Complaint # [redacted] Dear [redacted] This letter is in response to the complaint # [redacted] filed by [redacted] on 2/3/Mr [redacted] purchased the vehicle and was provided a month 3rd party warrantyThe warranty was provided through [redacted] [redacted] ***, at no additional cost to Mr***, The terms of the purchase agreement clearly state the vehicle was sold and no dealer warranty was expressed, guaranteed, or impliedA copy of the 3rd party warranty and sales agreement are attachedWhen he had a issue with the vehicle as a gesture of customer service we provided parts for the tire pressure problem as stated in the complaintNo further promises were madeAnd we told him to go and get the repairs finished at one of the auto service shops that we deal with on a day to day bases we made a couple of times appointments for him and he never showed up on time and that was the issue he couldnt leave the car to be repaired , after that he never contacted us about any engine issues or any sort of problems with his car and he never extended the warranty for that vehicle, from looking at the carfax report it looks like he got the tires checked at [redacted] auto group phone number (###-###-####) but when we spoke with him he told us that he still has the sensors in his vehicle and ignored the complaint that he was talking about, further into our investigation he put on the car after purchasing it when It had miles in the last six months.Very Truly Yours, Tony EL H**

The warranty was provided through *** *** ***- at no additional cost to *** ***The terms of the purchase agreement clearly state the vehicle was sold and no dealer warranty was expressed, guaranteed, or implied, And Ultra1motors does not have a Pennsylvania inspection station in order to inspect cars bought from auction , A copy of the 3rd party warranty and sales agreement are attachedAs well as Buyers guide, Ultra1motors bought the vehicle on 07/20/And the vehicle when purchased also had a valid PA inspection sticker on it until 05/2016- If the car would have had a bad frame issue or hole in it in Pennsylvania that wont pass the safety inspection requirements.Very Truly Yours,Tony EL H**

*** ** ***Dear *** *** ***As previously stated and dearly evidenced on the sales agreement, Ultra One Motors sold the vehicle "AS-IS” and provided a third party warranty through *** *** ***A written description of coverage and terms of the third party warranty was provided to Mr*** at the time of purchaseThe warranty was for a period of months or 3,miles and provided an option for the customer to extend the warranty upon the expiration of the original termCustomer did not renew.Ultra One Motors did not perform engine work or a PA vehicle safety inspection or emission inspectionThe vehicle was legally inspected and the stickers were valid when we purchased and sold the vehiclePlease note, Ultra One Motors is not a licensed PA inspection station and not a repair facility.At no time did Ultra One Motors indicate or imply an additional warranty other than the *** *** provided at the time of purchasePlease note, the odometer currently reads 118,which means Mr*** put nearly 14,miles on the vehicle since the time of purchase.Very Truly Yours,Tony EL H**

informed that all the vehicles come with a warranty provided by Ultra MotorsAt no time was I informed that it was a third party Warranty Company and that Ultra had no parts in the warranty, until after I began experiencing issues with the vehicleAs you will see on the copy of the warranty, there is no customer signatureFurthermore, after recently speaking with the warranty company, the warranty would only cover approximately $on the vehicleMajor engine repairs normally cost more than $Further, I was never informed of the amount that the warranty would cover, as the warranty was placed with all the other vehicle paper work when handed over to meIt was not until I called about the issues did I find out the amount that the warranty company would cover.Likewise, as stated in my last letter, to tell a customer that the dealership is selling the car with a warranty, then giving a third party without informing the consumer is a deceptive sales practiceIf you were to go the Ultra Motors lot, you will find numerous, if not all vehicles with a warranty sticker in the windshield, with nothing stating that it is a third party warrantyGoogle maps-earth shows that they have numerous vehicles listed as sold with warranty, and can be viewed at: https://***-*** *** *** ***.using the street viewMoreover, when the coverage for the warranty expired, I did not receive any paperwork stating that the coverage would need extended or that it endedAnd that time, while the vehicle was having issues, the warranty company was notified, and declined to repair the issues being that it did not deal with a lubricated part of the vehicleEither way, adealership purchasing a warranty and selling it with a vehicle is an “implied or expressed” warranty, therefore the vehicle should not be sold “AS IS”.Please note that Ultra Motors purchased the warranty for the vehicle, not the consumer.As per the vehicles inspection, Ultra is stating that the vehicle was legally inspected prior to the dealerships purchase of the vehicleBeing they did not complete the inspection, nor have the inspection completed, they could not know if it was legally inspectedThey also did not look into anything about the inspection, nor do a safety inspection prior to placing the vehicle for saleAt the time that the vehicle was inspected on July 15th, (see attached pictures) when purchased, the vehicle should not have been inspected until months later, as the vehicles inspection would not have expired until November (see attached car fax report date 11/26/2014), in violation of the PA Motor Vehicle Code, Ultra failed to complete any checks or inspections of the vehicle, but simply brought it from the auction and placed it on the lotNot to mention the fact that I was never informed that the vehicle was purchased at an auctionAt no time did the Dealership look over the vehicle, even though the salesmen who sold me the vehicle informed me that he is/was licensed in the state of Pennsylvania to inspect vehicles, leading me to believe that the Dealership inspected the vehicleFurthermore, while Ultra Motors may not have a garage to inspect their vehicles, they work closely with *** *** ***, which is only a few doors down from themThis is the same place they sent me to have my TPMS sensors installedAt no time did Ultra Motors attempt to have the vehicle looked over prior to sale, knowing that vehicles purchased at an auction come with more of a risk, yet sold the vehicle on the premise that it was just inspected and comes with a warranty.While the odometer reads 118,367,have kept up with all preventative maintenance on the vehicle since purchaseAttached you will find the oil changes completed, along with an exert from the vehicles owner’s manual showing how often the oil changes should be completed.Also the vehicle never had a buyer’s guide in the window, when the dealership showed the vehicle to me (the CarFax report will show that the vehicle was sold to the dealership on July 20th, 2015, which is the same day that I came to originally look at the vehicle), nor was one in the vehicle when I purchased the vehicleThe dealer gave the excuse that they had just recently had gotten the vehicle inThis is also a violation of PA and Federal Law pertaining to the sale of used vehiclesWhen a used vehicle is sold the Buyer’s guide is supposed to state all warranty informationThe Used Vehicle Order Form that MrEl H*** has provided does not provide all the information that would be provided on a the Buyer’s GuideMoreover, MrEl H*** failed to adhere to the Used Vehicle Order by allowing a family friend to borrow the vehicle when they were in townLikewise, the dealership failed to acknowledge the mileage change on any of the paperwork.I would just like the dealership to either take the vehicle back at full cost of the vehicle, along with any and all part that I have had installed or have the vehicle fixedThey should have had the vehicle looked over thoroughly before putting it on the lot and advertising it to be soldLikewise they should not give customers the idea that they have had they inspection completed and they are selling a Attached you will find a response letter along with documentation supporting my claim. I have came across the repair orders for the vehicle. The repairs were completed shortly before the vehicle was purchased. You will also find this attached. I have talked to the dealership numerous times about the issues with the vehicle and the dealership refused to assist.

To Whom This May Concern:            This letter is in regards to the response of Tony El H[redacted] to complaint # [redacted]. When the vehicle was purchased it was sold on the premise that the dealership was providing a warranty for every vehicle on the lot. The dealership does not inform you of a third party warranty group until an issue arises. Moreover, you cannot sell a vehicle “As-Is” then purchase a warranty and sell it packaged with the vehicle. Not only is that is using deceptive sales practices, but that would also void the “As-Is” clause, being the dealership supplied the warranty for the vehicle.  Likewise the vehicle was sold on the premise that the vehicle had a valid Pennsylvania Inspection and Emission Test completed. I was informed that this was completed on July 15th, 2015. The dealership failed to inform Plaintiff that the vehicle’s inspection should not have expired until November, 2015 and could have been tested at the earliest in August of 2015 (90 days before expiration), therefore the vehicle was sold with invalid and illegal inspection stickers. Moreover, the day that I had taken the vehicle off the lot, it was found that the taillight was out on the vehicle, and a vehicle cannot pass inspection with any exterior lights out on the vehicle, especially the brake/taillights.  Furthermore, I was not informed by the dealership of the fact that the vehicle had major engine repairs at approx. 90,000 miles. I found this out by getting contacting the garage that completed the work, [redacted] in [redacted] PA. Likewise, when I was shown the CarFax for the vehicle, it did not show that the vehicle was from an auction, nor that the vehicle had any engine issues. Likewise, when I was shown the CarFax report (via Mr. El H[redacted]’s cell phone) it did not state that the vehicle was sold at an auction. As I looked at the vehicle on 7/20/2015, this was the same day that Mr. El H[redacted] purchased the vehicle from the auction, and brought it to his lot.I have contacted the dealership numerous times speaking with Michael A[redacted], the salesman who sold me the vehicle and Tony El H[redacted], the owner of the dealership, about both the TPMS light and the check engine light being on in the vehicle. The check engine light came on a few days to a week after taking the vehicle off the lot and the dealership was informed of this. One of the times I informed Mr. El H[redacted] in person, in the presence of Nicole M[redacted], and he became combative about the issues. When I attempted to utilize the warranty provided, I was informed that the issue was not covered by the warranty company. The Mr. El H[redacted] was again informed and would not do anything to correct the issue. The dealership did purchase 2 used TPMS sensors that were given to [redacted] at [redacted] located right down the street from the dealership. I went to the garage numerous times to have the work completed, only to be given an excuse as to why it could not be done at the time. I offered to leave the vehicle, but only if I would be provided a loaner vehicle from the dealership, and Mr. El H[redacted] would not due this. Mr. El H[redacted] knew that I lived approximately 30 miles from the dealership and [redacted], yet expected him to continually travel for no reason. Moreover after speaking with Mr. El H[redacted] a final time in February 2016 when the engine failed, I was informed that the vehicle was not looked over by the dealership before I purchased the vehicle. Yet I was informed by Mr. A[redacted] that all the vehicles on the lot are thoroughly inspected before being sold.Mr. El H[redacted] is also relying upon a CarFax report that was a clerical issue as per the mileage of the vehicle, as an updated CarFax has been submitted by P[redacted]. I have had to have the replace one of the tires due to the tire blowing out because of the TPMS sensor. I did not have the senor put in at the time, because I did not have the sensor at the time, it was still in possession of [redacted] from [redacted]. I went to the garage approximately 6 different times to have the work completed, only to be given the parts on the final time.Furthermore, when I purchased the vehicle, it had 105,451 miles on it opposed to what was stated, as the dealership used the information from when I test drove the vehicle on 7/20/2015. Mr. El H[redacted] fails to mention that after the buyer’s agreement was signed, he allowed a friend to borrow the vehicle for the week, while they were in town. I found this information out on the way back from transferring the title of the vehicle.Again, I request that Mr. El H[redacted] repair the vehicle or take it back and compensate me for the parts and that I have put into the vehicle. Sincerely, [redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Hello Ms. [redacted]I'm in receipt of the mailed complaint response regarding my purchase of a 2002 4runner with a rusted car frame with holes.  Although I understand "AS IS" Please help me understand how this car passed state inspection (the state inspection states it checks the car frame) and then how ultra1motors could possibly sell a dangerous car where the integrity of the car is compromised? It can kill somebody. I've been trying to sell it to a mechanic and it has no monetary value. How can ultra1motors be in business selling cars with collapsible car frames?  I have had high-school and college kids coming to look at this car and I cannot sell it to them. It is absolutely terrible that this car dealer is in business at all!!!  AS IS meaning needs new tires, brakes, etc... is one thing, but when ultra1motors is selling cars with dangerous car frame with rusted car-frame & holes..It's quite frustrating to know that ultra1motors rips people off and then their vehicles are dangerous that can kill people!  How can Pittsburgh Revdex.com keep this from happening again, if it already hasn't?A very disappointed consumer.[redacted]
