Thank you for the replyQuestion number oneI asked for solid evidence that our company caused the alleged damagePlease provide it for me to reviewIf I certainly caused the damage, I will correct the damageI would also like to request any and all written documentation that she has for reviewI do not recall the exact conversation I had with Mrs [redacted] , and think that after this much time, would be irresponsible of me to confirm or deny any verbal communicationI do recall speaking with Mrs [redacted] about a the fence in question, and remember telling her that removal of the fence was an option, but I do not specifically recall telling her that we would remove itI do specifically recall her telling me that she wanted to do the job with the least amount of impact to her yardThe question has never been whether or not we used Mrs [redacted] 's drive for accessThe question is, did we indeed cause structural damage to it? A video of my skidsteer tractor on her drive does not conclusively prove that we damaged anythingAlso, if she was videoing this alleged damage while it was occurring, and told my operator that he was damaging her drive, why did she not stop the work immediately, and notify me or my office then? I assure you, if that would have happened, I would have promptly inspected the area, and stopped using the drive for accessHowever, that call was never madeFurthermore, if Mrs [redacted] was aware at the time the job was being performed that damage was being doneWhy did it take her until November to investigate as to it's severity? I will remind you again, that it was approximately and 1/months later that I was notified, for the first time, by certified letterSurely had the damage been that extensive Mrs [redacted] would have notified me soonerI understand that she encountered health problems, and for that I am truly sorry, but the fact remains that she obviously was not ill on November when she claims to have photographed the alleged damageWhy did she wait? To add, I do not own a skidderI own a Bobcat Sskidsteer loaderFrom the research I have done, a skidsteer of this size has between and lbs per square inch ground pressureEven loaded, it should not increase more than percent of thatHowever, this being said, this is only the best information I can find with google, and should not be considered concrete fact, but I will get the exact number for you I would also like permission to inspect this alleged damage myself with a witness of the Revdex.com's choosingI will not inspect it without someone with me who is a neutral party, but would be happy to provide a list of local people who would escort meTo be completely fair, Mrs [redacted] is also welcome to make suggestions for a neutral party to escort me to investigate the alleged damage alsoAgain, I have no problem solving this civily if I indeed damaged her drive, but before I fix anything, I will be sure that our company is at fault

I did do the job for Ms [redacted] last yearOn completion of the job Ms [redacted] was pleased, and paid us promptlyIt was not until some and 1/months later that I was made aware of any alleged damage to her driveI received this notification by certified letterShe never called me, wrote me, emailed me, or attempted to make any contact with me prior to sending this letter that I am aware ofMy question to Ms [redacted] is, why wait over months to notify me? Why wasn't a complaint made before paying me? Why all of the sudden, after this much time, would she decide that my company had damaged her drive? If Ms [redacted] can provide solid evidence, that we indeed caused the damage, I have no problem solving this issue with herHowever, over months after the fact, anything could have damaged her driveIE, garbage trucks, or other utility trucks that frequent the area probably weekly

As per phone communication with Revdex.com 12/10/15, Mr [redacted] will contact consumer, [redacted] to arrange a time convenient for both of them for him to come by her home

Complaint: I am rejecting this response because: By accepting his response, I would be indicating the issue is resolved and it is not resolved However, I do appreciate Mr [redacted] 's willingness to inspect the damage and view the proof that I have Since he stated that I could suggest a third party, I thought of my neighbor [redacted] since she is close byShe does not know anything about the issue as I have not talked with her about it Therefore, she is a neutral third partyDue to her work schedule, she is only available on Saturdays I asked her if she could be present and she said she could on most any Saturday If possible, I would like for this to be set up quickly since my Doctor has advised me of health concerns I will be facing in the near future Sincerely, [redacted]

When Mr*** came out to give an estimate for the job he explained that they would remove the fencing (which was already partially removed from work done after Rita) so that the heavy equipment could come across the yard However, when the crew arrived, they did not remove the fence Instead, they brought the heavy equipment across my driveway During the course of the operation I was on my porch taking video of the work while watching *** *** on the skidder He was controlling the arm and picking up large pieces of the treeI saw that the wheels were on the edge of the driveway and yelled out to Mr*** that he was damaging my driveway He shouted back that he couldn't help it The video I took while the damage was being done is dated On November 3rd, a few days later, after I had paid by credit card, I realized the damage was worse and I took pictures which I will be glad to provide in mediation along with the video Shortly after I took the pictures, my health deteriorated to the point that I was unable to pursue resolution of the damaged driveway My disability has made it imperative that I have a driveway I can navigate as I am afraid that I will fall in it's present state My issue is not with the work that was performed It is with the damage that was inadvertently done while the work was being performed This could have been avoided had the crew taken down the fence as originally stated by Mr*** I have no ill will against Mr***However, my video and pictures will serve as proof of the damage done by his crew I simply need a driveway that a handicapped person can navigate I am not opposed to a repair if some kind of epoxy can be used If *** is unwilling to resolve, I would like to pursue mediation.Note: I also have pictures taken prior to the damage Sincerely, *** ***
