In process of taking legal action against Mattamy for not honoring warranty agreement Buyer beware! Many problems exist two years after closing and Mattsmy does not want to fixSubcontractors are subpar and need to look over every item with fine tooth combI would recommend another builder but even then beware since all of the local builders use the same subcontractors

Initial Business Response / [redacted] (1000, 5, 2015/08/14) */ The homeowner has made extensive changes to their yard where they are complaining about water problemsThey removed the deck Mattamy Homes installed and had a much larger deck installedAs part of that project several additional concrete footings were added to support the deckSince the deck was installed in the homeowner has not re-graded and smoothed out the ground under the deck to allow water to run offThis project has changed the grading behind a substantial portion of their home and slows or prevents water from draining away from the back of their home in that area(Photos attached) In addition, they have constructed a storage shed near the back corner of their home opposite the deckThis shed is in an area where water originally drained away from the homeNow at least a portion of any rain water or snowmelt is channeled towards the back of the home where it contributes to the water issues created by the deck To confirm both of these issues Mattamy Homes paid for a professional land surveyor to provide a complete survey of their yardThis lot survey confirmed that the work done has changed the grading behind the home and the incomplete work under the deck has affected the drainage(A copy of the survey was provided to the homeowner free of charge) We believe that the problems they have experienced have been caused by the changes they made to their yard and not by any work performed by Mattamy HomesTherefore we respectfully decline to accept responsibility for these changes and will not perform work to fix them

Our client received standard baseboards in this homeThey wanted an upgraded baseboard which they did not getThis upgrade was not on their paperwork that they signed off on and not paid forMattamy has offered to have the baseboards they desired supplied and installed and the old ones removed at a cost to be paid by the clientIn order to proceed with this the client would need to pay to have this changedThe cost would cover the removal/install and the cost of the upgraded baseboard.

Per our communications and emails with the homeowner, Mattamy Homes agreed to investigate the possibility of making changes to the holding ponds as referenced in her complaintWe did not agree that we would make changes because there are many
affected parties, any one of which could refuse to accept the requested changesAs it turned out Mattamy Homes was unable to gain permission from the affected landowners to make the requested changesSince without permission we cannot legally make changes to land we do not own, we cannot make the changes to the ponds and drainage infrastructure approved previously by the developer, the City of Minnetrista, and the Minnehaha Creek Watershed DistrictMattamy Homes refunded the lot premium the homeowner paid as a good faith gesture towards resolving the issue, but we will be unable to make her requested changes to the drainage infrastructure
The homeowner is free to send in warranty requests at any time and they will be addressedWe have NEVER refused to accept requests from herAll communications with the homeowner include our outside counsel because the homeowner is an attorney and has specifically stated in writing that she plans to retain counsel

Buyer beware!

Many problems exist two years after closing and Mattsmy does not want to fix. Subcontractors are subpar and need to look over every item with fine tooth comb. I would recommend another builder but even then beware since all of the local builders use the same subcontractors.
