Don't rent here
I filled out an application. After reading reviews, etc. decided to buy a house instead. The application cost over $600, but $400 was a refundable deposit. I put the request for the deposit back in June. It is October and the company is giving me the run around - and, no deposit returned. They said there was an error with the "home company" and also stated check mailed out 2 weeks ago. Do not rent here - glad I'm just waiting on a deposit return and not living there with this kind of service!

I'm tired of offering my comment to the staff of how they should be running their business. All I can say is I pay 1700 a month to live in what's a dump... look for yourselves these are pictures that I've took around the property. They aren't the lush beautiful pictures on the website. Look at the green pool, the ceiling crumbling, the trash buildup behind the property, the animal area that has no poop bags and is always muddy.

I am a Senior at Texas State University and came across McCarty Commons and signed a lease in January 2020 to move in August 17th, 2020 before the Fall Semester. I did this ahead of time because over the Summer I was moving to Florida for an Engineering Internship that was ending August 14th, 2020 and I wanted to be able to just move into my new apartment when I came back with no problems. Today I noticed I couldn't login to my resident portal and called the front office. They proceeded to tell me their system for some reason stated I was supposed to move in August 1st, 2020. They claimed they tried to call me multiple times that day and there was no answer which is not true. I asked what number they had on file and it was my mothers who is not even going to be a resident there. I didn't receive any calls at all myself as the future resident and no voicemails were left. The day this happened was today August 10th, 2020. Apparently today there is someone already moved into my apartment and there is “nothing they can do” even though my lease clearly states my lease start date is August 17th, 2020. They mentioned the only option I had was to choose another available apartment and I'd have to resign a whole new lease. When I stated I wouldn’t be satisfied until I had the apartment that I originally requested the Leasing Manager interrupted me while I was talking and said she’d issue me a refund and hung up on me.

Now I’m currently in a different state having to find new living a week before I'm supposed to move back to Texas.

I also have a friend who had a similar thing happen to him with this same apartment complex. I feel these employees could be taking advantage of the fact that most of their residents are college students who don't know the law and have no one to advocate for them when situations like this happen. Their mistakes are illegal, and these employees should be held accountable.

McCarty Commons is in San Marcos, Texas and only 8 minutes
from Texas State University, making it ideal for individuals who need to be
close to the University. Between July 1st, and August 1st, 2020, McCarty
Commons had over eighty 80 move-ins as it is the newest community in the area.
Unfortunately, a clerical error occurred and Ms. move-in date was
entered into the system as an August 1st, 2020 move-in, not an August 17th,
2020 move-in. The conversation log shows that the Leasing agent attempted
to contact Ms. by the phone number that she listed on her application and
also tried the phone number listed as Ms. mother to discuss with her
what the staff thought was her missed move-in date. Please see the attached
conversation log and rental application. On August 3rd, 2020, the leasing office assumed Ms. was a No Show to move-into the apartment since they were not able to get in
touch with her, so her application was canceled in the system and the unit put
back on the market as available. It was leased quickly and occupied by another
individual. When the applicant made contact and the error was
discovered, the McCarty Commons Management apologized profusely to Ms.
***. She was offered the same exact type of unit on the same floor
(3rd) as the unit she initially reserved, as well as a premium unit on the
first floor with a private yard for the same price. Ms. refused any other
unit and demanded to make the occupants of the original apartment reserved to
move out, which was not something that could be done. Management decided after all possible options had been
exhausted and they endured countless verbal abuse over the phone from Ms.
***, that no option would be accepted by her. At that point, conversations
were ended and Ms. was told that they would gladly refund her full
$100.00 that she had put down on the apartment.It was a human error that caused the clerical mistake, not
maliciousness or an attempt to take advantage of anyone, and is certainly not
illegal as the staff tried to contact Ms. on the move-in date that they had
in the system of August 1st. After no response was made, the staff
followed protocol to release the unit hold and begin trying to lease the unit
again. The staff tried to go above and beyond to make things right with Ms.
***, even offering a premium unit normally more expensive than the original
one leased to her. We apologize for the clerical error, and we wish Ms. the best with her future endeavors.Tell us why here...

I am rejecting this response because:

I feel the call log McCarty Commons provided lacks credibility since it’s handwritten and can easily be altered to better fit the story on why certain decisions were made by McCarty Commons Employees. Attached is my lease that McCarty Commons has on file as well. I’m concerned why anyone within the office wouldn’t think to double check the lease document to ensure I was a no show before making any further decisions. This lease shows I was in fact NOT a no show. These actions by McCarty Commons are in Breach of Contract and I never received in writing that my contract was being terminated after the supposed missed calls. I’ve attached my mom and I’s actual call logs from our cell phone provider. These show no calls were made on the dates they claim they tried to get ahold of us. I also attached call logs from May to show those calls were not documented by McCarty Commons therefor their attachment cannot be used to prove anything.Verbal abuse is hear say, I’d like to challenge McCarty Commons to provide voice recordings to support their claim. These will also show I received no sincere apologies, and no one went “above and beyond” to fix the situation. With inconvenience comes frustration however I nor my mom were ever verbally abusive. Regardless, it’s never okay to hang up on a customer not once but twice and decide their final outcome when that was not what they asked for. Especially when the issue is not their fault but the Employees. Clerical errors happen but the lack of professionalism from both Shanae *** and Alissa *** was unacceptable and they need to be held accountable for their actions.
