Matt's LandscapingMatthew S [redacted] **I did a job for [redacted] in the late fall of last yearThe date was 10-24-The job consisted of filling in his inground swimming pool with the soil that was around it and regrade the back yard and plant seedIn the contract it stated that if I needed to bring in more topsoil for the grass to grow it would be an additional costI told him that is was too late in the season to plant seed and we should do it in the SpringAgainst my better judgement he still wanted me to do it in the late FallAt the completion of the job, I told him that it is too late in the season to plant grass and I would come back in the Spring and bring topsoil and replant the yardFor some reason he could not understand this; he thought he could grow grass in the winter timeHe called me through the winter season several times and I kept telling him when the weather was warm enough I would be out with top soil and seed to replant his yardI came out in the first week of April and brought three loads of topsoil and seed and I planted his yardI gave him the bill for the topsoil and seed that was stated in the contract that would be extra if I had to bring it inHe did not pay this portion of the bill, so I called himHe said that his yard still had spots where grass was not growingSo I went out to look at it and there were some spots that had not grown in yet; However new growth of grass was thereAs everyone knows it usually takes a season for the whole yard to come inI said, give it a couple more weeks to grow inA couple of weeks later he called saying all of his grass died and he is not going to pay the rest of the billHe tried to say the soil that I brought in was contaminatedThere is no way it could have been contaminated because then the grass would not have grown in the first month and a half that it was inFor his whole yard to die he must of not watered it an/or put something on it that would have killed his grassI believe he tried to fertilize it and he used the wrong product and he killed his own yardThat is not my fault and he still has not paid for the soil that was brought inI did the job that was asked of me and he still as not paid in full.ID# [redacted]

Could it be this is where the soil from the vegetable garden ended upAs stated in the response it did grow in spots where garden soil ended upCheck the photo taken June 13th.9.Would you pay for the June 13th result?10.If it was compacted properly why is there sink holes?I donot have access to the football fieldWater was drained by siphon over the hill well below the pooland did not kill the grass. In Conclusion why would I hire another contractor for $on June 13th if the job was done properlyI gave the grass months to growThe second Contractor brought in good soil.reseeded the grass and we had green grass by July 4th.*** ** ***

Matt’s Landscaping ID#***As I recieved the third letter from the customer, that he wrote to the Revdex.com, his story of what happened has changedFirst the customer stated that, and these are his words straight from the letters that he wrote," 1st I caught him stealing top soil from my garden and hauling it away and then he brought back contaminated top soil because all the grass died in the yard including the old grass." Now the customer is stating, "If water was a problem why did the two very green patches show up in the photo? Could it be this is where the soil from the vegetable garden ended up." In these two statements you can see he contradicts himself on both where the garden soil went and the growing of the grassAnother statement that he made was, "I gave the grass months to grow." I brought the soil in, in April and he said that the other contractor did it on June 13thThat is only two months apartThat is why I did it in the Spring and not the end of Fall, because grass does not grow in Winter in PennsylvaniaHe is also now claiming that the soil I got came from a football fieldThis was never brought up before, because it is not trueAgain I get all of my soil from local suppliersThe only thing that was ever mentioned about a football field was that at that time, they were putting in a new turf field and I made a comment in a converstation with the customer that if he put turf in his back yard he would have an instant yardSo this has nothing to do with the customers back yardAgain I will state the facts, I only brought in soil once; the soil I brought in, in April, could not have been contaminated because then no grass would have growHis pictures clearly show that the grass did grow and then died off for some other causeFurthermore, he made the statement that, "Would you pay for the June 13th result?"; he did not pay for that portion I did in AprilTo this day he still has not paid and he even said that he did notSo for him to expect me to pay for someone else’s work, when he never paid for the work from what I did in April and expect to be reimbursed is not reasonableI could understand, if he asked for the payment back for the work I did in April, from the planting of the yard in Spring, but he never paid that portion of the bill in the first place

*** ***Revdex.com*** *** *** *** *** *** ***RE: Contract to remove a poolwith Matt’s Landscapting*** *** *** *** ***Gentlemen:The original contract was signed early in September It was only after several calls the pool was removedI was concerned it was too late for grass to germinateI was assured the grass would growThe job was done late in October At that time MrS*** removed top soil from my vegetable garden which he was told not to disturbHe replaced the gardensoil with top soil which was contaminatedA drain pipe was cut off and plugedMrS*** removed a portion of fence and gate which was not replaced properlyIt was not put in concreteDuring the winter and early spring the grass did not grow which I believe that the top soil put down was contaminatedAfer many phone calls to MrS*** he came back and brought more top soilThe grass did not growHe sent me a bill for over $which I have not paidWe planted our vegetable garden in the middle of MayPlants died because of the bad soilI dug larger holes and put in good soil for the plants that survived and they did growAfter he reseeded we had a lot of rain and so I watered at least or 3 times a week when we did not get rainThe grass did not growI have enclosed a picture of the lawn taken on June 13, We always have a large picnic on the 4th of July so I had no choice but to contract with a reputable landscaper to put down good top soil and reseedBy July 4th I had a green lawn after good top soil was put downThe cost was $1,which I expect to be reimbursed by MrS***. Matt's Landscaping ID# ***I will be stating the facts that concur with each number of the last letter that was sent to the Revdex.com by the customerFact, the original paper work was given to the customer in SeptI had already had a waiting list of other customers jobs to be completed before his; also weather is factered in as when I could get to his jobYes he called several times and I did explain this to him and I suggested to put the yard in the SpringI told the customer several times that grass will not grow in the winter, I did not assure him that the grass would grow but he still wanted it doneFact, yes the pool was filled in by me in October with a machine that I had to bring through the garden areaIt was the only way in because that is where the customer had us take out the gate to fit my machine into the back yard where the work was to be doneAt this time no soil was brought to the job because we just used the soil that was all ready on the property from them digging the poolFact, yes a drain pipe was cut by my machine that I did not see, because it was underground and was not markedI did go back and unplug the drain and extented it away from the concreteFact, yes I removed the gate to get my machine in and I did put it back in concrete and then filled it over with soil so the concrete was not showingFact, the grass would not grow in the winter and also again, I never brought in soil to this pointThe customer called several times in the winter months; I explained to him that when the weather is warm I will come out and bring topsoil to plant the yardI came back out the first week of April and brought topsoil for the yardI planted the yard and gave him a bill for the topsoilIt was stated in the orginal contract if I had to bring more soil it would cost moreI have been getting my topsoil from the same reputable suppliers for years and never had any problems with contaminationFact, diffent plants grow in diferent types of soil and so does grass seedFact, after I put in the yard it is up to the customer to maintain and makes sure the yard gets enough water and also not too much waterThis is the main factor in growing a yardFact, the yard did grow but still had spots where it did not fill inThis is why he had me come out to look at it againThey were not very big spots at allThe yard just needed more time to growFact, the customer still,to this day, has not paid me in full for the work and soil that was brought in AprilFact, I did track/compact the soil in the pool area with my skid steer machineSoil does take up to one year or more to settleFact, if the customer took soil samples, he should also take samples from where I got the soil to make sure it is the same soil being testedNote: I was not the one who drained the poolMost pools use chemicais in themI do not know where the pool was drained to because when I got to the job it was already drainedFact, a large amount of pool chemicals can kill grass
