On 12/13/14, [redacted] approached me in my drive and gave me a gift of [redacted] for letting them come in and demo a product. I told him I was busy and really didn't have time. He said it would not take much time and it was a vacuum cleaner. I told him I had just purchased a new vacuum cleaner and was not interested. He said that [redacted] would do the demo, this was her first demo and it would help her so I said ok but I would have to be cooking as she demoed. After demoing [redacted] promised me several free items and said he could leave the cleaner in the house for 3 business days with no consequences even with signing the contract. I said ok so my husband could see it. [redacted] did not point out the cancellation slip on the contract. I asked that he come back on Wednesday12/17/14 which would be the 3 business days and he said I'll be back Saturday 12/19/14 with the extras and I said no your coming back on Wednesday12/17/14. He said you want me to come back on Wednesday 12/17/14 and I said yes and he said ok. I have yet to see [redacted] and today is 1/21/15. I called the office on 12/19/14 and left a message, on 12/22/14 I spoke to [redacted] in the office and asked her to have [redacted] call me, [redacted] is the one that informed me about the cancellation slip on the receipt, 12/31/14 I left a message again, 1/7/15 left another message and called [redacted] at 1-800-[redacted] and spoke to [redacted] and explained the situation and she said she would call and get up with [redacted] and have him call me. I called [redacted] on 1/14/15 left a message, 1/15/15 left a message, 1/16/15 left a message and on 1/21/15 I called in and asked for a supervisor and was told there was not one. The lady on the phone asked if she could help and I explained some of the situation to her and all she would say is "you signed the contract". I received the invoice for the first payment on 1/17/15 and I only want the vacuum cleaner picked up from my house and so this does not effect my credit. This has caused a great deal of stress for me/my marriage.Product_Or_Service: [redacted]Desired SettlementI am not paying for the vacuum cleaner and I want it picked up from my home with no additional cost for pick up and no penalties that will affect my credit report. I feel I have been taken advantage of and swindled into having the item left in my home under the assumption I was not legally bound to purchase the item. Business Response I [redacted], the owner in good faith, of Martin Distributing Company, LLC, followed 3 day procedure setforth by the state of North Carolina, allowing the customer to use the product in the home, under no obligation for 3 business days. The customer referred to the 3 days in her statement, which clearly shows that I informed her of such procedure. The customer does bare some responsibility in reading the return procedures of a product. The customer did not return the cancellation slip to my office or have it postmarked by the 3rd business day by midnight. we heard from the customer on 12/19/2014, two days longer than allowed. This contract now belongs to the customer and finance company. Consumer Response [redacted] did not point out the slip on the contract to mail in if not satisfied. [redacted] left me with the understanding that he would be coming back to my house on 12/17/2014 as I asked him to do and he said to me"You want me to come back on Wednesday 12/17/2014?" and my reply was "Yes". [redacted] did not bother to call me and let me know he would not be able to come to my house. I stated that I did not have time to read the contract while signing because I was busy cooking at the same time. I did not read it later either because my husband indicated we would not be getting the vacuum cleaner and I told my husband I had told [redacted] to come back on Wednesday 12/17/2014 and he said OK. Is [redacted] not responsible for indicating he would come back and should he not have given me the courtesy of a call to let me know he was not coming as I had asked? If [redacted] is such and owner in "Good Faith" why is he not trying to resolve this issue with me. He has not tried to contact me even though I have tried to contact him several times leaving messages. I feel [redacted] has no intention of calling or coming to my house to resolve this issue. Therefore I feel I will receive no customer service on a $2500 vacuum cleaner I have been forced to pay for. [redacted] clearly stated he would be the one to come back and help with any questions I may have with the cleaner but it is obvious he will not be helping me in any way. Who then is to help me with the service and warranty of this cleaner? Who is to help me with questions on use of the cleaner? Basically what [redacted] is saying in not handling this issue is that he is only out to make a dollar and he doesn't care how it effects anyone or what kind of problem it may cause for a family. As long as he is making money, traveling, building a bigger house and buying clothes at someone else expense it does not matter what the consequences are for the other person. There are many people out there that want to buy a [redacted] and these are the ones that will not be calling back or sending anything in. But when you get someone who has been calling and trying to resolve an issue why should that person not be heard and worked with. I am asking [redacted] to come to my house and get the vacuum cleaner and cancel the account. This is the only resolution to this issue. This issue has caused problems for me and my family all because [redacted] did not make one simple call because he was out to make a dollar any way he could.It is sad our society has come to this. I am sure I am not the first person to have this happen and I am sure I will not be the last.God is going to take what is meant for harm and turn it into good for me. I pray that this situation does not happen to anyone else.
