On April 30, 2018, shortly before we purchased our townhouse, we wrote to *** of Markwood Management to clarify the condo fee and what it covers. She failed to notify us that the condo fee the selling agent provided us was in fact less than the actual condo fee amount. We only learned the correct amount on the date right before our closing. This lack over oversight leads us to believe that Markwood Management is not properly collecting condo fees. This, combined with nearly line item being over budget and the incorrect P&L given to unit owners at last September's Annual Meeting is enough cause for us to request to see the financial documents of the condo, which we are legally entitled to view and copy. It has been more than 30 days since we requested to see these documents, with no response from the Board of Trustees or Markwood Management.

On June 28, 2018 (only weeks after we moved in) I wrote to *** at Markwood Management and notified them that our stair railings were a hazardous safety concern. On July 9, 2018, *** finally responded and notified us that the railings of the property were scheduled to be addressed that year. The railings were never repaired. A letter was sent by our lawyers on November 14, 2019 again demanding these be addressed. As of today’s date, our railings still remain a safety hazard. The railings on many other units have completely fallen off or are in a state of disrepair. This has been reported by me to the master insurance.

Since April 2019, I must have written to complain about the smoking coming from our neighbors 30 or 40 times to Markwood Management over the last year and I almost never receive a response. I even sent letters from my doctor and another unit owner's doctor. When they are out there chain smoking, we can smell the smoke in every room of our house, even with the doors and windows shut, and I have developed documented health issues as a result of their smoking. Rule #2 of the condo documents (which *** sent me in an email) state: No unit owner or occupant shall make or permit any noxious or offensive activity or disturbing noises in the units or do not permit to be done therein, which will interfere with the rights, comfort, or convenience of other unit owners. The littering and smoking still has not been addressed, largely due to the fact that one of the smokers is a trustee. Trustees have been given preferential treatment time and time again.

I tried to run for the Board of Trustees but Markwood Management withheld the paperwork related to the vote until just two weeks before the vote was set to happen. Other unit owners informed me they received this same paperwork many more weeks in advance. A trustee told me in person he would personally stop at nothing to make sure I was not elected and another made a threat against my life to another unit owner (which was reported to Markwood Management lat September and still has yet to be adequately addressed). At the meeting, the votes were counted. Many unit owners asked for the votes to be counted by an outside neutral party, but Markwood Management declined. Many other unit owners also addressed Markwood's lack of transparency and lengthy response times to complaints. To this date, more than 6 months later, the results of the election were never officially announced and notes from the meeting were never sent to unit owners.

On November 14, 2019 we delivered our second demand letter written by our lawyers, which requested access to condo documents that Markwood Management is legally obligated to furnish to us, it also requested for the railings, a safety hazard to be addressed, as well as a timeline for when the siding on our property would be replaced. Finally, it addressed our ongoing issues related to our health and safety due to the three neighboring units owners who smoke incessantly. As of today's date, no response has been received.

Markwood Management does not adequately reply to complaints in a timely manner.

In early February of 2018, we wrote to Markwood Management about a leak, coming from our neighbor's balcony, and leaking down into our garage next to our electrical panel. We wrote several more times, with no response. Finally, in April, when I threatened to file a claim with the master insurance company, she responded. It took 6 months and several dozen more emails, and four visits from the repair guy, to get this hazardous leak repaired.

On January 21, 2019 I wrote to *** to ask for permission to replace our garage door to a plain white garage door to match the others on our block. We hoped this would keep out some of the second hand smoke from our neighbors. It took her 11 weeks to give us a response and to approve the repair (that we paid for).

All of the above has been thoroughly documented.
