I apologize for the delay in responding to your correspondence. Mayfair Title Corporation ceased business operations in December of 2014, and the winding up process has been a daunting task, as our staff is now non-existent and the burden has fallen on me to resolve all of the outstanding issues.

We assisted Mr. [redacted] with the transfer of the property to him. We did not conduct a closing in the traditional manner, as the parties were related and had indicated that they would handle all of the credits and prorations outside of closing.

We were contacted by the seller, [redacted], in late December or early January because the tax bill came and was still in her name. At that time we discovered that  the deed had not been recorded.  We took steps to see that the deed was recorded             and the recording was completed on January 13, 2015.

Along with recording the deed, we were responsible for filing the property recording application with the City of Milwaukee Department of Neighborhood Services. We did so, and sent a check to cover the filing fees. We were not aware that the check was returned by our bank until we received this complaint.

At the time that the check was returned, we had approximately $86,000 in the account. The bank had rejected the check because we had a “Positive Pay” procedure in place, wherein, on a daily basis, we submitted the checks we had issued to the bank. If a check was presented to the bank that was not on the list, the bank would contact our office and reject the check if we did not give approval to pay it.  We had inadvertently failed to submit this check, and the bank had contacted us at an former employee’s email address that was not monitored. As a result, the check was rejected by the bank.

While I will certainly admit that we made our share of mistakes in this transaction, I take issue with the characterization of it as “unscrupulous misconduct.”

I should note that all of our dealings on this matter were with [redacted], and I have no recollection of speaking with Mr. [redacted] on these matters, and I certainly was not informed that he had paid our rejected check. If he had told me of this situation, we would have reimbursed these funds to Mr. [redacted] immediately.

I am mailing a check to Mr. [redacted] today in the amount of $161.82.

Future email correspondence should be sent to [redacted], and  additional contact information is shown below.
