To Whom It May Concern:

On November 14th, 2017 my boyfriend *** took my 2002 Chevy Cavalier to get an oil change at Martin Tire co. I was going to Albuquerque on November 15th to take my granddaughter to Presbyterian Hospital for tests that she needed done. I wanted my tires checked and oil changed to make sure that we were going.in a safe car and would have no problems, We left on 11/15/2017 at 9:00 to Albuquerque and arrived by 12:00. My granddaughter was seen and we left to come back home to Las Cruces at 2:00. On the way back home just past T or C my car started making a clanging noise. The car wasn't overheating, no smoke from the exhaust, nor was it spilling oil. We called my friend Head Mechanic *** from *** and explained the problem and he stated, "since car is not overheating nor spilling oil, go ahead and drive home just be careful and drive slow." we did, and we didn't get home til about 8:00 at night. Once home, my son and boyfriend checked the oil and found that it was low and also sludgy like the oil had not been changed. We called my friend *** and he stated he would come during his lunch hour on 11/16/17 to check the car out.
On 11/16/17 *** came by during lunch and checked my car out and stated that the car was about 2 quarts low and it was definitely sludgy and probably hadn't had oil changed. He stated that the clanging noise was probably from the car running low on oil and to take it back to Martin Tire Co. We took the car back to Martin Tire and informed them of the issue and they checked the car and stated that It was definitely low on oil and that the oil was sludgy and dirty. We told them that because we ran it low on oil that something had happened to the car and now it was making a noise, They stated that they would look at it but that their mechanic wasn't there at that time and wouldn't be there until the following day. We took our car home and the next day we dropped our car off and had their mechanic check it out. We went back arid picked the car up in the afternoon and they stated that something definitelyhappen but it wasn't their fault, They did change the Oil again. They told us the best thing was to take it to our mechanic and get it checked out.
We called *** and he stated he would check the car out and fix whatever was wrong with it but that the only time he had to work on the car was on the weekends. Left my car with *** on 11/18/17. On 12/7/17 *** called us and stated that he had Worked on the car and that the tensioner had broken due to the car being run low on oil. He also stated that the hydraulic and timing belt were damaged and that Martin Tire should be held responsible for the car breaking down. He had another certified mechanic aside from himself check the car out and they both concurred.that the car broke due to itbeing driven on low oil. He told us to take. it to Martin Tire along with a letter he wrote for us and picture showing what he did. and needed to be done. We took it back to Martin Tire Co and spoke to Richard/Manager and we Informed him on what our mechanic found and he stated that they had done what they were supposed to and that they couldn't be held responsible. We aSked for the District Manager's phone number which he gave us. He said to call Charlie B at and fax number is . I called Charlie and informed him of the problem and he stated.that he would call me right back. Received a call back from him and he stated that the car breaking down didn't have anything to do with them. I said, "okay," then we will see you in court because we feel that it Is your fault because my car was running perfect when I brought it In and your mechanics stated that It was.
I am a 67 yearold woman who kept my car in good running condition and now I am left without a car
due to human error on Martin Tire Co. I had also started working at *** and worked 2 days, 11/13/17, 11/14/17 and. had requested to take off on 11/15/17 when my car broke. I didn't have a way to get to work so I had to resign. This has truly been a hardship for me having to ask for ride to Dr's appt's and to get to the grocery store. I am beyond myself as to why Martin Tire Co would not admit that it was their fault and due to human error their oil person may have been distracted and thought he had put the 4 qts of oil that the car took and only put 2. All I want is for my car to get repaired.

I am rejecting this response because:

When the oil was changed they never showed us the dipstick to see if the oil been changed nor did they show us the oil filter or the air filter as other oil change places do when an oil change is done. The paperwork doesn't state that there were two people that checked and made sure that the oil was changed either as the response States.

Here at Martin Tire Company we have a very strict double check policy on every oil change done. Once an oil change is done another tech must verify the drain plug is tight, the oil filter is properly installed, and the oil level is full. This is a mandatory check on every oil change done here at Martin Tire Company. There is no way the vehicle left our facility with any less than the required amount of oil in the engine.

It is our opinion it is within reason given the vehicles age, mileage (around 100,00) and the fact that there was sludge buildup verified by both our employees and the customers mechanic there is a larger problem with the engine possibly due to lack of maintenance. It is also our opinion there is no way an engine could have survived a 600 plus mile trip starting with only two quarts of oil.
