To whom it may concern: Re: Complaint number *** My name is *** *** and I am one of the owners of Marquis Motorcars Inc On January 27, Mr*** *** Purchased a *** *** * from our companyHe traded in a *** *** sedanHe wanted to
make an even trade for our *** *** for his *** as he claimed he had "no money" to exchange in the deal We contracted to make an even trade however there was a $registration, title and documentation fee that need to be to paid His initial reaction was that he was not able to pay the $due to personal reasons Initially we are unable to come to an agreement because he was not pay the $He subsequently decided that he would borrow the money in order to purchase the *** *** On January 27th as evidenced by the attached documents, he took delivery of his *** *** While he was finishing the paperwork we changed the oil and filter and performed a minor service on the vehicle prior to him taking delivery We wanted to ensure the vehicle was in good working orderWe provided Mr*** with a day or mile warranty on his vehicle as required by Massachusetts state law The first indication of any issue with Mr***'s vehicle was on January 31st by way of email to my brother *** All documents which I refer to in this email will be attached to this email in separate attachmentsIn the January 31, email Mr*** is complaining about a fan blower motor that is squealing inside his vehicle and felt it was rough when he changed the gears *** responded to this January email on the same day at PM in the afternoon We never again heard from Mr*** again on any issue with his vehicle until March 15, at 4:PM as evidence by the attached email document In that email he describes an oil leak or spot on the ground as well as a check engine light that has come onNeither of these items were noted in his January 31st email We did not hear from Mr*** until a month and a half after his first email regarding his fan blower motor On March 2017I responded to Mr***I asked for his current mileage reading on his *** *** ** I could verify whether his vehicle was in warranty As evidenced by the March email I told Mr*** That I would be willing to look at his vehicle and diagnose the problem to determine what the issue was I received a call from Mr*** that same day when he told me what the mileage reading was on his automobileI checked his sale records and determined that his vehicle was out of warranty by mileage nearly miles over his mile limit At this point I did not verify the mileage myself nor did I verify any problems that he noted in either email At this time during our conversation Mr*** informed me that his friend was a technician that worked at a *** * *** dealership His friend advised him to call *** *** as the problem he was describing was a known manufacturers defect Mr.*** said if this is in fact the case he would bring the car to *** *** and have it checkedI advised Mr*** that if he was looking for any participation on our part any costs we would have to be verified before we made any commitmentThis was purely a gesture of goodwill Mr*** called me back approximately one week laterHe informed me that *** *** had inspected his vehicle and determined that the problem he was describing was in fact a manufactures defect and that they would contribute a considerable amount of money towards the repair costs I asked Mr*** what his out-of-pocket expense would beHe indicated the expense would be $I told him that I would be unable to contribute any amount of money until I was able to verify the problem with the vehicle and inspect it to determine if we had any responsibility Mr*** refused to bring me his vehicle and demanded I pay him $or he would disparage my reputation all over the InternetAt this point I was still willing to contribute some amount of money towards his out-of-pocket repair costsI thought it was reasonable for me to ask to look at his vehicle and verify there was an actual problem with his vehicleUnder Massachusetts law I am entitled to inspect any customers vehicles that they claim is under warranty Mr*** is claiming that this was a pre-existing condition and that I knew about a problem with this vehicle prior to his purchaseI told Mr*** I could not comment on the problem with this vehicle without inspecting itHe said that he lived in Rhode Island and it was too far for him to travel to bring me his vehicle He then once again demanded I pay $or he would disparage my reputationEssentially I felt that Mr*** was just trying to extort money from me because he could not afford the repair The conversation then shifted to his *** trade-inMr*** stated that I should pay him the $because I "made a lot of money on his trade-in" I informed Mr*** this wasn't true and that he misrepresented a lightbulb problem with his vehicle as in fact being a headlight ballast that had failed in both headlights. A very costly repair I did not ask Mr*** for any reimbursement for the cost of repair to his *** I merely informed him of a problem that he did not disclose to us I realize that we are the expert's and therefore accept responsibility for trading his vehicle in this condition The next exchange was one of verbal abuse from Mr*** continuing to try and extort money from me by threatening to disparage my reputation all over the InternetIn fact Mr*** conveniently leaves out that he called me an ignorant(expletive)He continued this line of abuse throughout the rest of the conversation I told Mr*** that if he going was continuing to speak to me in this fashion that I would not hesitate to hang upWhich I ultimatley did I have been in the automobile business a little over yearsI pride myself in selling quality automobiles in a professional and courteous manner I'm a well educated individual and do everything I can within my power to help my customersI don't believe it's fair or right to be verbally abused by someone because he cannot afford the repairs to an automobile that he purchased His vehicle by his own admission of his mileage reading was clearly out of warrantyRather than accept the fact that his vehicle was out of warranty he tried to extort money from me by lying, verbally abusing me and threatening to post bad reviews all over the internet He used the excuse that it was a pre-existing condition even though *** *** acknowledged that it was a manufacturers defect that caused the problem he was describing If you look at the attached email chain you will see that the first email that he sent has nothing to do with the second email he sent Those two emails were a month and a half apartHe claims in his complaint that we brushed him off in the January email when we clearly responded to his concernIf the vehicle continued to be a problem why did he wait a month and a half to contact us again and the second contact was for a completely different issue As I said in this emailI was more than willing to try and help Mr***However now that he has written a totally statement in an attempt to disparage my reputation all over the InternetI feel that I cannot participate in any reimbursement Thank you for taking the time to read this lengthy response
