Maria Gardens <[email protected]>Date: Mon, Jun 8, 2015 at 1:49 PMSubject: Complaint ID: [redacted]To: [redacted], I am writing to you today in regards to complaint id [redacted]I just wanted to let you know that the issue has been resolved, I personally went to...

[redacted]s house and showed her how we planted the tree, removed the burlap left on the trunk, and also discovered that it was in fact a duck who was making a nest in the dirt around the tree, as we discovered eggs buried underneath. I also made it so the wire around the ball was not above the ground at all. When I left she was satisfied with the work we did. Let me know if you need anything else from us.
