I am responding on behalf of MODEL AND TALENT to the complaint dated April 10, 2015.
MODEL AND TALENT is a commercial networking service designed to assist those seeking opportunities in modeling, acting,...

or other careers within the entertainment industry to get internet exposure, networking resources and tools to match their talent with available listings of auditions and casting calls. MODEL AND TALENT's advertising specifically states that the auditions are for MODEL AND TALENT, and provides examples of different casting opportunities that have been featured on the company's website. Those individuals who do elect to become MODEL AND TALENT members are exposed to many resources and networking opportunities through MODEL AND TALENT's website, including a large variety of entertainment industry casting calls.
While it is MODEL AND TALENT's hope that its members find success, MODEL AND TALENT does not guarantee work to anyone. In fact, MODEL AND TALENT's website contains the following clear disclosure:
"modelandtalent.tv is not an employment agency, school, performing arts academy, management company or a talent agency. Model and talent does not engage in training, procuring, offering, promising, or attempting to procure employment or engagements for artists. Model and talent only provides Internet exposure, networking resources and tools for you to match your talent with available listings of auditions and casting calls. The content provided by model and talent through this website is without warranties of any kind, whether express or implied, including, without limitation, warranties of merchantability and fitness for a particular purposes."
Client tried to cancel more than a month after signing the contract, which is past due the 3 day cancellation period. Therefore no refund is due.
In its presentations, MODEL AND TALENT emphasizes various qualities that help make people successful in the industry, which include, among other factors, a combination of talent, determination, having the right connections, preparation and tools. Talent is only one part of the equation, and not always the decisive part. The entertainment industry simply does not have a "one size fits all" approach to success. As a result, MODEL AND TALENT's presentations can at times discourage attendees by focusing on factors such as the need for personal motivation and determination to succeed. In this manner, the presentation process on the first day of a weekend event has a two-sided approach, as a number of attendees eliminate themselves by choosing not to proceed. In addition, because the process includes a second day, those attendees who are invited to return have the opportunity to go home for the night, talk as a family, review all materials, including pricing, and conduct the necessary research to make a sound decision whether or not MODEL AND TALENT is right for them.
There is no charge to anyone for attending a MODEL AND TALENT presentation or, for those invited to return, for attending on the second day. Charges are incurred only if a returning attendee elects to enter into a member agreement.
MODEL AND TALENT's services provide a resource and a tool for persons who wish to pursue an entertainment career, as an alternative to attempting to navigate through a complex industry without similar guidance. Thus, among other services, MODEL AND TALENT helps to prepare candidates for casting and audition calls through instructional videos, to find representation through a listing of legitimate and franchised agencies, and to search for audition opportunities through a variety of industry casting calls. Even the most talented person may not achieve success without the proper tools, knowledge and a determination to actively pursue a career. MODEL AND TALENT believes that those members who have found success provide the best demonstration of how the company's services can be effective.
In regards to privacy, we take this issue very serious and client has all the tools online available to set their own privacy restrictions. If client needs help they can watch our online tutorials once logged in or call customer service, who will be more willing to help and explain how to set up strict privacy restrictions.
In regards to "license", as already explained above we are not an employment agency, school, performing arts academy, management company or a talent agency and therefore do not require licensing. Model and talent does not engage in training, procuring, offering, promising, or attempting to procure employment or engagements for artists. Model and talent only provides Internet exposure, networking resources and tools for you to match your talent with available listings of auditions and casting calls.
