Initial Business Response /* (1000, 11, 2016/10/24) */
Modern Mechanical Systems (MMS) preformed a routine maintenance on *** heat pump as per her request in May of MMS has a pricing schedule in place for maintenance and service consisting of an hourly rate and maintenance fees
that ALL clients payThe standard cost for a heat pump maintenance is $***+HST; when *** contacted our office and spoke with me directly, she was told this amount and wanted us to schedule a maintenance in accordance with this conversation and agreed to the price quotedIt is unclear where she came up with her figure of $**, as there is no service that MMS provides with that specific price pointOur technician was promptly scheduled and within a few days visited *** home where he preformed the requested inspections and maintenance to her systemHer Mother, whom recommended MMS to *** was home to greet the technician at the time and provided him with a credit card # for processing of the maintenance cost of $*** (HST included)The credit card came up declined and after attempts over the course of a two week period MMS admin staff reported the service as unpaid with a bad cc #MMS made several attempts to contact *** but she was unavailable to take the calls and messages that were left for *** to contact our office were ignoredIt wasn't until recently when our service manager *** contacted *** from his company issued cell phone that she answered the phoneDuring the discussion *** first made numerous complaints about the service and her issues with our technician; that were NEVER raised prior to MMS enforcing our right to receiving payment for our services; she then proceeded to tell *** that she had already paid the invoice and remembers giving our technician "CASH" to pay for the service and "never provided a credit card #"This was concerning, as *** was claiming that our technician had taken an "under the table, CASH payment" from her and did not report it to our officeBy making this claim MMS then investigated and inquired with the technician, who almost lost his job for taking company monies and acting in a way that is unlawful and unrepresentative of how MMS conducts its business
Concerned with ***'s claims about our technician and business operations, I contacted her myself via phone call and she proceeded to tell me a different story all together then what she had told *** in her previous telephone conversation; she was still adamant with me that she had paid our technician cash as she claimed she had more than $*** of renovation work done on her home that she had paid all the trades "CASH, under the table" and couldn't remember all the people she had paid cash or by credit cardOnce I divulged to her that her phone call to *** had been recorded, she became extremely confrontational and defensive after she was quite frankly caught dead in a lie that she did not want to admit to and this is why she has filed a complaint to the Revdex.com about our business in hopes of creating some elaborate lie before she is reported to both the *** for and sent to collections for non-paymentI have been in business for over years now, I have see a lot of bad installations, poor workmanship and I have also had to deal with people that play the same foolish, elusive games to avoid paying their bills that *** is attempting to do here; only she has been caught in her lies and would rather escalate the matter then pay the invoice and walk away amicably
If she knows that she has not paid the invoice and has no record of paying it as we do not either, then there shouldn't be an issue and she should forward payment to our office accordingly; I do not see what the issue is hereSadly because of her slander and misrepresentations of our business we will no longer be doing business with her mother which has been a client of mine since I started the business long agoThe petty nerve of some people is absurd and it makes you wonder what we as a society are coming to as time progresses, but all one has to do is turn on CNN and watch mins of the presidential election to determine where the masses learn and believe that this level of behaviour is acceptable
I have no interest in dealing with *** or putting anymore of my time into this ridiculous, petty matter; for someone to lie about paying an invoice; almost causing our technician to lose his job and then having the audacity to use the Revdex.com to bully us and make our business look bad is both inappropriate and immatureWe have a credit card # that was issued to us for payment by *** that has been declined several times and we were doing our job as a business to collect on our receivables; she obviously doesn't want to pay the bill and feels some form of entitlement over a measly $***

Initial Consumer Rebuttal /* (***0, 13, 2016/10/27) */
(The consumer indicated he/she ACCEPTED the response from the business.)
I will accept ***'s response in so far as he states, "I have no interest in dealing with *** or putting anymore of my time into this ridiculous, petty matter" However, for the record, I submit the following clarifications to his response:
Company owner/respondent now advises that payment for maintenance to my heat pump came from my mother's credit card, and also that my senior mother, as a guest in my home, greeted the technician at the doorNot only did she not pay for the technicians visit but she did not greet nor deal with the technician, I didTo inform the company owner/respondent - my mother checked with her credit card company and just like my credit card, there are no transactions declined or otherwise from this company from May to present or transactions declined at all for that matter
Company owner/respondent stated he is no longer going to do business with my motherWhile my mother has no desire to continue to provide her business to them, and her deepest regret is ever recommending them to me, she did purchase a high end heat pump from the company owner in 2014, which has a year warrantyI'm certain the company (MMS) will be honouring that warranty should, god forbid, that need ever arise
Company owner/respondent stated the company left numerous unanswered messages with respect to paymentMy phone records don't reflect thatFurther, when I contacted the company some-time after their initial visit to my home on May 13, 2016, to inquire as to why my furnace fan was running continuously, I received a response from *** days later who advised that to repair that issue would require a $*** part, which I found to be an outrageous costMost importantly, if I indeed, as the company owner stated, owed money to them, and numerous messages were being left, *** certainly didn't mention it to me at that timeIt would also be beneficial that company employees, who are issued company cell phones, that those phones indicate the company's name on people's call displayWhen *** contacted me in September I had no idea initially who I was speaking withIt could have been anyone seeking to have me give my credit card number over the phoneGiven the state of the world, as referenced in his response to me, he should be able to understand that
Company owner/respondent stated he feels bullied by the Revdex.com but unfortunately given the way some people conduct business, it's a necessary organization that assists people who are being bulliedThankfully, it also provides a written recordIt's also a resource I will use going forward to choose my service providers
The company owner stated I've had *** dollars of work done on my recently purchased home, work done by trades paid cash under the tableI want to clarify something for this individual, not because it's any of his business, but rather to address the twisted, inaccurate and misinformed understanding of facts and responsibilitiesI don't think he realizes, or maybe he does, with his assumptions and statements, what kind of person he is talking about and talking toThat *** dollars he referenced so disrespectfully was money I saved over the course of five years working a second job for a down-payment to my now homeIt also paid for a window needed after closing and for maintenance to an existing heat pump and to have someone show me how to use the heat pumpIt's not a crime to pay cash for anythingFor example, the Revdex.com registered window company I used had no problem accepting my cash payment and provided me a detailed initial quote, followed by a detailed receipt outlining cost of materials, labour and tax paidWould *** like to tell that company it was an under the table transaction? I'm sure they would beg to differ with him
If this individual wants to recklessly throw around accusations of slander he should read the definition because as far as I'm concerned his response to me was just thatI'm not going to subject myself to someone who uses threats and intimidation as a means of communication i.e., calling me a liar, a scammer, collections, statementsThere's a saying "You can't reason with unreasonable people." The error, if there is one, clearly is not on my partThe company technician would be responsible for taking payment and completing the transactionTechnicians do not leave homes without paymentBoth, my credit card, and apparently now, my mother's credit card, show no declined transactionsAdditionally, I have a bank record of a cash withdrawal on that dateFurther, I find it interesting that *** would now say it's my mother's credit cardHad the credit card been provided in the first place, I would think that information would have been taken off the credit card at the time of the transaction
The company owner/respondent stated he doesn't have the time to deal with this "petty" matter over a "measly" $***That is the only thing we agree onHowever, his treatment of me and unprofessional and intimidating conduct is no "petty" or "measly" matter whatsoeverI will certainly never forget this experience
