Sent: Monday, February 08, 7:PM Subject: Revdex.com Case #*** Mr*** stated we have been unprofessional and rude for years which is untrue and provides no facts to back his claimsI have email proof from our discussions of him being rude towards me which I will gladly provide to the
Revdex.com and him to see, and on January 22nd, he hung on meI have been nothing but professional and tried to assist him and discuss his concernsHe has been rude and wont listen to what I say, and hangs up or doesn't want to talk on the phone when he cant get his way (which I have proof of)On Feb 24, 2015, I told him if he wished to discuss it further contact me on my cell so I can explain everything to both of them, which he replied "I see no point in arranging to get us all on the phone until the aforementioned has been handled as it would merely waste everyone's time." In a separate email I told him I have been awaiting his phone call to discuss it like he last agreed upon and haven't heard from himThat he can reach me the following day so I can speak directly to himI can address what you are asking and make sure everything is understood and all of your questions are answeredI even told Mr***, "I don't see a phone call to discuss the matter wasting anyones time, so please contact me tomorrow should you wish to discuss." He then emails me back saying it would "only be productive if I have coreect, up to date informationBased upon what was sent to us, that is not the case." Therefore he refused to even communicate with me about the matterI have all proper documentationAnswered and tried to address all questions and concerns but he REFUSED to call me or answer my callsHow can you HELP someone if they wont even speak to you, yet he claims I have been unprofessionalI have went out of my way to talk to him on several occasions because our company reputation means everything to me and so do our customersWhen you have a customer who refuses to speak to you, you know that IF you can speak to him it will only be him arguing against what you have to say, which has been the caseThe fact that he claims we refuse to explain why or even go to the trouble of working up an updated and correct schematic of everything done to date is complete bogusI have sent him the first diagram and then the updated diagram showing where the new work is proposed that we suggested which I will include both diagrams in this email, before and now current proposed piersTo say our work is shoddy and ineffective is offensive, he didn't even own or live in the home when the original work was doneIt was originally done for *** ***Unless he is an engineer, it is unfair for him to claim our work as such unless he has the background to backup his claims and has thorough knowledgeable about foundation repairthis is my very last email to the customer, which was dated February 1st 2016: Subject: Foundation Repair From: *** *** *** *** *** Date: Mon, February 1, 7:pm To: *** Priority: Options: View Full Header | View Printable Version | Download this as a file | Add to Address Book | View Message Details I have already discussed everything with you about your residenceThe warranty is being honored and is still in effect for where we have done previous repairs, in no way have we denied your warranty or not honored itIt needs new work as I stated, in locations that hasn't been worked on, which means there is not a warranty in those locations, only the locations we have repairedJust because we do repairs on some of the house, it does not warranty every location of the house where piers aren't placedLike I mentioned to you on the phone when you hung up on me, you can provide us an engineer report since you disagree with what we have advised youIf the engineer report finds that any of our piers under warranty need to be adjusted, we will adjust them under warranty per his reportIf you read your warranty closely, like I also told you, it states "Owner must provide evidence of settling in the area which the contractor performed workThe settling must exceed 1" in 8.33'Owner understands that suitable evidence must be in the form of a real estate inspection report completed by a licensed real estate inspector or engineer provided at cost of the owner." I also told you we have already been out there and went over everything with your spouse, and you want us to come back out to explain in person to you since you didn't make arrangements to be there the first timeWe have told you over the phone and now through email multiple times your issue and you want to argue about itUs coming there in person to explain something that was clearly explained to your spouse and you over the phone will just lead to more arguing about it and nothing being solvedYou mentioned you will contact the Revdex.com, but that will solve nothing to fix your home and I have presented the truth of your situation in this email which I will show them should you file a complaintWe have done everything and more to explain it to you and suggest what needs to be done, so at this point, I would AGAIN advise you to contact an engineer and provide us that report, like the WARRANTY calls for that you signed and agreed toYou mention us not "standing by our warranty" when it is you who is not standing by the contact YOU signed and agree toWe will gladly fix anything under warranty that needs it per engineer, but will not waste the time to come out there AGAIN just to argue with youYou can send over the report should you decide to go that route and we will review it then take care of any issues that do not include installing new piers as we have said you there isn't a warranty or we aren't honoring itI will attach a copy the warranty with his name on it and the previous owner and UNDERLINE the terms of the warrantyIt states he must provide us with evidence of settling and we will fix it according to the report IF it needs itAs I told him on the phone and this last email, hire an engineer LIKE THE WARRANTY SAYS YOU MUST, and should the engineer find any of our existing piers need to be adjusted, we gladly will, we never said we wouldn'tThe problem is, Mr*** is not following warranty procedure and also wants to argue about what the house needs or doesn't need when he isn't a professional on the matterAgain, when someone doesn't want to speak to you on the phone or hangs up on you, you can only accomplish so much with such a stubborn personThe Revdex.com and home owner has our word if any of our EXISTING piers are found to be adjusted by an engineer we will do it, no questions askedThe home owner refuses to listen, or do what the warranty calls forHe urges us to come back to his house to reexplain everything, when we have already been out there and done so in person to his spouseHe happened to not be there when we met with her because he failed to make arrangementsShe understood and even specifically explained the new proposed pier locations to herSo he wants us to come back out to tell him in person, the same thing we have told her in person, him on the phone on multiple occasions and also told him through email, it needs more piersJust because we did some piers on the house, doesn't mean every square inch of the house is covered under warranty, the warranty is for STRICTLY where we have placed piers previouslyI know we will not accomplish anything in person since he hangs up on me, refuses to listen, thinks he is a professional on the matter of foundation repair, and isn't following what the warranty says he has to do to begin withWe didn't even have to come out the first time to address his concerns, we could of said, you have to provide us evidence of settling in those areas like the warranty says you must, but we did so as a courtesyAs PROFESSIONALSSo again, we have been nothing but professional and kindTrying to work with him but he refuses, so we are left with no option but to make him follow the warranty procedure of providing us with a report showing the evidence of settling by a 3rd party, so both parties are protectedI have attached several documents to the email in referenceIf you need anything else from me let me knowAnd nothing has changed, HE NEEDS TO PROVIDE US WITH EVIDENCE BY AN ENGINEER FOR ANYTHING TO BE DONE at this pointHe really needs to read over the warranty document, because it appears he has not due to his claims of "the entire thing is under warranty" and "a 1,sq ft home should not need constant foundation work"So many factors can contribute needing foundation work, more foundation work, or adjustments to foundation workThe warranty first sentence says "Owner recognizes that soil conditions in this area are such that some future shifting of the soil may occur, particularly during periods of extended dry weather"There are so many factors such as soil conditions, weather conditions, no gutters, improper drainage and/or grading, big trees around the house, sewer or plumbing leaks that can cause more problems to a home that are out of our control Break down of the Attachments in this email are as follows (in order and as file is labeled): 'Email #1' - conversation of him refusing to speak to me 'Last Email sent to customer' - this was the last email sent to the customer which is also inserted in this email, telling him once more, for probably the 5th time that he needed to get an engineer report and send it to us, and everything I told him right before he filed his complaint 'Warranty Underlined' - document of the lifetime warranty, that remains good and intact for the customerI underlined the parts where it doesn't cover the entire house and also where it states he must provide us evidence of settlement from an engineer report 'Diagram #1' - The very first diagram of the house for the first work we did for the previous home owner, *** ***'Diagram #2' - This shows the original work, then piers #1-that we added for Mr***, of which are on the outside/exterior and pier (marked as #10) on the inside/interior of the house'Diagram #3' - This is the final diagram, showing all of the work done to this point on the exterior and interior (diagram #& #combined) plus it also shows new proposed piers that we said it needs that they do not want to do because they think these locations are already covered because ONE interior pier has been done, so therefore think all of the interior of the house is covered under warrantyThe interior has dropped in multiple locations since thenThe piers #1-are all in NEW locations that we have never done piers, therefore NOT under warrantyRespectfully, *** *** LEVEL CHECK
