I am rejecting this response because: when Matco's reps sell these tools they are sold with a lifetime warranty. Much like the more reputable companies Snap on, Cornwell, Mac, and even CraftsmanThis item has failed under the lifetime warrantyI am due a similar like, kind,quality item.

For clarification purposes, Matco Tools Distributors are franchisees and are not employees of Matco Tools Corporation Matco Tools financed purchases for Mr*** for over years and most recently on or about February 26, 2014. Mr*** contends that Matco incorrectly reported a
delinquent payment status of his account to the credit bureau for March After further review, Matco will remove the credit bureau rating for March. Mr***’s account is currently past due. I urge him to bring his account current before the end of the month to avoid another negative credit bureau rating

I am rejecting this response because: this is not a matter of what I understand or don't understand I had problems with their distributor which I called them about with no resolution about something he sold me and the price he gave me was $1,more than what we agreed on but my main issue is they're distributor said if it ever became too hard for me to handle that it was easy as returning the equipment with no consequences never was I told that it would still affect me years down the roadAnd then I have a lawyer that says they work for Matco calling threaten me

Without Mr*** properly identifying the exact tools in question, it is difficult for Matco to reply specifically. Matco Tools has been experiencing product fill issues from our Supplier for a particular product lines, but, without identification of Mr***’s tools, it is impossible to
determine if this is the cause for the delay in warranty I suggest that Mr*** discuss his warranty needs with his Matco Tools Distributor or contact Matco Tools’ Customer Service Department by calling 866-BUYTOOL (866-289-8665) to receive assistance with his warranty needs

Matco Tools sells products through commercial sales representatives directly to educational institutions and students. Mr*** was a student at Eastfield College in Dallas Texas at the time that he entered into a purchase agreement with Matco Tools on or about June 2, for the
purchase of a various tools totaling $1, The Purchase Money Security Agreement (“Agreement”), enclosed for your reference, contains a provision that permits Matco Tools, in the event that any item on the contract which remains on backorder for days, to either (1) substitute with like product of an equal or greater value for the same price, or (2) cancel the product from the contract causing the amount of the contract and payment due to be adjusted accordingly. As previously stated, the Agreement was executed on June 2, 2017. The tool order was held for days due to a backorder of tools (piece socket set and a piece socket set) which totaled $224.15, and which were removed from the order, pursuant to the provisional clause stated above. The order was finalized on July 18, 2017, and Mr*** was advised of the revision to his order and was provided with a revised contract indicating that the backorder-items were removed Mr*** contacted Matco on August 9, upset that he did not received the backordered items and accused Matco of breaching the contract. Matco explained the contract’s 45-day backorder provision and advised that he could re-order the two backorder-items from the Matco Vo-tech Representative. These are very popular socket sets and Matco is expecting another shipment of these items next week. Mr*** should contact his Vo-tech Representative to order these items if he is still interested in them Matco expects Mr*** to fulfill his obligation to Matco pursuant to his binding Agreement.

As previously stated, these contracts were entered into with a local Matco Distributor and Matco Tools then financed the sale. Although local distributors are independent agents they are provided with extensive training on the Matco Tools Business System before they start their franchise. Additionally, a review of the PSA system notes does not show any conversation between Mr*** and Matco Tools where Mr*** is alleging that the price of an item or the balance was not what he agreed to. This complaint, almost years after the contract was signed, was the first Matco Tools was made aware of Mr***’s claim that the contract was not what he agreed to. Attached is the last Contract and the Terms and Conditions of the loans signed by Mr***. The contract of July 23, provides an itemization of that purchase as well as the rollover from the July 15, purchase. The principal balance of both purchases ($7,125.71) is listed on Line H, and the expected interest to be paid for the duration of the Agreement ($2,845.81), if only minimum payments are made, is listed on Line I. These amounts total $9,971.52. Mr*** signed the Agreement right below the stated balance due acknowledging receipt of the goods and the amount he agreed to pay for them according to the listed terms and conditions. Per section of the terms and conditions, the contract represents the entire agreement between the parties on this subject. Therefore, no prior conversations with the Distributor would have any effect on the terms of this sale. As stated in Item of the Master Agreement, if Buyer pays the full amount due before the last scheduled payment is due, he would be entitled to that portion of interest, if any, to which Matco has not then become entitled as calculated pursuant to the Rule of 78’s calculation. Because of the commercial nature of the Agreement, the interest rate is not required to be disclosed on the Agreement Per Matco Tools’ original response, there is no provision for a “cooling-off” period or return-for-credit as may be provided in consumer lending

I spoke with Jason C., the operator of mobile store for Richard C..? Jason assured me that he has every intention of servicing the shop associated with Mr*** complaint.? Jason advised that he has encountered scheduling issues that have prevented him from arriving at this shop before
the shop’s closing? In the meantime, if Mr*** has tools that require immediate attention before Jason visits the shop, Mr*** may contact Matco Tools’ Customer Service Department by calling *** *** to receive assistance with his warranty needs

During 2015, it appears that Matco incurred some issues with Mr***’ credit card declining payment requests but the payments would be accepted after the 2nd attempt until the end of November at which time the credit card payment was declined after the 2nd attemptMatco’s procedure for a declined credit card payment is to make a second attempt to process a declined payment later that same day.? If the second attempt is declined, then Matco (1) emails the customer, if an email address is on file; (2) calls the customer; and (3) removes the account from the automatic credit card payment process.? Matco Tools made numerous attempts over the next months by phone to advise Mr*** of the problems with his credit card payment until Mr*** again sautomatic credit card payments on or about June 20, Upon Matco’s first attempt to process his credit card payment on July 1, 2016, Mr***’ credit card declined payment after the second attempt and Matco again took him off the automatic payment program because credit card issues.? Again, Matco followed its procedure for declined credit card payments.? It appears that Mr*** processed payments online thereafter; however, payments were missed for August 2016, September 2016, and October for which Matco reported these delinquencies with its usual bureau reportingAdditionally, Mr*** claims that Matco did not provide a physical bill.? Matco mails monthly account statements after an account is brought in-house; therefore, Mr*** should have received a monthly statement in the mail since February Ultimately, it is Mr***’ responsibility to ensure that he makes timely payments on his Matco account.? Matco made numerous phone calls to advise Mr*** that his credit card was having problems in processing his payment, that he was no longer on the automatic payment program, and that his account was delinquent.? Presently, Mr*** has paid his account in-full

Unfortunately, Matco Tools has been experiencing product fill issues with our Supplier for this product.? We have since secured a new Supplier but there has been a lag time for them to come up to full production; however, backorders on this item are slowly being filled? Matco has offered
an alternate tool replacement to Mr*** which he has accepted.? Matco is in the process of shipping this like-ratchet to him at no charge, and the backordered tool also will be shipped to him once available? My apologies to Mr*** if this matter has caused him distress, and I ask for his continued patience and understanding as Matco Tools works through this supply chain issue

? Matco Tools did enter into a settlement agreement with Mr*** on or about December 2011.? According to account records, the last time Matco Tools updated its reporting to the credit bureau regarding Mr***’ account was on or about September 29, with instructions to delete
the account entirely? ? Apparently, the bureau failed to do so? Matco resubmitted an electronic correction to all three credit bureaus on October 3, 2016.? Be advised, however, that credit bureaus typically process updates within days from the date of notification.? If this process does not correct the error on Mr***’ credit report, he should file a dispute with Equifax, Transunion and Experian directly.? This is the best and most efficient method to correct information on his credit bureau report

Matco Tools confirmed with Mr*** that he and Distributor *** *** met on July 3rd in order for Distributor Parker to return the tools to him.? According to Matco’s telephone conversation with Mr*** today (7/19/2017), Mr*** has no further complaints and Matco
considers this matter closed

This debt arose from two transactions where Mr*** purchased tools, while at his place of business, for use in his trade or business On the Purchase Money Security Agreement - Master Agreement signed by Mr***, he warranted with his
signature that "all Goods are purchased primarily for use in the commercial operation of this trade and business and not for personal, family or household use" As such, this is a commercial debt, not a consumer debt
Per the terms and conditions of the Sale/Security Agreement, removing the goods purchased from the place of business, failure to pay all Obligations when due, and suffering a material adverse change in business or financial condition, among other provisions, would constitute a "Default" under the agreement which among other things would cause an acceleration of the debt making it due and payable immediately
Mr*** stated that he would not be returning to his place of employment, and his return to gainful employment in the near future was in question due to his medical condition Additionally, Mr*** had already expended Matco's 26-week medical bypass provision Early in July, Mr*** authorized Matco to run payments through his credit card; however, several weeks later, the credit card company declined to process further payments As of the date of this letter, Mr***'s account is weeks past due
As stated above, the Sale/Security Agreement does not permit the removal of the Goods from the place of business While Matco will permit the Goods to be moved to a new place of employment, Matco does not permit the Goods to be moved to a private residence Since Mr*** stated that he would not be returning to work and that any future employment was questionable, it was evident to Matco that its Collateral was in jeopardy
Matco repossessed its Collateral on or about July 31, 2015, and a notice of sale letter was mailed to Mr*** There are some personal items that were contained in the toolbox at the time of repossession The local Matco attempted to contact Mr*** so that they could be returned; however, Mr*** has not returned his calls Unless Mr*** makes other arrangements with the Matco Distributor by September 3, these personal items will be left with Mr***'s employer (*** ***)
Because of the is situation involving the on-going location of the Collateral and Mr***'s ability to provide on-going payment method, Matco must reject his suggested resolution Once the Collateral is sold, Matco will advise Mr*** regarding the status of his account

MrA*** purchased a toolbox from Matco Distributor Craig on or about January 9, 2015, and Matco accepted assignment from Distributor Craig
The Purchase Money Security Agreement (the "Contracts") that MrA*** signed warrants
"that all Goods are purchased primarily for the use in the commercial operation of his trade or business and not for personal, family or household use." As stated, these contracts are commercial in nature, not consumer; and, as such, there is no return-for-credit policy as may be provided in some consumer financing agreements
On or about February 18, 2015, MrA*** approached Distributor Craig in order to arrange for the surrender of his toolbox because he had lost his job and could not financially afford to make the required payments Distributor Craig advised Matco Tools regarding MrA***'s intentions, and a voluntary repossession process was initiated by Matco
A notice of sale letter was mailed on February 18, to MrA*** for delivery to the address provided by MrA*** on his credit application dated January 9, After the prescribed waiting period, the toolbox was sold, and the Fair Market Value was credited to MrA***'s account less any cost of sale
After all adjustments, MrA*** owes a deficiency balance in the amount of $3,
Matco Tools was unable to make contact with MrA*** since we did not have his current address or telephone number
