I am aware of [redacted]'s Complaint. During the inspection, I inspected the roof. The inspection report revealed that the roof was in satisfactory condition. The roof was inspected from the ground with binoculars and from the attic. There were no indications of any past or present leaks. There was...

no indication of water leaks along any of the second floor ceilings. All of the roofing shingles were intact at the time of the inspection. In addition the roof was approximately 15 years old, showing usual wear and tear for a roof that is 15 years old.On or about October 3, 2015 [redacted] and his wife inspected the home as a final walk thru before settlement. The settlement was sometime during the first week in October. During that inspection **. and [redacted] discovered a leak in the second floor bedroom ceiling and determined that the roof was leaking. They informed the agent of the roof leak, who told them to go ahead with the purchase and that the roof would be taken care of. This information was provided to me from the [redacted]'s. On October 5, 2015, the [redacted]'s contacted me and informed me of the roof leaking and I came out and inspected the roof as a courtesy. I did inform [redacted] that if I missed something during my inspection then I would have to correct situation. However I do not feel that I missed anything during the inspection.The inspection was perform on July3, 2015. On or about Oct 1, 2015, the [redacted] contacted me regarding the roof. I re-inspected the roof and found that the roof was leaking from the ridge vent. In addition, I also found that the roof had sustained some kind of weather related damage to the top portion of the roof as evidenced by the missing roofing shingles along the top peak of the roof, and the damaged ridge vent. There was no damage along the back side of the roof. This damage occurred on the front side of the roof, during the last two weeks of September 2015 when there were two high wind events in the area of the home.**. and [redacted] performed a walk thru inspection prior to going to settlement a day or two before going to settlement. The [redacted]'s knew that the roof was leaking before they went to settlement instead and instead of contacting me, or the owner to inform him of the roof leak, [redacted] informed me that although they knew of the leaks before going to settlement, that they had no where else to live and had to go to settlement.**. and [redacted] had an opportunity to bring the problem with the roof to the buyer, but decided to go ahead and buy the house and then expect me to buy them a new roof. Also, it states very clearly in the contract signed by [redacted], that my inspection covers the day and time of the inspection, I do not guarantee nor warrantee any item in inform me of the condition of the roof.[redacted]'s roof does need to be replaced because it did sustain some damage after my inspection. That is why there are so many roofing shingles that are missing from the roof. At the time of my inspection there were no missing shingles nor were there any leaks. The house was built around 1999 which would make the roof approximately 16 years old, which is within my estimate of the roof being 15 years old. With out being damaged the average roof last approximately 20 to 25 years. The roof, showing no signs of damage, or leaks could only be classed as satisfactory, not excellent but because of the age, instead just satisfactory.[redacted] wants me to pay for a new roof on his house and I refuse because the damage occurred after the inspection and he and his agent knew the roof was leaking before he actually purchased the home, 100 days after the inspection. Now he wants me to buy him a new roof. After conferring with my attorney I refuse to pay for anything regarding [redacted]'s roof. [redacted] does not realize that the roof was damaged between the time I inspected the roof and 100 days later when he did a walk thru. The purpose of the walk thru is to see if anything had changed in the home between the time of the inspection and a few days before he goes to settlement. The house had changed because of the recent storms. There were missing roofing shingles and the ridge vents had pulled away from the ridge. [redacted] failed to contact the owner and tell him his roof was damaged, instead [redacted] wants me to pay for his roof. [redacted] should have contacted the owner before going to settlement. I performed my inspection on July 3, 2015. [redacted] purchased the house over 100 days later. [redacted] should have had the house re-inspected. A lot can happen in 100 days.SincerelyJerrold A

I am rejecting this response because:  We had over 8 professionally licensed roofing companies state that this damage is not new and the roof has been leaking for years.  I have the documentation to prove this.  Now me and my wife, my 2 daughters and newborn son have had to deal with replacing a roof that was clearly missed by the home inspector Mr. A[redacted].  We would have never bought this house had Mr. A[redacted]'s inspection had noticed that there was damage done not only to the roof but also the attic evidenced by black wood that he also noticed when he came back to our house on several occasions after we purchased the home.  Mr. A[redacted] promised us that he would have this replaced.  Now Mr. A[redacted] has went back on his word.  As a professional that I entrusted to the well being of my family, Mr. A[redacted] should have noticed this roof that was in bad condition.  It is evident that Mr. A[redacted] knows that he missed the fact that the roof was in bad condition by the 3 times he came back to the house.  I will not accept this and neither will my family.
