On September 20, 2017, after receiving a recommended layout from Peter, I agreed to a contract with Marine Contracting Group, MCG, for a 10'x10? dock with a 4'x10? access way to the dock at a cost of $4,960.00. Also included for an additional $7,000 was to be a boat-lift installed by MCG. MCG was specifically asked to verify that I the dock and walk-out would be in water deep enough to properly use the boatlift and was assured by salesman Peter that it would work fine. A deposit was paid. In early 2018 I sent Peter photos of our shoreline questioning his assurance that the lift would be in deep enough water. At that time he said it would become a problem and that the dock needed to go out further at an additional cost of another $2000.00 regardless of what he recommended earlier. If we were to cancel the agreement we would lose $1300.00 deposit. At that time I advised Peter that I could not afford the additional $2000.00 and we discussed alternatives. One alternative was for me to put off having the electrical done for the boat-lift until I could afford to have it done (we were unable to pull permits anyway for work until after moving into new home). He explained that as the property owner I could pull my own electrical permits if that would help and that the boat-lift was wired from the manufacture to plug directly into a 110 VAC outlet until I could afford to get the lift hardwired. As it turned out, even the aditional ten feet that we paid extra for was not enough. When the MCG crew arrived to install the dock and boat-lift the crew boss informed me that the lift would have problems because of shallow water. He recomended to his boss that they at no cost to me add another five feet to the walk-out. After about three months (about a month after moving in) we lowered the boat into the water (MCG raised the boat upon install using extention cords) at that time we discovered that while the lift lowered the boat it would not raise it. We found that the control boxs were full of water and damaged.

Desired Outcome

Refund I request that MCG refund the aditional $2000.00 for added walk-out length and that they repair damaged boat-lift, extend waranty for boat-lift. They voided the waranty because I was accusing them of misleading me and they accused me of improper use of the boat-lift by not having it professionally wired by a licensed electrician (even though Peter said I could pull permit as property owner and use provided cords/plugs until then). When I called owner to complain about Peter he refused to talk.

Thankfully the manufacture Golden Boatlifts is far more helpfull than the contractor Marine Contracting Group.

After contacting the sales manager at the manufacture, we were not only never told that we needed a licensed electrican but in fact the manufacture sent us new switches free of charge to replace the water damaged switches and advised us on the best extention cords to use with the lift. Unlike the contractor, they never said the system waranty was void because of the way we had used it. In fact, they mentioned that the water damage can happen sometimes when hanging next to the system.

Because we were unable to do the electrical work ourselves due to the contractors demands we did have the work done by a licensed electrican costing more than $1000.00 so we could get the boat out of the water. I will again stress that we were told by the contractors salesman Peter before sighning contract that we could indeed install the electrical ourselves by pulling a property owners electrical permit with the county.

As far as the dock length. Attached please find an email I sent to Peter asking him to advise us ASAP (before signing contract) if the water depth was going to be a problem. I have also attached photos of the original shoreline and bank showing what the contractor knew they had to work with.

I would like to add that in addition to the problems with our dock not being in deep enough water. The contractor also needed to go back to our neighbors house and also extend out their dock because Marine Contracting Group failed to install the proper length dock for them too.
