Review: In the process of repairing our roof, Max Construction failed to properly cover the roof prior to a huge rainstorm. The result was that water damaged over 1/2 of our home. As part of the reconstruction of our home, kitchen cabinets were secured to replace the damaged ones from [redacted] LLC (in [redacted], VA). Max Construction paid a portion of the bill for the cabinets, but has yet to pay the remaining balance of $1,969.75, even though we have authorized them to pay the bill. Now, [redacted] has threatened to place a lien on our home due to non-payment by Max Construction.Desired Settlement: Actually, to be more specific, we expect the final payment of $1,969.75 to be paid by Max Construction to [redacted] LLC immediately.

Response:

Max Construction, LLC was contracted to tear off and replace a roof for the customer. The process was hindered because of extensive repairs that needed to done to the rafters and roof that were unforeseen from lack of maintenance from the previous homeowners. Because of these repairs the job was extended for several days. The day before the rainstorm, our crews worked diligently to cover the roof by laying tar paper and tarps. In fact, they worked until well after 9 pm in terrible winds to try to accomplish this task. When conditions became unsafe, we called them down.> > The rain started around 4:30 am and lasted around an hour. The rain did NOT damage half the home or anywhere near half. > > To sum this up quickly, our insurance paid for most of the damages caused by the rainstorm. Anything additional was at the cost of our company. This customer was over compensated by Max Construction, LLC and the insurance company. This customer has not even paid us the balance for the roof and for the other costs incurred as promised. > > We have over compensated this customer in excess of $90,000 (in repairs and renovations) outside of what the insurance covered and gave them essentially a brand new house including a new full master bath (instead of the shower stall, toilet and sink they had and vastly increased the size of the room) and walk in closet in the master bedroom that did not exist prior. We have done extensive repairs that had nothing to do with why we were there and have not received any compensation from the homeowners. The customers have indicated that any company "worth their salt" would have done the same. Which is preposterous. No company would have extended themselves this far. They would have repaired the damages and that's it. The customers have been asked several times throughout this job if they were happy and if any changes were needed. They were asked not only by myself but the insurance adjuster and have always replied that they were content with the progress and changes. Now they are stating that they don't like anything, after the job is 98% complete.> > Instead of patching areas of the walls we the contractors opted to pull any affected areas completely down to ensure that there were would be no complications after the fact. Again, these work areas were comprised of exterior walls and a few ceilings. > > The cabinets were only removed to access the walls behind to ensure that if there was water damage, it was remedied. However, due to the quality and other factors the cabinets were not salvaged.> > There were several issues that Max Construction, LLC had with [redacted] and their subcontractor for granite that we were attempting to address. We scheduled an appointment with the cabinet manufacture after arguing with [redacted] for several weeks and not getting anywhere. I personally contacted the cabinet manufacture who then put me in contact with the area representative and facilitated a meeting with him. After respectively three weeks of getting no where with [redacted], I had started making progress and hoped to have all of our issues and concerns addressed. > > During the week of June 3, 2013 the homeowners went to [redacted] and told them they no longer wanted Max Construction, LLC involved and that they would directly deal with any and all issues themselves without consulting us. We were not allowed on the job site the day the manufacture representative was coming. The final payment for the cabinets/granite is being held for a multitude of issues and we as a company have no indication(s) if our issues and concerns have been addressed. It doesn't matter if the homeowner "authorized" a payment or not. We purchased the cabinets and we want to ensure that the necessary repairs a made or issues rectified.> > The homeowner apprised our company on June 6, 2013 that we were abolished from all rights and responsibilities following the end of the weekend. Through the extensive conversation I had with the homeowner on Thursday June 6, 2013 I questioned the homeowner if all of their needs have been met, if there were any issues, or changes that needed to be made. I was told they were very happy and looking forward to moving in and moving on with their lives. The homeowner stated that if there was anything left unfinished or that needed to be done, they would handle the expense. Although, this is not a common practice of ours to leave any job undone I understood that he wanted to return to his home. Since we were neighbors and friends we respected what the customers wishes were.> > It was not until Saturday June 8, 2013 when the homeowner said he had a punch list and came up with being unhappy about the new blinds (that were purchased and were in their packages in the residence for days prior to being hung, that could have easily been taken back and replaced with what the customer wanted but they waited until after the fact) and one room of hardwood floors and stated they weren't paying us what we were owed but that we are even.> > The following Monday and Tuesday the homeowner brought in several different contractors/tradespeople onto the job site. Which inhibits us when addressing warranty and workmanship issues on our end. We do not know what transpired and have qualms about providing a warranty on things that were touched by others.> > Our subcontractors worked worked 7 days a week between 12-15 hour days, sometimes more for respectively 50 days to ensure that the customer was happy. Our company as well as our insurance company feel deceived and taken advantage of. I really did The customer has not paid us. They relieved us from our worksite and took on all responsibilities without paying us as promised. > > The customer has infringed on our rights as contractors to not only finish our work but, give us the opportunity to make any necessary repairs. The customer was told to provide us with a punch list after they moved into the house and failed to do that, instead they contacted other contractors. And they expect us to pay other companies to remedy the situation. This work was provided to them without receiving a dime of any compensation. Both our company and the insurance company have done everything possible to remedy the situation and keep the customer happy. > > We certainly have no issues with coming to a reasonable settlement and or solution so that both parties are content with the outcome. The customer does have all of my contact information. I have had contact with the homeowner through email and telephone and have also extended the offer of a formal mediation that has not been responded to.

For your reference, details of the offer I reviewed appear below.We have worked directly with [redacted] and [redacted] Cabinets and they have agreed to remedy the issues with any damages from shipping and handling, as well as missing items.
