agreement and did verify that all parties signed and agreed to all terms and conditions listed in his lease. This includes his responsibility to provide us with a written 60 day notice to vacate. As per our lease agreement, paragraph XVI. Section B. NOTICE TO QUIT states "If the tenancy under this agreement is for a term longer than one month, then such tenancy may be terminated, on the initial expiration date of this agreement by either party hereto by giving the other party not less than sixty (60) days notice in writing. If such sixty (60) day notice is not timely given, then the tenancy will continue on a month-to-month basis subject to termination up sixty (60) days written notice" Paragraph XVI. Section B. goes on to state "If no sixty (60) day notice is received by Agent, and if resident vacates the property, the parties hereto agree that Owner will sustain injury and losses that are extremely difficult or impossible to calculate and further agree that a sum equal to sixty (60) days rent is reasonable compensation to Owner for such injury and losses resulting from an improper or missing sixty (60) day notice and shall be paid by Resident to Owner in addition to any other amounts owed". As per our company policy, we do not accept any verbal notice of intent to vacate. Our company is not in a justified position to waive this lease obligation as we are consistent in our dealings with customers and do not discriminate.

Due to the misconception brought about from the staff when I verbally notified them I was vacating at the termination of my lease I was told I would be prorated for the month of October as well as informed by your staff that 60 day notice was not required for the termination of a lease. You as a company cannot ignore the fact that your employees mislead me in regards to this matter.

Each employee is thoroughly trained on our notice and move out procedures per the lease agreement and our company policy. It has been verified with all employees that they have not given permission or accepted any verbal notice to vacate submissions. It is our company's policy and position to move forward with the terms and conditions listed in the signed lease agreement.

Since the agreement was done over the phone and I know this business records calls for quality assurance I called the leasing office July of 2015 and was verbally informed by your "trained" staff that I was not required to submit notice for the termination of a Lease. That was the first time I was also told that on three different occasions while in person in the leasing office.
