To whom it may concern; I was hired by Ms*** to remove trees from her house, repair shingles, repair fascia and gutters as well as replace (1) fence panel as per the contractIn good faith I had given her afair price as she claimed she did not have any insuranceI gave her a quote of
$for taking the tree off the houseShe said she would get back to meAfter a few days she contacted me and gave me the go-ahead to take the tree off the houseI asked for a deposit of $which she reluctantly paid. Ms*** was on the schedule for tree removal from the house and that took place during the 2nd week in MarchOn the day the tree was removed from the house I supplied an estimate for repairs which she accepted and provided me with a number for her insurance agent, Caroline Lawyer(keep in mind she initially said she did not have insurance) Later that day I had a conversation with Ms*** stating the tree would cost an additional $due to its size of 65' +She replied that it would not be a problem to pay that amount. Ms*** *** *** *** *** *** *** *** March 23rd I requested a payment as I had not yet received it for work done to dateMs*** claimed she was waiting for the check to clear her bank and she was unable to write a check because she didn't have checks with her accountOn March 28th I had still not been paid and she asked who to make the cashier's check payable toOn March 30th after dodging payment for the last couple of days she finally agreed to meet when it was convenient for her so she could hand over a checkShe paid the quoted price of $which included the cleanup of the tree as well as an additional (2) fence panels she requested on March 24thThe additional $(due to the size of the tree), approved by the insurance company, was not included in thatpayment and is still due and payable. Due to her upcoming closing the repairs for the house, gutters and fence were scheduled for~ week of April 10thBecause I was not there on April 10th she sent (6) text messages and (4) disturbing phone calls within the course of hour, each one being stronger than the last demanding an answer as to why I was not there that dayI was unable to answer as I was involved with an emergency job and wasn't able to take the call at that timeLater that evening while on my way home from work at approximately 7:I received a phone call from someone who said they were her realtor requesting a definite date the work would be completed and I was told it needed to be done by Friday morning, April 14th at the very latestThe soonest I could obtain the boom lift would be Thursday, April 13th which was within the time frame initially given. Ms*** claimed to have received a code violation due to the fence panels facing the wrong wayThe fence panels were attached to the existing panels with good sides on both sides for aesthetics. My first and only notification of the panels being a violation of code was while I was out of state. Ms*** is claiming a refund of $for the fence panels which are still in her possession. I am claiming a total of $due as follows: • $for additional cost of tree which she received (and then some) in her insurance payment according to her agent• $for reschedule of boom lift due to RUSH job as mentioned to her. I am willing to remove the (2) fence panels and credit her $260, reducing the amount due me $540.Respectfully yours, MrMark Brassie

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. The issue is he did not repair the fence as per my town's regulationsFrom his response, you can clearly see he wants me to reimburse him for the tree removal job and not the fence panels which had nothing to do with trees or boom rentalI do not think this issue will be settled, so I am content with Revdex.com adding this compliant to his Revdex.com recordIt is clear his not a person of integrity as I believed to him be, so I will move on from there.
