Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
In a nutshell, the response provided by the business is laden with misstatements and half-truths. Given my interaction with the owner, *** ***, at the time I attempted to resolve my complaint with him in person it was clear to me that he had no intention of covering the damage his actions caused to my boat. An employee of his whom we first brought our concerns to earlier in the day was willing to take care of all the damage caused and offered to do so. He instructed my partner to take the boat back to the Marina later that day for work to be done on it at their cost. Upon doing so, Mr*** was there. He refused to do anything and renounced the offer his employee had made to my partner. She told me of this and I then responded to the marina in an attempt appeal to Mr*** directly, and he again tersely and rudely refused. His description of the events that transpired is, as I said, not accurate. And I have pictures, as well as a witness who was there when I talked to him, in addition to the employee with whom we first spoke. All can attest to the condition of the boat upon our picking it up.In response to Mr***'s description provided here, I take issue with the following as they are either misleading statements or entirely untrue:I contacted their office toward the end of April to inquire as to when the boat would be ready for pick-up, as this was my first time storing the boat over the winter. When I called, the person with whom I spoke told me they could not readily find my paperwork. I asked what they did to prepare the boat, as I thought they would tune it up, check fluids, etcprior to pick-up. Again, I was told they could not find my paperwork, but all they do is turn the key to see if the motor starts. He then said I could "pick it up anytime."On May 16, I received a voicemail from *** ***. He left a message advising that my boat was ready for pick-up. That was the extent of the message - I still have this message saved on my phone as evidence. He did not at this time advise me that he had or would be moving my boat out of protected storage, taking the travel cover off, putting the drain plug in, and putting the boat in an open field.Because I was traveling out of state, I returned the call and advised whomever I spoke with (they did not identify themselves and I did not ask) that I would not be able to retrieve the boat until I returned to Wisconsin. The person I spoke with said that would be fine. Again, during this phone conversation I was not advised that my boat had been moved out of protected storage and was sitting in the elements with the travel cover off and the drain plug in - in essence accumulating water. This person did NOT advise me that the conditions of our agreed upon storage had changed or would change prior to my being able to pick the boat up.Mr*** states in his response that the "boat was cleaned May 1st" but when I called prior to May I was told that the only thing they did to prepare the boat was to start the motor. They did not say that any cleaning was included, nor is that in the contract. So this statement is untrue.Mr*** states in his response that I called him a "coward" and "that I didn't give a *** about her boat." He neglected to provide the context for my first comment. I did, in fact, call him a coward. I did this after he walked away from me and entered an area out of site and in which I understood I was not invited to follow. He stayed there for several minutes and I believed he had simply cut off the conversation and walked away. So at that time, I called into the open door and asked him, "Are you going to be a coward and just walk away?" I did not at any time tell him that he didn't give a *** about my boat. This is blatantly untrue, and I have a witness who was there at the timeI did not tell Mr*** that I'd been an officer for "years" because I've been an officer for years. Again, his statement is untrue.I did tell him that I was going to tell all my co-workers, family, and friends, how I was treated and the damage that he caused to my boat without so much as an apology or offer to do the right thing and remedy the damage his practices caused.Mr*** is a tall and largely built manI am a slender, 5'10, pound woman. I am an educated, articulate career professional and comport myself as such. I find it absurd that he would state in his reply that I was "intimidating" or that I tried to "intimidate" him. What I tried to do was express my displeasure and advocate for myself in the face of an entirely unacceptable service that his business provided - one that caused significant damage to my boat.Mr*** stated that I yelled at him in front of my "friend" (my partner and witness) and his employees. This is yet another untruth. There were no other employees present when I spoke with him. In fact, he tried to end our conversation by telling me that it was time for him to close the business. I noted that it was minutes prior to closing time. He proceeded to walk toward his truck as I was trying to speak to him. He closed the metal swinging gate to the marina and walked to his pitruck parked in the lot. His was the only vehicle other than mine in the lot. Even though he knew I was unhappy with the service/damage he'd caused and did not feel the matter was resolved, he proceeded to get into his car and drive away. Leaving me and my partner standing ALONE in the parking lot.I filed my complaint with the Revdex.com as one measure of recourse given that Mr*** refused to resolve the matter with me - a cus***er - in any way. I did not expect that he would actually follow through with any admirable or decent response. Interestingly, days following my interaction with him - and not coincidentally the day I received notice from your office that the Revdex.com had notified Mr*** of my complaint - he called my place of work to file a complaint against me. I repeat - he called my EMPLOYER to lodge a complaint about our interaction and accuse me of who knows what. My interaction as a cus***er and a citizen falls well out of the purview of my employer and as such his complaint has no standing. Still, it is evidence to me of his ill character. That he had several days to call in a complaint against me if he was truly upset, but he only did so AFTER he'd received notice that I'd filed a complaint with the Revdex.com. This man is a despicable business owner/practitioner. My next step is to file a small claims suit against him in court. His conduct is beyond unacceptable. Clearly, he will manipulate and lie as I have seen here in his response to the Revdex.com complaint I filed.Regards,
*** ***

Review: Boat storage practices resulted in significant damage to my boat. Contract was for storage through May 1. Contract does not state that if the boat is not picked up by that date, it will be moved out of protected storage, placed in an open field, with the sturdy weather cover removed and the drain plug installed. I called around May 1 to ascertain when my boat would be ready for pick up. They advised that I could pick it up anytime. They did not articulate during that call that if I didn't pick it up by a certain date that the above practice would be employed. Nor did they articulate any additional storage fees that may be levied, though the contract does state that storage fees are applicable. Mid May, I received a call from an employee there (unknown who) asking about when I would be picking up the boat. I explained that I was out of state and would pick it up upon my return the following week. The individual on the phone said this was fine. Again, during this phone call the individual did not advise that the boat was or would be removed from winter storage and placed in a storage open field as described above. Nor did he advise that any additional storage fees would be assessed. Upon picking my boat up on Saturday May 30, the boat was in an open storage field several blocks away from the marina, with the large weather cover balled up on the floor of the boat. The light snap-down boat covers were on the boat. The drain plug was installed. Once home, I removed the covers to find extensive mold and mildew on all the seats and the dashboard. All the boat covers were lined with mold/mildew. Upon removing the bow seats to dry, I uncovered a large ant colony replete with larvae/eggs. Gallons of water had to be drained from the boat since the plug had been in for some time while in their care and out in the elements. The contract called for protection from the elements. And while the contract clearly stated a pick-up date of May 1 and I was unable to retrieve it by that date, it did not state that the consequence for not picking the boat up by that date would be anything other than additional fees assessed. Instead, the agreed upon storage conditions were changed without notice and the result was significant damage to my boat. When I attempted to seek resolution from the owner, he was rude and unrelenting. I even offered to pay the additional storage fees (which he did not request upon pick up) if they would clean the ants, mold, and mildew from the boat given that their actions caused this damage. He refused. Repeatedly. Without apology. Told me it was "my problem for not picking it up by May 1".Desired Settlement: Given the damage that Mazanet Marina caused to my boat, and their refusal to "repair" the damage, I had to take the boat to a different boat servicing business in order to prepare the boat for use. The cost of these repairs was $600. The cost to store my boat at Mazanet for the winter season was $800 . For the damage and hardship caused by their actions, I am seeking a full refund of $800.

Response:

We received a call from the customer the week of April 27th, 2015. She wanted the boat water ready to pickup the weekend of May 1st. We responded to that request by having the boat water ready by the above mentioned date and time. It should be noted that water ready includes installing the drain plug, running and cleaning the boat. Memorial Day weekend came, she did not pick up the boat, so we moved the boat to our storage field to provide extra parking. She finally picked up the boat May 30th and returned June 2nd. She told me she wanted the boat cleaned and she also said there was some water damage. I told her the boat was cleaned and ready May 1st, per her signed contract. She then proceeded to call me a "coward" and "that I didn't give a fk about her boat". She also explained to me how she "was a city cop for 16 years" and she was "going to tell her cop friends who love to boat to never do business with us". She also could not remember signing a storage contract until I showed her the signed contract, She admitted it was her signature and she did sign the storage contract. I feel disturbed by her actions, trying to intimidate me at my place of business in front of her friend and in the presence of my customers. She has no one to blame but herself for being negligent. I thought her behavior and disrespectful comments were uncalled for, especially for being in law enforcement.
