We were originally contacted by *** *** on August 10, He contacted the company to order signs for ABMG/Palomar Tax and ultimately requested the creation of three large custom acrylic signs on with a company logoIt should be noted that the signs were purchase by Mr***
individuallyHe communicated with our representatives concerning the design and ultimately received proofs and a quote that were approved by himA copy of the email communication between *** *** of Marketing Instincts and Mr*** is attached showing receipt and approval of the proposalA copy of the proposal is also attachedAs the order was for custom signs, payment must be made in advanceA copy of the credit card receipt attached shows that payment was processed on September 14, 2016, and the Invoice/Remittance Stub shows the charges for the signs and paymentAll work was approved and paid for by Mr***Marketing Instincts had no payment information for Mr*** prior to sending the proposal and would have only received the credit card information upon approval. The custom signs were delivered as requested on October 14, A copy of the Delivery Confirmation is attached showing that either Mr*** or another individual at ABMG received the signsClaims by Mr*** that they attempted to refuse delivery of the signs or that the signs were left in the hallway are unfoundedMarketing Instincts would have no incentive to force delivery of the signs, as rejection of the delivery by Mr*** would not have relieved any obligation to pay for the custom signsA short time after delivery of the signs Marketing Instincts was contacted by ABMG and told that Mr*** no longer worked with the ABMG, and that they had never approved the order of the signsAt some point the signs were shipped back to Marketing Instincts, however, they are of no value to Marketing Instincts as they are custom signs that cannot be reused in any way. Mr*** has already submitted a dispute to his credit card company in an attempt to have the charges reversedA copy of the Dispute Summary and Dispute Notification are attachedThe credit card company ultimately decided in favor of Marketing Instincts and against Mr*** and the charges were not reversedAs a result, Mr*** now has taken the matter to the Revdex.com. From the facts set forth above it is plain to see that Marketing Instincts did nothing wrong in this situationThey received and fulfilled an order as requested by Mr***Mr*** may not have gotten approval from ABMG prior to making the order, but Marketing Instincts had no way of knowing thisMr*** elected to purchase the signs in his individual name and pay for them on his personal credit cardThe fact that ABMG may not approve of the charges and may have been unwilling to reimburse him for the purchase does not change the fact that the signs were ordered, paid for and delivered, and that Marketing Instincts completed all of its obligations in this transactionAs a result, the complaint of Mr*** should be determined in favor of Marketing Instincts

I am rejecting this response because: they have the merchandise and I never signed for it. Here is a timeline of everything and all the documentation. 
8/15/16 MP: Order Initiated
8/18/16 8:25am- MP: “Following Up”
8/18/16 11:47am- MP: “Following Up”
9/2/16 at 4:59pm- Marketing Instinct: They said they were going to send the quote and art soon
9/2/16 at 4:59pm- [redacted] Marketing Instinct: [redacted] sent me lower prices for the signs. Then decided to charge an extra $500 per sign. See attached, “Exhibit A”
9/12/16 9:22am- MP: “ Following up on this and the artwork for Palomar and ABMG. We need to finish this order ASAP.”
10/10/16 8:51am- MP: “Any Updates? It's been over 1 month and I have not been updated on anything. Can you help me?”
10/10/16 9:38am- MP: “I have called several times and sent emails and have had no response. This was really poor professionalism, follow up and customer service. I am paying for a list customer service and I am really disappointed that you didn't email me at least letting me know that you tried to get in contact with me etc. it's been OVER 1 month and still no sign. This is beyond crazy!”
10/10/16 11:20am- Marketing Instinct: We are extremely sorry for the limited communication and for the mishap with the email update regarding your order.  We are working as quickly as possible to remedy the situation and will keep you updated every step of the way.Currently your order is scheduled to complete Wednesday in which the items will come back to our warehouse for QC.  I will coordinate with our production team to have these items delivered on Thursday to the address that you have provided. As soon as the items deliver, we will update you via email with the delivery confirmation details.” 
10/10/16 12:23pm- Marketing Instinct: “I hope you had a great weekend! I apologize for the delay. I tried calling you back several times on Friday before I left the office, however the call kept going to a disconnected tone.Our production team sent out an email on 9/26 letting you know that the factory had mistakenly produced the signs in the wrong size and we were having them create new signs.  I apologize, it appears that the email may have gotten caught up on our server outbox.  I have reached out to our IT company to look into this further.As of now, the new corrected signs are scheduled to complete by this Wednesday and we can schedule delivery on Thursday or Friday.  May I confirm which day works best for you and the address that you would like them delivered?Sorry again about the email mishap – Our team did not realize that email may have not gone through correctly.If you need any additional information, please feel free to reach out to us any time.”
10/13/16 2:51pm- Marketing Instinct: Sent me an invoice with higher prices. See attached, “Exhibit B”
Note: Completely overcharged for these signs, because I inquired about them making a sign that had the same specifications as the ones they made and the prices were much lower. See attached,“Exhibit A”.
10/13/16 2:41pm- [redacted] Marketing Instinct: Sent me an email where I would like the sign to be delivered. 
Note: I never told them when and where to deliver the signs. 
10/14/16 12:31pm- Marketing Instinct: They said they delivered this on 10/14/16 at 12pm
10/15/16 9:08am- MP: “I apologize to have to say this, but the sign is going to have to be returned, if you can please pick it up that would be great. We spoke the day before about ABMG possibly changing their mind since the ball was dropped on your end in poor communication after numerous attempts in reaching out to you and that I would let you know by the next day if they would want it or not anymore but then I found out that they already delivered it. It took over a couple months for them to finally get the package...was really late.  Also, another thing that made this really bad was it had my address and it should have never had my address on it like previously mentioned. Please refund the amount that was charged.”
10/23/16 11:10pm- MP: “I do not appreciate you making slanderous/ false remarks concerning me. And I ask that you refrain from it. You were suppose to get back to me about refunding this and you never did. Where is my refund? No one ever got back to me. Did you pick up the merchandise?” (No Response)
10/23/16 11:10pm- MP: “Wasn't this picked up? Please call me as soon as possible ###-###-#### so we can resolve this matter. This was suppose to be refunded. [redacted] said everything was being refunded, but it was not. I would like to try to resolve this with you guys instead of the bank, please let me know how we should proceed. “
10/23/16 11:53pm- MP: “Before you were to deliver, you were suppose to call me first and this never happened. Secondly, you waited over one month to complete the order and apologized in the below email. Thirdly, the items are over priced. The items were suppose to be picked up and then refunded. What happened to everything?”
10/25/16 9:24am- MP: “When is the sign going to be picked up so I can be refunded?”
10/25/16 6:30pm- [redacted] Marketing Instinct: “We will be finalizing the details this week with ABMG and will keep you posted as soon as there is an update.”
11/11/16 4:10pm- MP: Followed up on the refund and pickup (No Response)
11/12/16- MP: I initiated a dispute with my bank 
12/23/16 11:47pm- MP: Followed up on refund and pickup from [redacted], since he promised on 10/25/16 that he would be doing this. (No Response)
12/31/16- MP: After no response, I paid $266.85 (See attached, “Exhibit D”) to send it back to them and then it was delivered/ signed by the merchant on 1/04/17 by KKERR. I also sent this information to Chase Bank since they asked for it in order to process a refund. See attached, “Exhibit E A & B”
12/29/17 CHASE: Chase called me, but unfortunately we got disconnected and then I immediately called back, but unfortunately they already closed the dispute since we got disconnected. I found this out after I called back after we got disconnected, but they reopened the case and asked me to return the merchandise, so I returned it and sent the tracking number to Chase. 
01/30/17 CHASE: Chase requested Marketing Instinct to refund the money back to me since I returned it back to the merchant, see attached, “Exhibit H 1st Page”
02/07/17 6:30pm- Marketing Instinct: Marketing Instinct denied Chase in refunding the money back to me because it was after the time frame of disputing it, but did not have any other reason of denying my refund. Chase 
4/12/17 12:44pm- MP: Followed up with my refund (No response)
To add additionally, we never once signed for the signs at all. That had to have been a forged signature made after refusal of delivery and it being left outside the office. They also defamed my character by stating false accusations against me from my previous employer, see attached “Exhibit H 2nd Page” by stating, “These fraudulent practices lead to his termination from the ABMG on 9/8/16 among other statements in the letter they sent to Chase. Also, they said I or someone I know signed for this, but no one signed for this in my name, this is not even my signature whatsoever. It states on the document from Marketing Instinct's stating that I, [redacted] received the signs. If it was truly someone was then they wouldn't have wrote my name whatsoever. Additionally, on the "Title & Company line", it doesn't even have ABMG on this line at all, we never signed for this. See attached, “Exhibit C”
They also completely overcharged me 120%.
I just want my money back. They have the merchandise and I just want my money back. Chase asked them for the money back, but Marketing Instinct’s refused to refund it and according to the dispute policy with Visa and Chase, the merchant can technically refuse to refund it back even if the bank asks them to refund it, which happened in this case. Marketing Instinct's keeps saying that Chase found it in their favor, but Chase asked for the money back. You can also call Chase Disputes specialist to verify this as well, Ashley Miller Senior Specialist, ###-###-#### Ext. 6543272.
