To: Revdex.comCC:  [redacted]Re:  Complaint# [redacted]Pursuant to Section 184.034, “For the purposes of computing the charge for electricity, the RV Park owner shall divide the amount charged the owner by the supplying utility for the preceding fiscal year by the total...

number of kilowatt hours consumed by occupants visiting the park in the preceding fiscal (calendar) year, which MAY included ALL the costs on your utility bill, INCLUDING the commodity and wires fees.” (paraphrased).  We do NOT include the commodity and wires fees.We re-calculate our charges as described above and re-adjust on January 1st of each year.  Thus, when ALL costs are included, the rate in which we re-bill will be slightly higher than the charge from the utility company.  We do NOT make a profit and are very cognizant of that fact and monitor it monthly.  Per our attorney, the Legislature ruling (stated above), and our member association, which works closely with the State Legislature, we are in complete compliance with the law.In the 5 years of ownership and 275 guest sites located over 3 different parks in the area, we have had one complaint regarding electricity.  The guest politely came to our office, and once we explained the system and law, the guest understood and no further complaints were made and the guest has remained at the park for over 3 years.  RV's are insulated to less than ½ the insulation of a house, thus will use more electricity.  Management and staff have been working continuously at Village 21 RV Park over the summer and have observed the complainants A/C running most of the day during the peak heat times.  An analysis of the RV's located on either side of the complainant and across the street reveal almost ½ of complainants usage.  Their A/C units do NOT run during the day as they are at work.  Complainant is offered a student rate, however a guest living with her is NOT a student and per our student rate policy, ALL occupants of the RV must be students in order to receive the student rate of $50/month LESS than normal guest rental rates.  Instead of raising the rent when we discovered the roommate was NOT a student, we elected to leave the rate alone at student pricing.  Per the complaint, the TOTAL amount of electricity used and charged for is being requested as a refund.  This request would, in effect, make her electricity charges $0 for the months she has been in the park.  Not only unreasonable but getting her electricity for free.  As we are in compliance with the law set forth by the state legislature, no refund will be given.  We do NOT have a tenant/landlord agreement and operate under the hotel/motel standards of rental.  No lease is signed.  As per the standards of the rental agreement, either party may terminate the agreement for any reason at any time.  If guest is unhappy with where she is staying, she is more than welcome to choose another location.
