July 12, 2016Dear *** ***:I represent *** *** in the above mentioned complaintFirst, I must apologize for this delayed reply to the response of *** ** ***, Esq., counsel for Mark Cement Contractors (a/k/a Mark l***), miscalculated the response date and ask that you not hold my error against my client and add this reply to her complaint fileI am copying *** *** this letter and sending it to him via fax as well.Generally, *** *** refutes completely MrL***'s description of his contract negotiations with her and their subsequent dealingsIn particular:*** *** was never presented with a color chart from which to choose the paint color for the "thoro coat" sealant of the rear façade of her homeInstead, she told MrL*** that she wanted the color to match the façade of her home, which he viewed before entering her homeThere was no contract to repair and/or replace the rear façade because the rear façade did not require repair or replacement, it was in very good condition and not in a state of disrepair as claimedAfter the initial meeting where the work was discussed as well as a price quote, which she accepted, MrL*** returned only once on the day work commencedHe stayed briefly and then left his crew there unattendedHe never revisited her home after that dateAfter the first day of painting and cap replacement, *** *** contacted MrL***'s office and spoke to his assistant, MariaShe stated that she was not happy with the work at that pointThe color did not match what she had described to MrL***, namely the color of the front facing façade of her homeShe also told Maria that the quality of the Work was not to her liking, i.ethe paint was not applied evenly and spots of the old color could be seen, it was sloppily applied, there was spatter etc., Maria said she would relay the message to MrL*** and that he would comeback out to her home to inspectMrL*** never called *** *** or returned to her home to inspect her complaints. When *** *** called again a few days later, and was speaking with Maria, MrL*** got on the phone and began yelling and screaming at herHe used vulgarities and offensive language, *** *** said she would be glad to pay for the work done satisfactorily if his crew would come out and make things rightMrL*** then told her: "You can keep your f--- moneyI will never cash a check from you."After these incidents, and with the totally unprofessional and unacceptable manner in which she was treated, *** *** was compelled to retain another contractor to correct the unsatisfactory work performed by Mark Cement ContractorsThe new contractor found the correct color of "thoro coat" to match the front façade of the home and corrected the job done by Mark Cement satisfactorily and to *** ***' liking*** *** never refused to pay for the work that had been done satisfactorily and was, at all times, ready willing and able to payShe was told NOT to pay by MrL***After these events in April of 2016, she did not hear from MrL*** nor did she receive any further billings or invoicesAgain, she was willing to pay for work done satisfactorilyThe next notice she received was from *** ***, in a letter stating that she was in breach of contract and demanding the full contract price.As you can see, the parties are almost diametrically opposed in their versions of what occurred.Even though *** *** was dissatisfied and forced to make a complaint to the Revdex.com for not only the unsatisfactory work but for the unprofessional and offensive manner in which she was treated by MrL***, she remains ready, willing and able to pay for the work that was done satisfactorily by Mark ContractorsShe has also been and remains willing to negotiate the price of these services, since the contract was not completed by Mark CementShe is willing to pay even though she had to hireanother contractor to complete the job.I hope that *** *** will contact me to broker these negotiations so that the matter could be resolved amicablyIf there is any other advice or assistance the Revdex.com could offer, it would be most appreciated.Thank you for your consideration and courtesies.Very truly yours,*** ** *** Esquire

June 15, 2016Dear [redacted]:I represent Mark Cement Contractors. Receipt of your letter of May 31, 2016, your follow-up of June 7, 2016 and the Customer Experience information (complaint) of [redacted] are hereby acknowledged.Initially, Mark Cement Contractors and the L[redacted] family have been...

a respected company operating in Philadelphia for generations. They pride themselves on providing impeccable work in every instance, including services performed for [redacted].Mark Cement Contractors was contracted to "remove and replace 2” caps on cmu wall and to furnish and install thoro coat to rear wall” for a contract price of $2700.00. At the inception of the work, [redacted] was asked to select the color of the coating from a color chart. She told Mr. L[redacted] she was "looking for a brownish color, but not to dark". Ultimately, Mr. L[redacted] selected the color from a color chart provided by the material yard, a color which definitely fit the description of the color she described to him. In addition, it should be noted, the intent of the parties and what was contracted for was to change the color of the rear of the house, not to repair andlor replace the rear facade.Thereafter, [redacted] expressed dissatisfaction with the color of the thoro coat, which notably was a color which clearly met her specifications. She also complained about what she described as poor workmanship, which apparently did not satisfy her in the final appearance, because though the thoro coat was applied properly, as were the caps, the structure was in such a state of denigration and disrepair when the project was initiated, the impeccable workmanship could not cure these issues, nor was Mark Cement Contractors obligated to perform a complete rebuild of the area being coated. For example, you can get the best paint job on a dented 1968 [redacted], but if you do not wish to pay for the necessary bodywork to be repaired, you cannot then complain about the paint job, though it was painted with the utmost skill, because you are dissatisfied you can still see the dents, although the paint is perfect. That is exactly what [redacted] did and is doing here. In addition, Mark Cement Contractors revisited the job and addressed [redacted] complaints.Mark Cement Contractors performed all services it was required to perform and unfortunately, it appears [redacted], without a real basis, was dissatisfied by the color, which was within her requested color description and that the rear facade remained, structurally, in the same state as before the project, simply because the contract did not provide for repair of the facade.Thank you.[redacted], Esquire

To whom it may concern,Below is the exact response we sent to Ms. [redacted], job location [redacted]. I feel our response was adequate and timely to her initial complaint. As you will read below Ms. [redacted] has exaggerated our response into something of inappropriate by saying things like “Unfortunately concrete cracks “and as you will read below, we did not use those words in that manner. I also would be able to provide the actual email where this below letter was written to Ms. [redacted]. We have been running a reputable business in the Philadelphia area for over 30 years and have been cited throughout the city as dependable, reasonable and provide quality work. Hello [redacted], Unfortunately, cracking is pretty common in concrete, especially during an extremely cold winter like we have just had. In most cases with our work being prepped and done correctly and the conditions are ideal, the cracks can be virtually unnoticeable from plain view, except the homeowner's prudent eye.
There are a number of reasons why concrete cracks. The most common is because concrete shrinks as the excess water evaporates and it hardens. Unfortunately, we have had a lot of that over this winter with the cold temps and freezing conditions of snow and ice. Weather conditions – extreme temperatures, rapid temperature changes or conditions that are too wet or too dry – also play a major factor. Many variables alone could have played a factor as to why your concrete cracked.
I advise all homeowners to acknowledge the fact that although unwanted, concrete does crack. With that said, the cracking is not severe – big enough that you can fit a quarter in the crack – at that point I would say there is an indication of a problem and would deserve a conversation with you and I about an agreeable solution. So, in short I would have to say that the crack you noticed is in fact common and at this point does not require any action. Should you have any concerns or questions feel free to contact us.
