I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
Yes, We will agree with Marv’s Trailer on the items of: 1. They were unable to give a finite date of delivery, they gave an estimated date of delivery of April.2. They did deliver the trailer to Fargo, ND and requested an additional fee of $500.3. The trailer was ordered to model after another customers trailer.4. We did receive a build sheet, as attached.5. *** did not explain that he needed a vented generator box, because he presumed that Marv’s would be more experienced in building or ordering trailers to know that you cannot run a generator in an enclosed box with no ventilation or electrical wiring.6. The trailer did receive hail damage.7. We will not purchase another trailer from Marv’s Trailer.8. We did have a conversation with Marv’s Trailer about the spare tire, numerous times.9. Prior to the receipt of the trailer and final invoice, *** told Marv’s Trailer that we did not want to pay the sales tax to the state of Wisconsin, and wanted it titled and taxed in the state of residence, North Dakota. The items that we still differ on are: 1. The build sheet and the spec drawing included the dimension for length but not width of the tire rackMarv’s was fully aware of the type of car that we would be hauling in the trailer and what size tires would be carried in the trailerThe “standard tire rack” that was provided was so wide that we could not drive a car into the trailerWe then incurred an additional bill in the amount of $to adjust this “standard tire rack”.2. When we questioned the non-ventilation of the generator room, we made the assumption that Marv’s Trailer was knowledgeable enough to know that there needed to be ventilation in order for the generator to run in the compartmentWe were also told by the salesperson, that Marv’s Trailer would contact the Manufacturer for information on how to rectify the problemTo date we have not heard from them in reference to this matter.3. We did not ask, request or leave the impression that we wanted Marv’s to order another trailer for us.4. Marv’s Trailer forgot to give us the spare tire, so when *** called questioning its whereabouts, was told by ***, that he would ship a tire to us, or if we preferred would send us the funds to purchase a spare tire locally to save him shipping costsI told him to send us the cost of the spare tire, which Marv’s Trailer had valued at $209.00. To date we have not received any further information from them in reference to the spare tire, or a return phone call, so there was no offer for a satisfactory conclusion.5. We have asked Marv’s Trailer to refund the sales tax from the state of Wisconsin both verbally and in several emails, to date we have not received a response. I have attached a statement from the state of ND, as proof of paymentMaybe all customers in the state Wisconsin pay these sales taxes, but Marv’s was fully informed and even delivered the trailer to the state of North Dakota. At this time, we still have not heard from Marv’s trailer, even after filing a formal complaint with the Revdex.com.We are continuing to ask for the refund of the Wisconsin sales tax in the amount of $834.79, the spare tire cost of $209.00, the repair of the spare tire rack of $and the cost to vent the generator room of $550, or a total of $2358.59. We will concede to the delivery fee of $500. Thank you for any help you can assist us with in this matter. *** L ***

After reviewing your response we have came to the conclusion that we have no obligations to pay for these modifications that *** and *** *** decided to make to their trailerThese modifications could have been made by the factory had *** took the time to build his trailer instead of trying to rush the processIt is unfortunate that *** was not satisfied with the services provided by us at Marv's TrailersAs we have stated from the beginning, we would be more than happy to provide the spare tire and wheel as long as the sponsorship agreement has been fulfilled by *** and proof can be providedWe did not overcharge *** on his trailer and we take these allegations very serious as they could slander our good nameYour insurance company does not want to pay out the full amount so they undercut the cost of the trailerThe insurance company is just that, an insurance company, not a trailer sales company. The tax that *** paid to the state of North Dakota would not have been taken if *** really brought his bill of sale with him to the DMV upon registering his trailerMarv's Trailers has been in business for years and has never had this issue before while dealing with North Dakota customers. Again, we are very sorry that we can not reach terms of agreement. -Marv's Trailers

This purchase was made by *** *** and the customers were notified that delivery dates are estimated and stated on every bill of sale "There is no guarantee on delivery dates for trailers ordered by any customer"The customer was also aware of the separate $delivery fee*** ***
contacted us with the desire to order a trailer that he seen at a raceThis trailer was custom made for a previous customer and *** *** requested the same exact trailerWe went through the process of obtaining the vin# off of the trailer that he had seen and wanted to replicateWe sent the vin# to the manufacturer to start the build processWe sent the build sheet to *** *** so that he could review and confirm the buildThe only change *** requested was the tire rack which was a standard tire rackHe confirmed and signed the build sheet and the drawing The build took longer than anticipated due to complications at the manufacturers facilityWe do apologizeOnce the trailer was done we notified the delivery driver and he brought the trailer to *** *** in Fargo, NDOnce *** was able to see the trailer he then notified us of the problems or concerns with the trailerWe explained to *** *** that the trailer was built to the same specs as the trailer he seenWe built what *** had asked for*** never explained that he needed a vented generator box*** had every chance to review the build sheets and the drawingsThe tire rack is standard and made to be adjustable to fit many racers needs*** paid the same taxes that every customer has to payWe tried to work with *** *** on the spare tire numerous times but could not come to a satisfactory conclusion*** recently notified us that his trailer was totaled due to hail damage and he gave us the impression that he would like to order another but given the previous interaction with the customer we were leery of ordering another trailer he may not be satisfied with
