Mr*** retained our firm to assist him with the purchase and redemption of a homeowners' association lienOur firm filed the assignment of lien and notice of intent to redeemWe believe that there are two ways to redeem from a sheriff's
sale: (1) by redeeming through the Sheriff; and (2) by redeeming through the certificate holderWhile our firm timely filed the notice of intent to redeem with the Registrar of Titles, we did not timely file the necessary documents with the SheriffThus, the Sheriff refused to accept the redemptionOur firm then attempted to redeem through the certificate holder ("bank")The bank refused to accept the redemption even though the funds were offered prior to the end of the redemption periodOur firm then deposited the funds necessary to redeem with the District Court and filed a lawsuit in District Court against the bank to require them to accept the redemptionPrior to resolution of the matter with the bank, Mr*** decided to dismiss the case because he no longer wanted the property, in part because of his belief that the property had declined in valueWe have provided Mr*** with the contact information for our malpractice carrierIf he decides to bring a claim against our firm, our carrier will evaluate the matter, and if appropriate, attempt to resolve the claim

The firm was contracted to file and redeem the lien from the homeowner associationThe contract that we made with this firm specifically stated that they would redeem the lienThe correct way to do this would have been to file the court required method of redemptionThis was to file the redemption days prior to the day waiting periodThis firm did not follow this procedure and we lost the right to have any lien against the property
We now have to retain another lawyer to get a fair settlement with this firms insurance carrierNo full loss settlement was offered by the insurance carrier

Our firm attempted to resolve the matter by retaining outside counsel, at no cost to Mr***, to force the bank to accept the redemptionWe believe that the bank wrongfully refused to accept the redemptionHowever, Mr*** voluntarily dismissed the case before there was a resolution to this matter
