Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint [Provide details of why you are not satisfied with this resolution.] Regards, This business is not honoring their warranty or promise to replace the defective merchandise they installed in my home and appear to be looking for a "loophole" to get out of doing soI agree that it is very unfortunate that I have had so many problems with my home including the problem I'm now having with Flooring AmericaI had a major sewer back up and my insurance did pay for my new flooring They paid Flooring America directly for the damaged area and I had additional flooring installed that I paid for out of pocket That claim was completed and that is the flooring that Flooring American installed that was defective They came out and inspected it and told me it would be replaced under warranty Subsequently, I had foundation problems caused by the sewer and filed a claim with my insurance, none of the claim involved flooring in any part of the house I was told by [redacted] at Flooring America we needed to delay replacing the defective floor until all the problems were resolved because there could possibly be floor damage related to these new problems I was having While I was in negotiation on the foundation and plumbing claim with the insurance company there was a small backup and I filed a claim that my insurance closed considering it to be related the foundation and plumbing claim we were already negotiatingThe claim covering the problems that Flooring American said might cause some issue with the flooring so we should wait to replace the defective flooring No, I'm not happy that they do not honor their commitment and it does not resolve my issue with them for them to sell me more merchandise

Our installation warranties and the product manufacturer warranties do not cover local damageWe all agree damage has taken placeWe do not know the specifics of the insurance claim as we are not privy to that confidential informationHowever, the fact that damage occurred has voided the warrantyBased on what information we do have about the situation there is not a viable warranty claim against the installation or the productWe don’t know how to proceed based on the facts of the case other than to let the customer and her insurance company complete their claims process Sincerely, My Flooring America

This business continues to avoid the issue that the warranty was for a defective product that they declared defective soon after the initial installation. They approved replacement but delayed replacement under a defective material warranty because they anticipated the repairs on my home that were in progress could cause additional damage. The warranty was not for workmanship unless their workmanship caused the product defect? I'm not sure how they think they can have it both ways, "doing me a favor" by delaying replacement of defective material anticipating that there could be additional damage and then denying replacement of the defective flooring because some minor subsequent damage did happen to occur. And, the majority of the defective flooring didn't have any subsequent damage. This is not resolved

I have been in contact with *** *** on several occasions this past week. I have informed *** *** that his particular stain claim on his carpet, which was caused by vomit, is not covered under the manufacturer's stain warranty. However, we have been
working with the manufacturer on *** ***s behalf to get a one time accommodation replacement of the carpet for the affected large family room where this stain occurredThe process of filing a claim with a manufacturer on a customers behalf can take several weeks. I am happy to report that after numerous calls and e-mails with the manufacturer this past week, we have been successful in getting *** *** *** to agree to sending us a replacement piece of the same carpet in the amount of square feet for his family room and although the manufacturer would not cover the reinstallation labor, My Flooring America will provide the labor as a one time courtesy to accommodate *** *** for a complete no cost replacement
We value *** *** as a customer and are happy that we could accomplish this accommodation for himI have also apologized to *** *** for not getting back to him this past *** as I had statedI have spoken with *** *** about all this and let him know that the process for this accommodation replacement will be a couple of weeksWe will process as quickly as possibleOur goal is to always do our best for our customers

It is very unfortunate that [redacted] has had so many issues with her home, from the original insurance claim to foundation and plumbing issues that she stated arose after her initial flooring complaint. Then subsequently another issue with a sewer back up as she also stated.

understanding that the flooring in question that was damaged has been resolved thru her homeowners insurance company. The damage is not covered under any warranty. Therefore, there is no claim with the manufacturer or My Flooring America. We would however, be happy to work with her on a new flooring purchase at this time.

As we’ve previously stated, we
rely on information provided to us by the manufacturer.  The original
claim was denied but we pushed for a re-evaluation of the claim which was
ultimately approved.  We communicated the information to Ms. [redacted] as we
obtained it from the manufacturer.  We also only become familiar with any
manufacturer discontinuations as they are reported to us by the
manufacturer.  We have worked with Ms. [redacted] on  her reselection to
finalize her flooring claim and issues. We trust that this will all conclude with a satisfactory outcome for her.    Sincerely, My Flooring America

It was warranty coverage for defective material installed by My Flooring America, that they had committed to replace, not an insurance claim. This seems to be a debate that's not going anywhere with My Flooring American's total avoidance of the actual basis of the complaint.  Is there a next step of resolution through the Revdex.com?   At this point I want to be reimbursed for the defective material and will have a new floor installed by another firm.  I no longer trust My Flooring American with a new installation at my home, or to honor any warranty or the word or promises of their representative(s).  They have surely not proven themselves to be honorable people.   I will be informing the owners of this My Flooring American franchise, [redacted] and [redacted] as well as anyone else that will listen of my experience .  Certainly not somewhere I will ever do business again or refer anyone as I have done many times in the past.  No, not honorable people.  Buyer beware!

I find interesting how the facts get twisted to make FLOORING AMERICA look like they ACTUALLY CARE about this... I was informed on JULY 28, 2015 that [redacted] had approved the claim. I visited the store on AUGUST 1, 2015 to see what material was going to be used to replace the original carpet. This visit to the store was a HUGE WASTE OF MY TIME, the store associates HAD NO INFORMATION REGARDING THE CLAIM, AND COULD NOT (OR WOULD NOT) ANSWER ANY OF MY QUESTIONS. I had a sample of the carpet with me, they stated that the material had been discontinued but could not tell what would be the replacement.I e-mailed the claims department and called on AUGUST 3, 1015 to find out what options were available to me since the carpet installed in my house was no longer available. I received an e-mail on AUGUST 4, 2015 stating that the following (I'm copying the text of the e-mail): We spoke with our rep and he is
researching to see what is comparable to the carpet that you originally
installed. He hopes to have some choices for you by the end of the week.Today is SATURDAY, AUGUST 8, 2015. AS USUAL, THE DEADLINE THEY GAVE HAS COME AND GONE AND NOTHING HAS BEEN RESOLVED YET. HOW LONG DOES IT TAKE TO FIGURE OUT WHICH CARPET IS COMPARABLE TO THE CARPET ORIGINALLY INSTALLED?This has been the issue from day one: THEY DO NOT FOLLOW UP WITH... THEY KEEP DELAYING AND DELAYING...

Our Fulfilment Manager has been communicating with Mrs.
[redacted] and while she’s not happy thus far with the current status,
it is where we are at in the claims process. Please understand that the claim’s
process truly does take as long as it has been and longer.  What she...

failing to understand is that we are the liaison between her and the
manufacturer.  [redacted] the manufacturer is denying the claim at this point as
they are not satisfied with the records she has provided relative to their
requirement for cleaning standards as outlined in the warranty they
provide.  This required care information was included in the documentation
she received at the point of sale as indicated by the terms and conditions form
as well as the warranty/care booklet for which she signed.
 
Danny and our claims department are continuing to engage
with [redacted] relative to this matter and have asked that they re-visit it which
would probably include a re-inspection.  At this point, we are doing
everything we can do. The information we are obtaining and able to obtain from
the manufacturer is being passed on to her as diligently as possible. The
product warranties are with the manufacturer and we are doing everything we can
at this time to represent her as our customer.  
Our goal is for customer service and satisfaction and we
will continue to work on this matter in her interest.

We re-scheduled with Ms. [redacted] to have the cabinet piece installed on 5/3/15. As we are in the flooring business, we relied on the cabinet company to provide us with the piece required to fix Ms. [redacted] cabinet trim. Unfortunately, we did not receive the correct piece from the cabinet company. Fortunately, we did have an installer who was capable of custom fitting a piece to complete the job. We were informed by the installer that she was satisfied with the work; however, we have not yet heard back from her regarding our Quality Control Manager’s request to determine if she was indeed satisfied.
