I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below We kept our options package paperwork and the insulation option is not in there We still have it if you would like to see it Also this is our 2nd home with Marini and we went through several cold winters with severe temperatures and never had this happen in our old homeObviously there is an issue with this home We know a lot of neighbors in this neighborhood whose houses were built by the same builder and no one has had this experienceWe don't need a structural engineer to evaluate the house we need it properly insulated so we don't have wet spots on our ceiling Once it dries it leaves a brown ring on the ceiling that we will need to repaint every time it happens This isn't the first time it happened we put in a complaint years ago because of this same issue This time we had a professional company come in called True Building Performance to inspect and they determined that we needed more insulation to seal the drafts We would like Marini to cover the expense of properly insulating our attic so this never happens again Regards, [redacted]

I appreciate the response. Several of the items stated in the response are factually incorrect. The storm did wash away our seed the day before the closing. We were at the house the day before (during the storm) for our final walk through and the day after. The property was never regarded or reseeded. Regardless of the landscape package not being completed prior to closing, our issue is with the enormous amount of glass in the hard. Our lot is relatively flat (as seen in the picture) and we lost seed, not inches/feet of fill. We were told several times that the yard would be raked for glass and nobody ever came. In regards to the basement, I’ve brought attention to the issue several times. The basement crack issue was also documented in the one year walk through. I’ve attached a picture with “three quarters” in the crack to show the size. Once again, I was told the issue could be fixed and the work order was ultimately cancelled. Finally, I never received a work order for the type of siding that was used. The buckling in the siding continues to increase. I was told the “Certain Fiber” siding (non-winter grade) may have been used on my house. I was also told by a Marini representative that the work order reflecting the type of siding would be forward to me. Over the course of one and one half years I’ve been told items would be fixed. Ultimately, each item was not fixed and our work orders were cancelled

[redacted] .A landscape package was included as part of the purchase price. The landscape package includesfoundation plantings and street trees around the home. Also included in the purchase price was thegrading and seeding of the yard. At the time of contract, the Purchaser was provided an addendum as toour policy concerning the grading and seeding of the yard. The addendum specifically relates to erosionand washouts caused by heavy rain after the lawn has been planted and states that it is not covered underwarranty by the Builder unless the Purchaser elects to purchase a " lawn warranty". The Purchaserdeclined coverage under the lawn warranty. After the lawn was graded and seeded, a severe storm causedsignificant damage to the yard and washed away large amounts of fill that was used to prep the yard. Wefilled the washouts and re-seeded the yard at our expense as a courtesy to the customer. The yard wasgraded with clean fill, however, this is not to say that during extensive erosion as in the case of this job,fragments of debris and stones and rocks will not become visible. The yard consists of approximately 3/4of an acre of area and there was substantial fill imported to grade and seed the yard. Any debris thatbecomes visible after erosion occurs is a homeowner responsibility. We intend to take no further actionwith regard to this complaint.The Purchaser was provided a warranty with the home. The warranty covers structural items for ten (10)years. Structural items are defined as a defect to any load bearing portion of the home caused by failureof such load bearing elements which affect their load bearing function to the extent that the homebecomes unsafe or unsanitary. Cracks in concrete floors are not structural defects as they have no loadbearing capacity within the home. The performance standard for cracks in concrete floors is more than3/16" wide (must be able to insert 3 quarters in the crack) or 1/8" in vertical displacement.
