June 19, Cincinnati Revdex.com West 7th StSte: Cinn., Ohio RE: Complaint ID [redacted] Dear Revdex.com: In addition to my previous responses, I want thank the Revdex.com for allowing individuals to register their concerns in an indirect forumWhile I am not a member of the Revdex.com, I respect the efforts you make to assist individuals like me and, in this case the plaintiff As in previous statements, the plaintiff has always made complimentary comments toward me and my efforts to assist in this matter, and I am appreciativeIn fact, in the recent letter, she again acknowledges that I was attentive and helpful I acknowledge the customer concernsIt seems self-evident otherwise there would be no complaint of this nature While I am addressing several points in this recent letter, I still stand by the finding of the [redacted] Firm as were outlined in their response last month There are few items in which we agree and a few where our interpretation of events differAnd a few items that I am just not privy to the information that she brought forth Where we differ or where I am unaware of the plaintiff's interpretation I am quoted as saying, "...everything was done right the first time." I don't recall making this statementPerhaps the plaintiff is paraphrasing her interpretation of what was saidQuotes that are more germane to my discussion might include: "if the veterans dies during the process, prior to approval, the process stopsThere is no refund from [redacted] ." (The plaintiff confirms knowledge of this in her comments.) Or,"...if [redacted] is unsuccessful in their efforts to qualify the veteran, there will be a refund." I agree with the plaintiff that I was the one that introduced the fact that there was another lawyer involved in this caseI never mentioned the lawyer by name or genderAnd I disagree that it was to sidetrack any issues of the plaintiffMost, if not all the work I do in this arena is through referrals from lawyers and other professionalsI do not solicit veterans or their familiesThe families usually find me because of other professionalsIn addition to veterans and seniors, I also work with families that have a loved one with a developmental disabilityThese all can be highly sensitive situations, and each family and individual is different The plaintiff suggest that [redacted] , myself, and others "..sell these services to people who are in a hurry to complete the process." Again, I did not find the veteran, or the plaintiffThey found and solicited meAnd they found me from an attorneyI don't know how they located that attorney This is why this situation is so bafflingI have worked with both of these legal entities on numerous situations and this is the first complaint that has ever been filedI am still trying to determine what is unique about this case, versus the other casesSince the [redacted] Firm did the lion share of the work for the applicant, I responded to them for their commentsI submitted their response last monthIf you don't have it, I will provide a copy The plaintiff also makes the statement that the initial attorney misrepresented the factsThat is not something I can addressI was not privy to their discussions nor am I able to interpret what was misrepresented to the plaintiffAs the plaintiff confirms, she was dissatisfied with this attorney and paid the feeTo my knowledge, she has not requested a refundI have not approached the initial attorney about this matter The plaintiff states that her current attorney is assisting her in filing for back payments for the VAIn addition, she claims that [redacted] had offered to provide this same service, but at an additional chargeAttached is an email sent to the plaintiff dated March 10, at 5:24pmIn this email it appears she and [redacted] from [redacted] are discussing the issue of fiduciary arrangements for the veteranAs I read the email, it does not indicate that [redacted] is requesting any additional charge for this serviceIt is not clear to me why this claim is being made I am pleased that the plaintiff is consulting with a qualified [redacted] attorney for issues of Elder Care and MedicaidThe [redacted] attorneys with whom I have work are amply qualified to assist in these mattersAnd many have had similar success as hers in obtaining Medicaid benefits with no appealsAnd that includes the initial attorney that the plaintiff dismissed She also discusses some recent letters she received from the VAI cannot address those letters because I was not aware of them am also pleased that she was able to get her father situated in a safe placeIt is clear to me that she has worked very hard to help him these last few years If I can be of additional assistance on the matter, feel free to contact me See attached for original

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowRegardless of everything else that has been discussed, there is no way to dispute that [redacted] Firm submitted incomplete paperwork directly to the VA and then did not follwith me in a timely manner in order to correct this Mr [redacted] hired them and according to the [redacted] Revdex.com, he is accountable for the services they provided as well as his own It is not my fault that he hired a group that submitted incomplete paperwork to the VA which delayed my father’s application from being processed A quick recap: In July 2013, Mr [redacted] was paid $for the sole purpose of acting as a “Distinterested 3rd Party” in order to obtain VA benefits for my father He then contracted this out to [redacted] Firm for $ In August 2013, [redacted] submitted incomplete paperwork to the VA The only reason that Mr [redacted] helped me after [redacted] was hired is because I called him when there were problems The biggest problem I had with [redacted] is the incomplete paperwork that was submitted to the VA in August I only learned of the incomplete paperwork in December when I received correspondence and documentation in the mail from the VA I emailed this information the same day I received it to both Mr [redacted] and [redacted] with scanned file attachments and neither of them responded A few days later, I called and left a voice mail at [redacted] I still heard nothing for a couple of days so I called Mr*** Mr [redacted] tried to reach [redacted] while helping me with the incomplete paperwork Over a week later, [redacted] from [redacted] responded by email and that was after Mr [redacted] had faxed the completed paperwork to be re-submitted to the VA There was no explanation in her email as to why the paperwork wasn’t completed properly before it was submitted In summation, I would not have paid $ to Mr [redacted] to hire [redacted] Firm as contractors if I had thought they would submit incomplete paperwork directly to the VA After all, I didn't need to hire them at all Regardless or not of whether there have been no other complaints besides mine is totally irrelevant Regardless or not of whether [redacted] submitted incomplete paperwork for other clients referred by Mr [redacted] is totally irrelevant When [redacted] submitted incomplete paperwork to the VA in August 2013, it delayed the application from being approved as quickly as it could have been After all, I didn’t hear about the incomplete paperwork from the VA until December I then waited several days for [redacted] to respond regarding how to handle the incomplete paperwork This also delayed the application from being approved The VA is - months behind VA reps will tell you this themselves over the phone Therefore, any mistakes made by applicants further delay the application from being approved Let's not forget that if the applicant dies while filing, the application is canceled and there are no benefits Again, Mr [redacted] was paid $for the sole purpose of hiring [redacted] Firm as contractors to help me to complete and file my father’s VA application I didn’t submit my father’s incomplete paperwork directly to the VA - [redacted] Firm did that And I didn’t hire [redacted] Firm - Mr [redacted] did This doesn’t seem like money well spent to me regardless of how courteous and helpful Mr [redacted] was throughout the process Thank you again for your time and consideration Regards, [redacted] r

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowI have read [redacted] ***’s response to my complaint that was filed on March 5, I have attached the original statement that I sent to him on March 5, which he forwarded to [redacted] Firm that date As he stated, he asked that I not make an official complaint to the Revdex.com because he wanted me to wait for [redacted] Firm to respond to the statement He said that [redacted] said that she would have it written and sent by Tuesday, March 11, I told Mr [redacted] that the Revdex.com of the [redacted] , [redacted] said that I couldn’t directly file against [redacted] since he hired them – not me Therefore, I decided it was not in my best interest to wait to file a complaint with the Revdex.com of Cincinnati, OH as it was and still is up to him to address the complaint, not [redacted] It is March 24, and there still has been no response from [redacted] and no action taken by Mr*** However, I have included an attachment with copied/pasted email correspondence from [redacted] which still does not address the statement I still have the correspondence saved in my inbox if you need it in that format instead He is also correct in saying that he was referred to me by a lawyer ( [redacted] ***) for his servicesWhile I was in her office, she called and left him a message that I would be calling him regarding VA Services She then gave me his number and I followed up I’m not sure why he brought his up because it doesn’t seem relevant He hired [redacted] Firm, not Ms [redacted] and not me I found the small amount of work that Ms [redacted] did to be unsatisfactory so I paid her off and hired another lawyer ( [redacted] ) to continue to process I have been satisfied with Mr [redacted] as he managed to get my father on Medicaid within a couple of months without any appeals If it is necessary for me to explain to the Revdex.com why I became disenchanted with Ms***, please let me know and I will explain But I never worked with Ms [redacted] and Mr [redacted] at the same time At this point, I believe it is in my best interest to ask for the full $that was paid to Mr [redacted] for his services I think that it is up to him to then pursue restitution from [redacted] Firm Before I filed the complaint, I gave him the option of writing a check for $to my father because that was the amount that was paid to [redacted] He chose to wait to see how they responded even though he is and has been well aware of the poor service that I received from them throughout the process as I have sent him documentation as well as discussed it with him over the phone You will see in my original statement that he had to intervene with [redacted] on more than one occasion It is not important that other people that he has referred to [redacted] Firm have never had any problems like this with them before It only matters that I have Since he is the one that hired them, he can file the complaint with the Revdex.com in [redacted] , CO I would like $instead of the $I originally requested Thank you for your consideration I have more file attachments that back up my statement, however, there isn't enough room for me to include them here Please let me know if I can send them elsewhere Regards, [redacted]

[redacted] did not do everything right the first time I have already presented this evidence to Mr [redacted] and [redacted] I have also submitted evidence to the Revdex.com As [redacted] and [redacted] know, the VA is already several months behind when it comes to these applications They also know that the VA will not accept any mistakes on applications - the process stops completely until the mistakes are corrected and submitted Then they are addressed in the order that they are received along with everything else that is submitted to the VA This is how [redacted] and [redacted] (as well as others who are approved by the VA) sell these services to people who are in a hurry to complete the process They promise that they will cut the waiting time by helping people who are not educated on applying for these benefits Mr [redacted] and [redacted] say they have done this many times for other people They know how to not make mistakes Yet [redacted] made mistakes If they hadn't mistakes, this complaint probably would not have been made [redacted] and [redacted] also know that even if the application is started and filed with the VA, there will be no benefits if the veteran dies before it is approvedThere is also no refund for their services My father was when we started this He was also in compromised health I paid for the services because I knew that I needed "to get this done right the first time" because my father might die before it was approved and then there would be no benefits I hired [redacted] because he said [redacted] wouldn't make mistakes Yet [redacted] made mistakes I have outlined exactly what they didn't do right in my original complaint to the Revdex.com in March I had also sent evidence of this to Mr [redacted] in December when it happened There was a form that was supposed to be filled out by a company that I had hired for services for my father [redacted] neglected to send this to the company or to me so I could ask the company myself to fill it out The VA also sent me forms that my husband and I did not fill out correctly or completely [redacted] submitted them without sending them to me to correct and complete Therefore, [redacted] made mistakes I also have presented evidence of how [redacted] tried to confuse me by saying that I needed to create a "Personal Care Agreement" for my father's application in late August and into early September After several days of receiving advice from [redacted] on how to create this "Personal Care Agreement", I was told that it wasn't good enough She then suggested that I pay them an additional $to create one because by not doing so I might prevent the application from being approved as quickly When I called Mr [redacted] to ask why I was being asked to pay for another service, he told me he had never heard of this He said that the VA provided a form called an "Attendant Affidavit" on their website and that is what he had always used He contacted [redacted] and was told that it was only a suggestion Within the hour, the Attendant Affidavit was filled out by me and approved by Mr*** He then sent it to [redacted] to be sent to the VA I'm really glad that Mr [redacted] was there to intervene when necessary However, it never should have been necessary [redacted] was paid because they were "supposed to get it right the first time." [redacted] made mistakes Mr [redacted] is fully aware of this because he helped to correct them These mistakes - as well as the "suggestion" to buy the unnecessary "Personal Care Agreement" - has cost valuable time in obtaining these benefits for my father To explain this again - in late August and early September, I spent about a week going back and forth with [redacted] about this "Personal Care Agreement" when it was never necessary for me to have it So this cost about a week's worth of time in obtaining VA benefits In December - when the VA sent me the additional forms that were supposed to have been filled out and submitted (but weren't) and the ones that were not correct or completed (but submitted anyway), I contacted [redacted] and Mr [redacted] immediately After all, my father's living situation had changedI needed to know if these forms were still necessary At the time, I didn't mention how upset I was that this "was not done right the first time" because I wanted to get this done I did not hear back from [redacted] or Mr [redacted] for almost a week I then called Mr [redacted] who finally read my email He helped me to complete these forms, including making a 3-way call with a company to advise them on how to fill out the necessary form – so it would be “done right” before being submitted He also contacted *** This cost about days time But not only that - there was mailing time to receive the notification of the mistakes from the VA So after these forms were finally "done right" and submitted to the VA in December, they were still going to be addressed in the order that they were received How much time was lost here - I can't really say Again – the VA is several months behind on these applications Regardless, not "having it done right the first time", as promised by [redacted] ***, was taking more time than it was supposed to take And I had given him $to avoid this By the way, The VA never did request "Personal Care Agreements" like the ones that [redacted] tried to sell me There were only requests for the forms that were not submitted by [redacted] (that were supposed to be) and the ones submitted incorrectly and incompletely by [redacted] In his responses, Mr [redacted] also continues to sidetrack the matter with [redacted] by referring to the lawyer ( [redacted] ***) that referred me to himIt's not relevant But since he seems this is important to address, I paid Ms [redacted] for legal advice as well as a legal agreement she said that I needed I was not satisfied with her for a couple of reasons and chose to not use her when I applied for Medicaid for my father Mr [redacted] may or may not know these reasons First, I was dissatisfied because she told me that if my father became ill and ended up in a nursing home, I needed to have a signed agreement from him that I didn’t have She said that both of us would be in trouble if I had to apply for Medicaid for him without this signed agreement When she created and sent me the agreement, it didn’t have accurate information on it She also didn’t mention that it didn’t need her signature on it So I not only had an inaccurate form, I didn’t know if I needed her written signature on it - as well as my father's - for it to be valid This was on a Thursday I sent her an email immediately and waited for a few days for her to respond In a conversation with Mr***, I was told she was out of town I still waited – hoping to receive an email I received nothing When I finally called her office, I was told she was out of the country for weeks and had not given a contact name for someone in her office to call in an emergency I considered it an emergency because my father was and in compromised health Anything could happen to him while she was out of the country and I had an inaccurate legal agreement which may or may not require her signature to be valid When she finally came back to town, she told me I could modify the form anyway I liked and I didn’t need her signature for it to be valid Regardless, I paid her $ bill I knew if I had to apply for Medicaid, I would simply hire someone else And I certainly wouldn't recommend her to anyone I knew Coincidentally, when I hired [redacted] as my father’s Medicaid lawyer, I learned that Ms [redacted] misrepresented the facts This signed agreement was never necessary and Mr [redacted] didn’t use it when applying for my father’s Medicaid application $of the bill she sent me was for this "legal agreement" $was for her time I also explained to Mr [redacted] what was happening with [redacted] and the VA benefits He offered to help me – free of charge – in any way he could to get these VA benefits for my father His firm actually handled them too He said he offered this to me because I had made his job easy by submitting everything he requested in a timely and accurate manner My father’s Medicaid application was approved very quickly Mr [redacted] is still helping me to still get VA benefits for my father Although my father’s initial application was finally approved because of the work done by [redacted] , there are “retroactive” benefits that require more paperwork be filled out and filed It is true that [redacted] offered to do this for me – at an additional charge I said no After all, they had already made enough mistakes which had delayed the process And like the original VA benefits – if my father dies while in the process of filing for this – then there is no settlement In fact, the VA sent me something again last week that I forwarded to Mr [redacted] He didn’t understand it either and told me to call them to clarify so we could find out what needed to be done I was told by the VA rep that there were some mistakes in the letter – some of what they requested wasn’t actually necessary But there were some additional forms that needed to be filed My father will be on June Per his wishes, he is listed as “Do Not Resuscitate” at the nursing home where he resides He will receive no care other than pain management even for simple infections The “suggestion” for me to pay $for the “Personal Care Agreement” can be interpreted differently by different people Mr [redacted] and [redacted] choose to see it one way and I see it another However – none of us can ignore the fact that [redacted] made mistakes that could have been avoided This has delayed the process [redacted] knows this It’s in black and white on VA letters mailed to me that I forwarded to him And he went through this with me step by step I gave him the option of paying me $before I submitted this claim as well as when I first submitted this claim to the Revdex.com I told him he could then file with the [redacted] Revdex.com against [redacted] Since he has chosen to ignore the evidence, I have asked for the whole $fee to be returned I shouldn’t have to continue to explain to him that [redacted] made mistakes My time is valuable too Regards, [redacted]

I was aware of some of the concerns of the plaintiff before March 5,
It was not until March 5th that the plaintiff brought to my attention that she was considering seeking restitution
I was referred to the plaintiff by a local *** *** AttorneyThis attorney was commission by the plaintiff to assist her in several issues concerning her fatherShe became disenchanted with this attorney and dismissed herIn the meantime, I had contacted The *** *** Firm and commissioned them to assistThe reason I choose The *** *** firm was because the original attorney was familiar with their services and had success with other clients
In her complaint, she is frustrated with the level of service she received from The *** *** firmI have used this third party provider for several years and have had dozens of cases processed by themThis is the first time anyone has demonstrated any displeasure with their service
On March 6th I spoke with The *** *** Firm and we reviewed the letter that both of us had receivedSince I am not privy to the conversations between representatives of the law firm and the plaintiff, I do not know exactly what was discussed and when
I requested that the Law Firm respond to her concerns in writing, I conveyed to the plaintiff that I before I respond I wanted to hear what they had to sayI also asked that a complaint to the Revdex.com be postponed until we heard from

If they don't respond, I will need to rethink my future dealings with them, and focus on what, if any remedy may be available

I hired him because he said that [redacted] would make sure
"everything was done right the first time."  [redacted] did
not do everything right the first time.   I have already presented this evidence
to Mr. [redacted] and [redacted].  I have also
submitted evidence to the Revdex.com.
As [redacted] and
[redacted] know, the VA is already several months behind when it comes to these
applications.  They also know that the VA will not accept any mistakes on
applications - the process stops completely until the mistakes are corrected
and submitted.  Then they are addressed in the order that they are
received along with everything else that is submitted to the VA.  This is how [redacted] and [redacted] (as
well as others who are approved by the VA) sell these services to people who

  I paid for the services because I knew that I needed "to get this

mistakes.  
I have outlined exactly

be valid. 
This was on a Thursday.  I sent her an email
immediately and waited for a few days for her to respond.  In a conversation with Mr. [redacted], I was told
she was out of town.  I still waited – hoping
to receive an email.  I received nothing.  When I finally
called her office, I was told she was out of the country for 3 weeks and had
not given a contact name for someone in her office to call in an
emergency.  I considered it an emergency
because my father was 85 and in compromised health.  Anything could happen to him while she was out
of the country and I had an inaccurate legal agreement which may or may not require her
signature to be valid.  When she finally came back to
town, she told me I could modify the form anyway I liked and I didn’t need her signature for it to be valid.  Regardless, I paid her $400
bill.  I knew if I had to apply for
Medicaid, I would simply hire someone else.  And I certainly wouldn't recommend her to anyone I knew.    
Coincidentally, when I hired [redacted] as my father’s
Medicaid lawyer, I learned that Ms. [redacted] misrepresented the facts.  This signed agreement was never necessary and
Mr. [redacted] didn’t use it when applying for my father’s Medicaid application.  $200 of the bill she sent me was for this "legal agreement".  $200 was for her time.  
I also explained to Mr.
[redacted] what was happening with [redacted] and the VA benefits. 
He offered to help me – free
of charge – in any way he could to get these VA benefits for my
father.  His firm actually handled them too.  He said he offered this to me because I had
made his job easy by submitting everything he requested in a timely and
accurate manner.  My father’s
Medicaid application was approved very quickly.  
Mr. [redacted] is still helping
me to still get VA benefits for my father. 
Although my father’s initial application was finally approved because of
the work done by [redacted], there are “retroactive” benefits that require more
paperwork be filled out and filed.  It is
true that [redacted] offered to do this for me – at an additional charge.  I said no. 
After all, they had already made
enough mistakes which had delayed the process. 
And like the original VA benefits – if my father dies while in the process of filing for this – then there
is no settlement.  In
fact, the VA sent me something again last week that I forwarded to Mr.
[redacted].  He didn’t understand it either
and told me to call them to clarify so we could find out what needed to be
done.  I was told by the VA rep that there were some mistakes in the letter – some of what they requested wasn’t
actually necessary.  But there were some
additional forms that needed to be filed. 
  
My father will be 86 on
June 27.  Per his wishes, he is listed as
“Do Not Resuscitate” at the nursing home where he resides.  He will receive no care other than pain
management even for simple infections. 
The “suggestion” for me
to pay $299 for the “Personal Care Agreement” can be interpreted differently by
different people.  Mr. [redacted] and
[redacted] choose to see it one way and I see it another.  However – none of us can ignore the fact that [redacted] made mistakes that could have been avoided.  This has delayed the process.  [redacted] knows this.  It’s in
black and white on VA letters mailed to me that I forwarded to him.  And he went through this with me step by
step.  
I gave him the option of paying me
$950 before I submitted this claim as well as when I first submitted this
claim to the Revdex.com.   I told him he could then file
with the [redacted] Revdex.com against [redacted].  Since he has chosen to ignore the evidence, I
have asked for the whole $1500 fee to be returned.  I shouldn’t have to continue to explain to him that [redacted] made mistakes.  My
time is valuable too.

My response to the second complaint letter is to support the position of the [redacted] Firm.
The original letter of complaint primarily focused on a dissatisfaction with their service, and indirectly against me because I recommended them. And I do acknowledge and appreciate that the plaintiff made some very generous and kind remarks regarding my interaction with her. In her complaint she also made no reference to the local attorney that initially recommended me.
In the second complaint letter, which was a response to my request to allow the [redacted] Firm time to respond to her, the plaintiff reaffirmed her complaint against the [redacted] Firm, and requested to be reimbursed an additional sum. The plaintiff also confirmed her dissatisfaction with the attorney that recommended me, and she also confirmed she chose to pay that attorney. And as far as I know, she has not requested a refund from that attorney.
I do acknowledge that she was dissatisfied with both attorney groups that tried to assist her, and I do believe that both attorney groups acted in good faith. The attached document from the [redacted] Firm details their interactions, services, and benefits provided to the plaintiff.

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Regardless of everything else that has been
discussed, there is no way to dispute that [redacted] Firm submitted incomplete
paperwork directly to the VA and then did not follow-up with me in a timely manner in
order to correct this.  Mr. [redacted]
hired them and according to the [redacted] Revdex.com, he is
accountable for the services they provided as well as his own.  It is not my fault that he hired a group that
submitted incomplete paperwork to the VA which delayed my father’s application
from being processed. 
A quick recap:    
1.     1.   In July 2013, Mr. [redacted] was paid $1500 for the
sole purpose of acting as a “Distinterested 3rd Party” in order to
obtain VA benefits for my father.  He then contracted this out to [redacted] Firm for $950.    
2.     2.  In August 2013, [redacted] submitted incomplete
paperwork to the VA. 
3.     3.  The only reason that Mr. [redacted] helped me after
[redacted] was hired is because I called him when there were problems.
4.     4.  The biggest problem I had with [redacted] is the
incomplete paperwork that was submitted to the VA in August 2013.  I only learned of the incomplete paperwork in
December 2013 when I received correspondence and documentation in the mail from
the VA.  I emailed this information the
same day I received it to both Mr. [redacted] and [redacted] with scanned file
attachments and neither of them responded. 
  A few days later, I called and left a voice
mail at [redacted].  I still heard nothing
for a couple of days so I called
Mr. [redacted].  Mr. [redacted] tried to reach [redacted]
while helping me with the incomplete paperwork. 
Over a week later, [redacted] from [redacted] responded by email and that was
after Mr. [redacted] had faxed the completed paperwork to be re-submitted to the VA.  There was no explanation in her email as to
why the paperwork wasn’t completed properly before it was submitted.
In summation, I would not have paid $1500
to Mr. [redacted] to hire [redacted] Firm as contractors if I had thought they
would submit incomplete paperwork directly to the VA. 
After all, I didn't need to hire them at all.      
Regardless or not of whether there have
been no other complaints besides mine is totally irrelevant.  Regardless or not of whether [redacted] submitted
incomplete paperwork for other clients referred by Mr. [redacted] is totally irrelevant.    
When [redacted] submitted incomplete
paperwork to the VA in August 2013, it delayed the application from being approved
as quickly as it could have been.  After
all, I didn’t hear about the incomplete paperwork from the VA until December
2013.  I then waited several days for
[redacted] to respond regarding how to handle the incomplete paperwork.  This also delayed the application from being
approved.  The VA is 4 - 6 months behind.  VA reps will tell you this themselves over the
phone.  Therefore, any mistakes made by
applicants further delay the application from being approved.  
Let's not forget that if the applicant dies while filing, the application is canceled and there are no benefits.   
Again, Mr. [redacted] was paid $1500 for the sole
purpose of hiring [redacted] Firm as contractors to help me to complete and file
my father’s VA application.  I didn’t submit my father’s incomplete
paperwork directly to the VA - [redacted] Firm did that.  And I
didn’t hire [redacted] Firm - Mr. [redacted] did.  This doesn’t seem like money well spent to me
regardless of how courteous and helpful Mr. [redacted] was throughout the process.

In addition to my previous responses, I want thank the Revdex.com for allowing individuals to register their concerns in an indirect forum. While I am not a member of the Revdex.com, I respect the efforts you make to assist individuals like me and, in this case the plaintiff.
As in previous statements, the plaintiff has always made complimentary comments toward me and my efforts to assist in this matter, and I am appreciative. In fact, in the recent letter, she again acknowledges that I was attentive and helpful.
I acknowledge the customer concerns. It seems self-evident otherwise there would be no complaint of this nature.
While I am addressing several points in this recent letter, I still stand by the finding of the [redacted] Firm as were outlined in their response last month.
There are few items in which we agree and a few where our interpretation of events differ. And a few items that I am just not privy to the information that she brought forth.
Where we differ or where I am unaware of the plaintiff's interpretation.
I am quoted as saying, "...everything was done right the first time." I don't recall making this statement. Perhaps the plaintiff is paraphrasing her interpretation of what was said. Quotes that are more germane to my discussion might include: "... if the veterans dies during the process, prior to approval, the process stops. There is no refund from [redacted]." (The plaintiff confirms knowledge of this in her comments.) Or,"...if [redacted] is unsuccessful in their efforts to qualify the veteran, there will be a refund."
I agree with the plaintiff that I was the one that introduced the fact that there was another lawyer involved in this case. I never mentioned the lawyer by name or gender. And I disagree that it was to sidetrack any issues of the plaintiff. Most, if not all the work I do in this arena is through referrals from lawyers and other professionals. I do not solicit veterans or their families. The families usually find me because of other professionals. In addition to veterans and seniors, I also work with families that have a loved one with a developmental disability. These all can be highly sensitive situations, and each family and individual is different.
The plaintiff suggest that [redacted], myself, and others "..sell these services to people who are in a hurry to complete the process." Again, I did not find the veteran, or the plaintiff. They found and solicited me. And they found me from an attorney. I don't know how they located that attorney.
This is why this situation is so baffling. I have worked with both of these legal entities on numerous situations and this is the first complaint that has ever been filed. I am still trying to determine what is unique about this case, versus the other cases. Since the [redacted] Firm did the lion share of the work for the applicant, I responded to them for their comments. I submitted their response last month. If you don't have it, I will provide a copy.
The plaintiff also makes the statement that the initial attorney misrepresented the facts. That is not something I can address. I was not privy to their discussions nor am I able to interpret what was misrepresented to the plaintiff. As the plaintiff confirms, she was dissatisfied with this attorney and paid the fee. To my knowledge, she has not requested a refund. I have not approached the initial attorney about this matter.
The plaintiff states that her current attorney is assisting her in filing for back payments for the VA. In addition, she claims that [redacted] had offered to provide this same service, but at an additional charge. Attached is an email sent to the plaintiff dated March 10, 2014 at 5:24pm. In this email it appears she and [redacted] from [redacted] are discussing the issue of fiduciary arrangements for the veteran. As I read the email, it does not indicate that [redacted] is requesting any additional charge for this service. It is not clear to me why this claim is being made.
I am pleased that the plaintiff is consulting with a qualified [redacted] attorney for issues of Elder Care and Medicaid. The [redacted] attorneys with whom I have work are amply qualified to assist in these matters. And many have had similar success as hers in obtaining Medicaid benefits with no appeals. And that includes the initial attorney that the plaintiff dismissed.
She also discusses some recent letters she received from the VA. I cannot address those letters because I was not aware of them.
1 am also pleased that she was able to get her father situated in a safe place. It is clear to me that she has worked very hard to help him these last few years.

I have read [redacted]’s response to my complaint that was
filed on March 5, 2014. 
I have attached the original statement that I sent to him on
March 5, 2014 which he forwarded to [redacted] Firm that date.  As he stated, he asked that I not make an
official complaint to the Revdex.com because he wanted me to wait for [redacted] Firm
to respond to the statement.  He said
that [redacted] said that she would have it written and sent by Tuesday,
March 11, 2014. 
I told Mr. [redacted] that the Revdex.com of the [redacted], [redacted] said
that I couldn’t directly file against [redacted] since he hired
them – not me.  Therefore, I decided it
was not in my best interest to wait to file a complaint with the Revdex.com of Cincinnati, OH as it was and still is up to him to address
the complaint, not [redacted].  It is
March 24, 2014 and there still has been no response from [redacted] and no action taken by Mr. [redacted].  However, I
have included an attachment with copied/pasted email correspondence from [redacted] which still does not address the statement.  I still have the correspondence saved in my inbox if you need it in that format instead.
He is also correct in saying that he was referred to me by a
lawyer ([redacted]) for his services. While I was in her office, she called
and left him a message that I would be calling him regarding VA Services.  She then gave me his number and I followed up.  I’m not sure why he brought his up because it
doesn’t seem relevant.  He hired
[redacted] Firm, not Ms. [redacted] and not me. 
I found the small amount of work that Ms. [redacted] did to be unsatisfactory
so I paid her off and hired another lawyer ([redacted]) to continue to
process.  I have been satisfied with Mr. [redacted] as he managed to get my father on Medicaid within a couple of months
without any appeals.  If it is necessary
for me to explain to the Revdex.com why I became disenchanted with Ms. [redacted], please
let me know and I will explain.  But I
never worked with Ms. [redacted] and Mr. [redacted] at the same time. 
At this point, I believe it is in my best interest to ask
for the full $1500 that was paid to Mr. [redacted] for his services.  I think that it is up to him to then pursue
restitution from [redacted] Firm.  Before
I filed the complaint, I gave him the option of writing a check for $950 to my
father because that was the amount that was paid to [redacted].  He chose to wait to see how they responded
even though he is and has been well aware of the poor service that I received
from them throughout the process as I have sent him documentation as well as discussed it with him over the phone.  You will see in my original statement that he had to intervene with [redacted] on more than one occasion.  It is not important that other people that he
has referred to [redacted] Firm have never had any problems like this with
them before.  It only matters that I have. 
Since he is the one that hired them, he can file the
complaint with the Revdex.com in [redacted], CO.  I
would like $1500 instead of the $950 I originally requested.  Thank you for your consideration.
