We took a look at the driveway and saw no issuesFurthermore, per the signed contract, we offer an industry standard one year warrantyThat warranty would have expired on 5/21/2014, and the customer didn't issue a complaint until late July of

I submit three documents ("A","B","C"), each of which shows that the north side of the exiting driveway at *** *** *** ***, from the brick front walk to the "apron" at the foot of the driveway, was straight - essentially a straight line with no bend, curve, or "crook" in it - prior to the driveway's removal by B&C Blacktop on October 21, 2014.Document A - is a survey of the house and lot - including the driveway - at *** *** *** ***, done by *** * ***, a prominent and reputable surveyor, in North side of the driveway was essentially "straight".Document B is a print-out from the Franklin County Auditor's website, showing two images of the house and lot - and driveway, at *** *** *** ***The left image - a map done in 2010, and the right image - a photo done in 2008, both show that the North side of the then - existing driveway was straight.Document C is a diagram prepared by B & C Blacktop itself, and sent to me as an attachment to an e-mail sent to me on July 14, The same e-mail contained two other attachments: B&C's quotation for the new driveway, and B&C's terms and conditions for its work It is clear from the cover letter for the e-mail and its three attachments that B&C viewed the entire e-mail as its written contact with me to do the new drivewayI have included the cover-letter and the three attachments, but my main point here is that B&C regarded the diagram as very important and part of its contract with me.A careful, close inspection of this diagram shows that B&C itself saw and concluded that the north side of the existing driveway was straight - "essentially a straight line" - from the brick walk down to the "apron" at the right-of-way areaTo see this, focus on the solid blue line in the sketch.*** ***

We have addressed Mr ***'s concerns with the driveway installation. We made numerous return visits and have had numerous telephone conversations with Mr *** before, during and after the driveway installation. Attached is a statement of satisfaction that Mr *** signed
after his concerns were addressed

Thank you for responding to my complaintI appreciated receiving a copy of the statement of satisfaction dated 10.30.14. It is my position that I signed the statement to express my satisfaction with *** ***'s work that day to remove the asphalt in the "apron" that B&C installed incorrectly behind the curbs at the foot of my driveway in the "right of way" area. However, the basis of the complaint in front of us now are: the north side of the driveway is crooked, not straight or even close to straight, whereas both North and South sides of the previous driveway was straight. There is a low spot near the Southeast corner of the driveway which retains a lot of water (puddles) in a heavy rain. Some of the asphalt is already crumblingThis could indicate a serious problem with workmanship. These concerns [1, and 3] could not have been addressed by you when the satisfaction statement was signed because I did not discover them until November, 2014.You did send two workers out ot my property on I do not know what they did on the driveway that day, but they certainly did not address any of the concerns described above [1,2,3].My interpretation of sectof your document entitled "Terms and conditions" is that I am entitled to have you address all three concerns [1,2,3].Also, I note in the contract that I signed with you on July 24, the statement "All work to be completed in a workmanlike manner according to standard practices." Therefore, I am asking you to look at these pictures (in the file) and make an appointment to come look at the drivewayThen I am sure that you would agree that these concerns need to be addressed and resolved.Thank you for your timeI look forward to your reply.Regards,
*** *** ***

As discussed previously, there are no issues with Mr***’s drivewayPrior to the removal of the driveway, it had at least six inches of grass overgrowth along the driveway edges which hid the old edgesAs stated before, the grass at the edge will again grow back in the same fashion and hide the edges of the current new drivewayWhen asphalt is hot it is in an almost fluid stateThere are several factors that could affect the flow of material through the machine to the screedIt is not uncommon to have some deviations in the edge of a residential drivewayIt is not a highway class paver with end gates used to install a drivewayIf indeed Mr***’s driveway has a deviation, it is not a structural problemI have seen the driveway in question several timesIt does have a slight bow in the side in question if you stare at it and look for itThis is not a structural problem nor is it something that needs to be torn out and reinstalledThe driveway is a structurally sound and aesthetically pleasing piece of pavementAs stated before, we have addressed every one of Mr***’s complaints in a timely mannerThere is nothing that can be done or needs to be done in the area in questionBy this fall the edges will be grown back in and defined by grassMr*** has agreed in writing that he is satisfied with the driveway and I am sorry but there is nothing else that B&C Blacktop can do for Mr***.Thank you*** ***President, B&C Blacktop

regardless of the Standard one-year warranty
the driveway was not installed correctly If it had been installed correctly, my driveway would not have tire ruts, which by the way, will only get worse as time goes on. I had an asphalt driveway at my former home for years and it never developed tire ruts, it remained flat. I own a Mini Cooper not a Dump Truck It makes no sense that two years after the installation of this driveway that it is degrading as much as it has because not only does it have tire ruts but the actual stone underlayment is starting to push through to the surface of the driveway. When Chris, an employee of B&C came out to my home and placed the level on the troubling areas he stated to me that he understood my concerns, it was clear when he placed the level on the driveway that it showed the rise and fall where the car is driven on the driveway. There is no reasonable explanation for the condition of the driveway other that it was either installed incorrectly or an inferior product was used. It seems to me if the owner of this company wanted to maintain a positive rating for his company he would make an effort to resolve this complaint to my satisfaction

I am attaching a copy of the notes from my employee [redacted] who was the lead on any problems with Mr. [redacted].  As you can see form his notes we have gone above and beyond trying to satisfy this customer.  I also live in the neighborhood less than a half mile from Mr. [redacted].  I am not in the habit of letting my company install inferior work ever, especially in my own neighborhood.  I received several phone calls form [redacted] officials whom are very familiar with Mr. [redacted] due to their multiple interactions with him over the years.  [redacted] has no issues with any of the work that we performed for Mr. [redacted] and does not want to have nay more interaction with the situation.  The notes that I am attaching from [redacted] detailing all of his interactions with Mr. [redacted] paint a very clear picture of the lack of a situation and the over reaction of an over zealous customer.  There is nothing else that we can do to satisfy Mr. [redacted] because it is not possible.  On 10/30/14 Mr. [redacted] signed a paper stating that he was satisfied with all of our work.  At this time I request that the Revdex.com remove this complaint from our record.  Thank you[redacted]PresidentB&C Blacktop

We do not see any concerning issues with the driveway. The warranty is long expired. I have attached current photos.
