Review: During August 2011, I received a quote from MCC inc. to prep and pave 911 ft. of gravel roadway with 2 1/2" of asphalt. The 9 property owners on this road all agreed to pay a share of the cost. MCC informed us the road would be paved in late Sept. or early Oct. 2011. After many follow ups with MCC, they finally prepped and paved the road in late Nov. 2011. MCC gave us a 1 year warrenty against any defects or performance issues with the asphalt. When I talked with one of the workers prepping the road, he told me this road will last for 50 yrs. After about 1 month (Dec. 2011) the property owners started to complain to me that there were cracks in some of the asphalt. It wasn't major and soon after the road was covered with snow for the winter. The snow plow is a pickup truck. Of the 9 property ownders, I am the only permanent resident, the rest are summer homes, so there is very little traffic of any kind on the road. The trash collector ([redacted]) is the only large truck that comes down the road every other week and is empty when it comes. When the snow melted in April of 2012, there were many more cracks in the Asphalt. In July I called MCC and talked with Daryl [redacted] Stratton about the issues with the road. He stated that he had never heard of anything like that. MCC came and inspected the road and assured the property owners they woudl take care of it. I made at least 15 calls and several emails to MCC during the remaining months of 2012 - talked with several different people in the company and they all assured me the road would be repaired. Nothing ever happened. now one year later the ashphalt continues to deteriorate and there are weeds growing up in the cracks. it won't take long for the freeze/thaw cycles to start to crumble the ashphalt and create potholes. We spend $13,000 for this road that was supposed to last 50 yrs, and it didn't even survive an entire month.Desired Settlement: I would like MCC to repair or replace the ashphalt before winter so that the prpoerty owners get the product we paid for.

On 09/20/11 MCC, INC. submitted a proposal to Mr. [redacted] to fine grade the existing gravel

base and pave with 2 1/2 type E-1, 12.5 mm upper course asphalt, a 911' X 10' roadway.

When the job was quoted MCC, INC. was told that the sub base that MCC was to pave over was a "good

base" that was done 10 + years earlier and was ok to pave on by Mr. [redacted].

Mr. [redacted] returned an accepted signed proposal dated 09/28/11.

On 11/11/11 MCC, INC. fine graded the roadway and noticed some areas where stone was needed.

MCC added some stone in noticeable low/soft areas. The roadway was paved with the material

indicated to the specifications that were quoted .

After the project was completed, Mr. [redacted] contacted [redacted] - the MCC, INC.

salesperson handling the Job. Mr. [redacted] indicated that cracks were starting to show on the

outside edge of the roadway. [redacted] inspected the cracks in the road and indicated to Mr.

[redacted] that heavy trucks need to stay off the edges of the asphalt paving.

At a later date Mr. [redacted] again contacted the MCC sales Rep, [redacted]straten and said more

Cracks were appearing near the middle of the roadway. [redacted] straten re-visited the project to

review the cracks indicated by Mr. [redacted].

MCC's salesperson, [redacted] contacted Mr. [redacted] and informed him that it is the

belief of MCC, INC. that the failures are due to an inadequate sub base that MCC was told to pave on.

MCC, INC. contends that the above project quoted to Mr. [redacted] was completed according to

the accepted Quote as specified using quality material per specifications, and the problem lies within

the existing sub base that MCC, INC. was instructed to pave on.
