6/5/2016This letter is to reply to the complaint by [redacted] My name is Mark R [redacted] , owner of Marks Auto Repair inc upland, PaI have been in the auto repair business for years [redacted] s car was repaired on approx 5/20/at my shopIt was found to be in need of a transmission after discussing repairs we agreed on a salvage yard or "used manuel transmission"explaining to [redacted] there would only be a six month parts only no labor warranty on a used transmission he agreed so we completed the workAs a note before we recieve the transmission and make payment we inspect it before it comes off the delivery truck to my shopI do a visual check of the case for crackes, any broken parts, damage to output shaftsshift linkage any electrical partsSeals, gaskets and all mounting holes for installationwhen installing the transmission I put in a new clutch, pressure plate and release bearing along with a new flywheel "not remanufactured but brand new" also changed the oil in the trans to make this job as right as I can from the beginningthe installation went great, took for a test drive and it shifted great, very smooth with no transmission noises, whines, ectAfter [redacted] took the car he called me about leaks he saw and isaid to bring it back and I will take a look and see what it isExamining the leaks it was found both axle seal were leaking and told him the seals need to be replacedAt this point he asked me why I didnt remove the new seals from his defective transmission and install them in the replacement transmission because he said that they were just replacedi explained to him once a seal is pressed in installed the only way to remove it is to destroy itI explained there would be a labor charge for the work but the seals and fluid would be covered and he agreed before I did the work [redacted] seems to think there is a six month parts and labor warrantyThis was never the case, this transmission is a used part not newnot remanufactured where there would be a labor warrantyExample: you go to a junkyard, salvage yard, ect and purchase a used alternator for your car and install it or have it installed and it is bad "does not do what it is Supposed to do" it is not the installers responsibility for labor on a used part that is badThe junkyard will exchange the defective alternator "you hope" but will not pay labor to replace the partThis is common senseWe thoroughly inspect what we install but dont have a crystal ball to tell the future of a used partIm willing to give the $axle seal labor charge back to [redacted] "not an admission of guilt, just to be nice" [redacted] still has a six month parts warranty on the transmission, if the transmission totally fails he will get another used transmission "FREE" but will have to pay labor to have it installedI hope this clears up the situation between [redacted] and marks auto repairi dont like to have a unhappy coustomer and this is the first time I ever did work for himSincerely Mark

[redacted] seems to think there is a six month parts and labor warranty. This was never the case, this transmission is a used part not new. not remanufactured where there would be a labor warranty. Example: you go to a junkyard, salvage yard, ect and purchase a used alternator for your car and install it or have it installed and it is bad "does not do what it is Supposed to do" it is not the installers responsibility for labor on a used part that is bad. The junkyard will exchange the defective alternator "you hope" but will not pay labor to replace the part. This is common sense. We thoroughly inspect what we install but dont have a crystal ball to tell the future of a used part. Im willing to give the $200.00 axle seal labor charge back to [redacted] "not an admission of guilt, just to be nice". [redacted] still has a six month parts warranty on the transmission, if the transmission totally fails he will get another used transmission "FREE" but will have to pay labor to have it installed. I hope this clears up the situation between [redacted] and marks auto repair. I dont like to have a unhappy coustomer and this is the first time I ever did work for him. Sincerely Mark
