Review: Several breaches of the contract terms occurred: Photographs of my genitals were taken without my prior knowledge and consent. This breached the "Notice of Privacy Practices" and breached the limited permission given for the recording of the surgery itself and only for educational purposes. There is nothing unusual about my genitals; they are ordinary, and pictures of my genitals could not be for educational purposes. Also, permission was only given to the Maryland Surgery Center for Women to have and use the digital or other recording of the surgery, and the Maryland Surgery Center conveyed one or more copies to the surgeon, who is not one of the owners of the Maryland Surgery Center in violation and breach of contract with me. Also, I was refused a copy of my medical record, which I am supposed to be able to obtain under the "Notice of Privacy Practices." I WISH TO RESTRICT AND REVOKE AUTHORIZATION ACCORDING TO PROVISIONS 4 AND 7 OF THE 'NOTICE OF PRIVACY PRACTICES' SINCE THE SURGEON PROLONGED MY SURGERYAT THIS FACILITY IN ORDER TO DIGITALLY RECORD FOR COMMERCIAL PURPOSES (CONTINUING EDUCATION VIDEO/MEDICAL SCHOOL TUTORIAL DISPLAYING MY GENITALS WITHOUT MY PERMISSION. Also, I was ordered to use an outdated 2005 prescription medication that had expired instead of being given a current prescription for post-surgery pain. Also, the surgery that I contracted for (the removal of a 4" internal polyp) was not performed. I was told this by one of the nurses, who showed me what was removed. Also, I requested and was denied a copy of the full contract I signed. When I protested this, I was told that the contract would be in the discharge packet and told it was in the discharge packet, but that was a lie. I was not provided a copy of the contract. Also, the Maryland Surgery Center for Women violated its own privacy policy as set forth in the section that begins "We mauy not use or disclose...: in paragraph 3 of that sections which states in full: "We must obtain an authorization for any disclosure of you PHI [personal health information] which constitutes a sale of such PHI." I fully believe that it is the intention of the surgeon [redacted], M"D's intention to sell my PHI in the form of digital and other copies of my genitals against my will and without my consent. Also, the Maryland Surgical Center for Women refused to allow me to use disability transportation to and from the surgery--a violation of ADA. This delayed the surgery 3 weeks, forcing me to go without pain medication and anti-inflamatories (NSAIDS) for 3 weeks, which resulted in the inflamatory disease going out of control, causing me to become disoriented and irritable. The repeated delays caused high tension which set off additional inflamatory disease responses. The absence of pain management before and after this surgery literally caused me several shieking episodes in public.. I had previously disclosed fully that I have a very high pain threshhold, no current prescriptions for pain, and that before I feel pain the inflamatory diseases produces disorientation and irritability.Desired Settlement: 1) I want to restrict use of any digital or other copying made of my surgery to permit only internal digital or other copying of the surgery images with the distruction of all external image copies of my body. This is under provision 4 of the "Notices of Privacy Practices."

2) I want to revoke authorization of any use of any of the digital images recorded outside of my body. It was never my intention to authorize any digital or other images to be made of the exterior of my body. I was unconscious/under general anesthetic and so whatever external images were done without my knowledge and without my consent. Specifically, a nurse told me that external images in addition to internal images were recorded. My opinion is that external images would be pornographic and not for any kind of educational purposes. My genitals are ordinary and should not have been digitally recorded or otherwise recorded. No surgery was performed upon them.

3) This surgery center provides substandard nursing services. No one is supervising the staff there except (perhaps) in the operating room itself--and there no one was supervising what the surgeon was doing--unlike a hospital setting, where the hospital administrative structure regulates human experimentation. I believe that I was experimented on by the surgeon in that my surgery was prolonged beyond what was medically necessary so that he could make extra digital images for his own commercial projects of selling videos for lectures. Only the internal digital imagery of the surgery itself are appropriate for that purpose, since I categorically object to images being made of my genitals.

4) This outpatient surgery center needs someone on site who has studied normal business practices in a class at a college or university. No one on site demonstrated any knowledge of business management, human experimentation, ADA, contracting, or how to supervise in a business setting. Although the paperwork referred to an 'Administrator' there was no evidence of any administrator on site. There was only a receptionist/clerical employee, two nurses, and an anestheologiest. The anestheologist did not appear to be authorized to supervise the surgery center nurses. Despite my bilateral arm injuries, the two nurses grabbed my two arms, causing me a whole lot of pain. It was unnecessary and counter productive. I believe that the surgeon might have removed the 4" polyp and taken it to his office, not disclosing that to the lab doing the biopsy for cancer, nor disclosing his removal of the 4" polyp to the Maryland Surgery Center for Women. I believe this was in order to commercialize that polyp in CEU presentations. Had I been asked, I would have allowed that, but being told by the nurse that the surgeon did NOT remove that 4" polyp has been very distressing and has made me feel/think that I went through a 5 week ordeal and a lot of expense without getting anything done!!!
