Auto prices their cars according to [redacted] clean retail.  On 5/11/15 [redacted] valued this car at $4525 with an adjustment for low miles.  [redacted] vehicle history report also showed this was an accident free, one owner vehicle.  As the complaint states, the [redacted]’s were presented with a finance package that included the price of the vehicle, sales tax, title, registration, fees, and a two year extended warranty service contract.  The deal review statement also broke down the interest rate, and the total amount that would be paid over the term of the loan.  On 5/26/15 the [redacted]’s signed the contracts and took delivery of the car complete with a full tank of gas and a Mass state inspection sticker.  On 7/1/15, Mrs. [redacted] contacted the service department and notified them there was a problem with the fender liner and with the heat.  It was repaired under warranty in a timely manner with no cost to the [redacted]s.  On 7/16/15, Mrs. [redacted] returned to the service department for her complimentary oil change.  On both occasions, there was never any dissatisfaction shared by Mrs. [redacted].  On 8/1/15 Mrs. [redacted] called the sales department to say she was unhappy with the price of the car and the interest rate.  She was notified verbally and also in writing that she would need to contact the finance company to discuss her concerns and the instructions on how to do that was provided.  On 8/11/15 Mrs. [redacted] returned to the service department to have the front suspension repaired and was notified prior to the appointment that the repair was covered by her extended warranty service contract and she would be responsible for the $100 deductible.  The repairs were made, she made a partial payment, agreed to pay the rest the following week, and the service department released the car.  Since that date, the [redacted]’s have not answered any phone calls, nor returned to pay the balance due.  Marx Auto Center presented this customer with all of the facts upfront, supplied them with a safe mode of transportation that fit their budget, and resolved their transportation problem.
