I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowAs noted in my complaint, Market Domination's guarantee was NOT for services rendered; the guarantee was for REVENUE and their was none generated per the agreement in the 12-month launch period from 1/1/- 12/31/See attached agreement dated 9/12/13, my letter to Market Domination dated 3/18/and a follletter to Market Domination from my attorney dated 4/4/Because their marketing campaign was unsuccessful in the first three quarters of 2015, we shifted gears in the 4th quarterThe claim that they "heard nothing from Ms [redacted] for more than three months" is as I met on various occasions with [redacted] , COO, and have numerous text and e-mail exchanges with Market Domination staff as proof That said, it was my intent at a meeting on January to terminate the business relationship and request my refundAt that time, MrGreene profusely apologized for his failed effort and asked for a short extension to "make things right." An updated/revised agreement was not presented to me and when asked, MrGreene was vague on how much time he requiredAfter 60+ additional days this was just dragging on so I sent a letter dated March 18, requesting a refund in the amount of $15,(cash amount I paid to Market Domination.) The agreement was for $20,- $5,was deducted in exchange for a qualified lead I provided Regards, [redacted]

This is not true.We spent months marketing to HR directors for her and she never replied.  It took three months for her to change her mind and say she didn’t want HR directors anymore, as she now thought they viewed her as a threat. Also the additional marketing we did was working, and she approved her first three podcast interviews, but cancelled the week they were due to air. Also the guarantee stated that we would achieve the revenue target, or refund her money, or work for another 12 months at no charge – at our discretion.  We chose to keep working, and she agreed to those terms, so no refund was due.  If she wanted to cancel early and walk away, that is her prerogative, but again, not a refundable event when we were within sight of the finish line in terms of generating sales.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. As noted in my complaint, Market Domination's guarantee was NOT for
services rendered; the guarantee was for REVENUE and their was none
generated per the agreement in the 12-month launch period from 1/1/15 -
12/31/15. See attached agreement dated 9/12/13, my letter to Market
Domination dated 3/18/16 and a follow-up letter to Market Domination
from my attorney dated 4/4/16. Because
their marketing campaign was unsuccessful in the first three quarters
of 2015, we shifted gears in the 4th quarter. The claim that they "heard
nothing from Ms. [redacted] for more than three months" is false as I met
on various occasions with [redacted], COO, and have numerous text and
e-mail exchanges with Market Domination staff as proof.  That
said, it was my intent at a meeting on January 5 to terminate the
business relationship and request my refund. At that time, Mr. Greene
profusely apologized for his failed effort and asked for a short
extension to "make things right." An updated/revised agreement was not
presented to me and when asked, Mr. Greene was vague on how much time he
required. After 60+ additional days this was just dragging on so I sent
a letter dated March 18, 2016 requesting a refund in the amount of
$15,000 (cash amount I paid to Market Domination.) The agreement was for
$20,000 - $5,000 was deducted in exchange for a qualified lead I
provided.  Regards,  [redacted]

Please be advised that this firm represents Market Domination in connection with the above referenced matter. Please be advised that my client disputes the matters set forth in your letter of April 4, 2016. Ms. [redacted] is not entitled to any refund. Market Domination undertook a second marketing...

campaign for Ms. [redacted] in 2015 which successfully garnered substantial interest from a number of human resource directors. Unfortunately, my client heard nothing from Ms. [redacted] for more than three months. Thereafter she determined to go in a different direction by requiring Market Domination to scratch the website it had built for her and rebuild a website according to her less marketable and far more conservative specifications. Remarkably, in December of 2015, Ms. [redacted] expressed her interest to continue working with my client by which my client agreed to create a new podcast and book featuring business owners and their hiring/firing issues to get Ms. [redacted] in the door. Market Domination succeeded in generating the interest of a number of business owners of which Ms. [redacted] conducted six interviews. Having provided herapproval for three podcasts on March 11, 2016, my client was both surprised and dismayed by your clients request for her money back only ten days later.  Clearly, my client has gone above and beyond its obligations and efforts for Ms. [redacted]. As such, Ms. [redacted]'s demand is hereby rejected. Thank you for your attention to this matter. If you have any questions, please contact me. Very truly yours, HCC/rar cc: Mr. Seth Greene Doc ##[redacted]
