On August 14, 2015, Mr [redacted] purchased a product from us on eBayHere are the product details: - sq ftVolt Warm Surface Radiant Tile Heat Floor Heating System On January 25, 2016, we received an email from MrCoffey, stating the following: This is regarding an an auction I won in august ( [redacted] ) for Heat.on flooring with GFCI thermostat that was switched for Warm Surrfaces that you said was only different in nameI am opening this package now to install the heated floor and see that Warm Surfaces does not include the thermostat while the heat.on auction that I paid for does come with the GFCI thermostatPlease send me the thermostat immediately to remedy the situationIf I don't get confirmation that this is occurring, I will initiate a full charge back through paypal and my credit card companyI'd like to believe this was an honest mistake that you will take care of ASAPIf not, I will take to any and all review sites, Revdex.com, and my local state attorney general with the all documentation clearly shown I was defrauded under bait and switch statutes in the federal and local statutesPlease respond to joel.wy#gmail where the # sign is an at signHere's our response to Mr [redacted] : Thanks for your emailPlease review our eBay policy, which we have pasted below for your referenceYou purchased this item in August 2015, and now it's January 2016, which is months after your purchased the productInspect your package carefully upon arrival, If there is any defective/ broken/damaged parts or you may think there are missing parts, we must receive a written notice through eBay (contact seller) (ON THE DATE OF ARRIVAL)The defective item(s) has to be in their original nylon wrapping upon the claim, some pictures may requiredThank You, Heat On Customer Support Our policy is very clear He should have inspected his package carefully upon arrival and provided us with feedback immediately Some companies provide customers with a 30-day dispute policy Others, like eBay, are very generous with a 60-day dispute policy Over months (days) had passed until Mr [redacted] decided to contact us This is both unacceptable and extremely unreasonable; and the force in which Mr [redacted] wrote his email to us demonstrates the weakness of his position He should have complied with our policy and examined his package in a reasonable timeframe This is our only and final position on this matter I am confident that you will appreciate our position regarding this matter based on the circumstances enumerated aboveSincerely, Shawn S [redacted] , CSP Sales Manager, Max Water

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowI received the following email from the seller on 8/12/15, after purchasing a Heat.on - sq.ft Volt Warm Surface , Radiant tile heat Floor Heating System with thermostatDear jr***,Thank you for order, sorry for the inconvenience, we do not have the item in our stock, so we will supply Warm Surface instead of Heat ONIt is exactly the same item but its just different brand nameif that is okay with you please reply as soon as possible, so we can ship it today. Note, we will remain your package on hold until we receive your further instruction - heat.onThe replacement product they sent does not match the same description as it did not include the thermostatI was mislead and did not agree to a substitute product without the thermostatThe party made a written misrepresentation of material informationFederal trade laws place no statute of limitations on deceptionI intend to pursue action until the matter is resolved

Max Water is the company that came up on the Revdex.com website when I entered the HeatOn telephone number of1488 into the search fieldThis is the site listed on the HeatOn website ( http://www.underfloorheatingcables.com/About-Us_ep_7.html )This is also the phone number they use in their
active listings on Ebay so the businesses appear to be correlated ( http://r.ebay.com/nvXDRb )Maxwater even sells the same products and lists the same phone number on their page ( http://www.reverseosmosis-usa.com/Multiple-sizes-120-volt-warm-surface-radiant-t... )I called the number and was told that they are the same companyIn the absence of any online profile for HeatOn, I submitted the claim against Max Water as their appears to be shared management/ownershipI was past the window for the Ebay resolution process and therefore encouraged to contact the seller directlyI did contact the seller through Ebay but was blocked after communicating my concern to the seller. I will contact Ebay's fraud claim department if I fail to get resolution as I think the product sent to me was a deliberate bait and switch, which would negate any statute of limitations on Ebay or seller policy

It is exactly the same item but its just different brand name. if that is okay with you please reply as soon as possible, so we can ship it today.  Note, we will remain your package on hold until we receive your further instruction    - heat.onThe replacement product they sent does not match the same description as it did not include the thermostat. Federal trade laws place no statute of limitations on deception. I intend to pursue action until the matter is resolved.

In the absence of any online profile for HeatOn, I submitted the claim against Max Water as their appears to be shared management/ownership.
