I have reviewed the offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
There is no resolution in his statement. But there sure are false statements.
My big question is WHY was he unable to finish the fence? He disappeared on or about the 1st of January never to respond to any e-mails, texts or calls. He just left us hanging and loosing much income along the way because of it. We HAD to hire a new contractor when, by early March, it was obvious that he was never to return.
1. He moved to work on another area because he neglected to contact [redacted] before his dig. I would not allow him to dig where utility lines were until all companies delineated their lines. This delayed his plans in one area and he moved to another to maximize his day. Our contract was for the entire job and there no concern mentioned by [redacted] concerning his focusing on another area.
2. I can provide photos showing how deep the posts were in the ground. They were 8 foot posts with a clear dirt line on them when they had to be removed.  [redacted] and I agreed on a very clear, contract for services with an unquestionable payment schedule. At contract time, there was no mention of upfront financing except for the agreed upon first installment which was 1/3 of the total cost of the job. It clearly states the payments and how they align to work completed. In late January, as per [redacted] request, and out of contract, we even provided an additional $1000, way ahead of the contracted schedule. Regardless, there were materials purchased and left unused (wood, cement) and left for ruin. There was much still left to be done that required no additional material expenditures.
[redacted] had numerous opportunities to return to the job or, in the least, simply correspond with us concerning his intentions. He chose to do neither.
Acceptable Compromise:
There is no question that a portion of our payments went to materials. But, our losses have accumulated, far beyond what he was paid, due to his lack of professionalism in quality of work and conduct. This burden should be shared. In the least, he should return our payments ($4,833.34) to help offset our losses.

Review: We hired [redacted]) to remove old fences and replace with new as outlined in the contract. He verbally stated that the job would be done by Christmas. He started the job, was paid $4,883.34 then disappeared, The work that had been started was incorrect, as per the contract, lacked quality standards and damages continue to accumulate. Incorrect As per the Contract under Fencing Quote and Contents:Posts that were removed were broken in the wholes leaving wound hazards and leg breaking hazards when rotted out. Field posts were set at 10 not 79 No cement was in the holes. The 60 round posts were put in with no cement. Back of cross boards were not painted before assembled. Lacked Quality Standards:Extremely loose Post were only in the ground by 1-1.5 Posts could be pulled out by hand and were removed) Three board fencing was not in the ground deep enough, extremely loose. Will be disassembled and removed (to be done tomorrow) Wonky angles)Debris left Damages:As a presently full horse boarding stable who shares fence lines with a flourishing dairy farm, we have lost the use of four fields for 5 months - the adjacent farmers cattle field, a rented out cattle field, and two horse fields resulting in additional hay expenses, loss of rental fees and much inconvenience by both establishments. Oak boards were left in the weather to warp and shrink Cement was left to harden in the bags under an unsecured tarp with no under vapor barrier. It is all ruined (CONTINUES. . .)Desired Settlement: I request that [redacted] be required to pay the additional costs, to complete the job, plus damages.

Response:

I spoke with [redacted] from the business and he stated that the fence is about 1,600 feet. He was taking down the old fence and putting up the new fence when he was told to stop and work on a different part of the fence. He did put the posts 4 feet in the ground. He wasn't able to finish the fence and the consumer was hiring another company to finish the fence. The payment the consumer has paid was for the materials that were already bought for the job. [redacted] stated that he explained to the consumer that he could not finance the job and would need money upfront to pay for the materials.

There is no resolution in his statement. But there sure are false statements.

Acceptable Compromise:

There is no question that a portion of our payments went to materials. But, our losses have accumulated, far beyond what he was paid, due to his lack of professionalism in quality of work and conduct. This burden should be shared.
