for a failed company in the high performance boating industry. With over 2500 different products, we faced great challenges in reproducing all of the previously offered products. The specific product that is in dispute is a custom manufactured product for Fountain Powerboats. Unfortunately Fountain Powerboats is out of business. With Fountain Powerboats no longer utilizing this proprietary product, our production schedule for this specific part has suffered. This situation was explained to the client. It was also explained that I would eventually reproduce the product and that when the product became available I would let them know. As a sign of good faith, I sent the customer two step plates that share the same exact fit and finish as the Fountain Powerboats step plates free of charge. The only difference in the product is the logo. These complimentary parts were sent to the client so they could install them in their boat and when the Fountain Powerboats version became available, we could change them. The complimentary step-plates with the [redacted] logo share the same exact fit and finish as the Fountain Powerboats version. They also share the same exact cost. The customer received over one hundred dollars worth of product free of charge. The client makes a point to mention that they did not order these complimentary parts. As we are fully aware that they did not order them, it cannot be overlooked that they were given to the client free of charge as a temporary product to install in their boat. It is also reasonable to mention that this gesture was offered, not requested. At any point in time the customer could have sent the product back for a refund. There was never any mention or inquiry made on the products being returned. The customer isabsolutely more than welcome to send the product back, for a full refund. In addition, I would then ask for the complimentary parts to be sent back also. Fair is fair. It is important to note, the client was never charged for any parts that they did not receive. The dispute of $52.68 represents one Fountain step plate that was shipped to the customer. The customer has acknowledged that they have received this part. I would also like to add that these step plates are sold individually. The client specified that these step plates are sold in sets and that information is incorrect. The nature of custom parts in any high performance motorsport is often subject to lead times due to changing demands. These parts are not produced for the masses. In this specific case, we are literally the only manufacturer for this product worldwide. In closing I find it very unfortunate that the Revdex.com has been involved in a case with such a simple solution.
