Initial Business Response / [redacted] (1000, 5, 2014/03/12) */ [redacted] tried to make her reservation in September for Maili Cove via Flip KeyShe was unable to complete the simple on-line payment option available through themShe was very frustrated after several attempts, and as can be seen in our emails, I offered her other options to make her 50% deposit confirmation; iesend me a check, pay with credit card via PayPal or have her bank send moneyAND there was nothing to stop her from completing the reservation payment on Flip KeyHer email to me even said she did not like themWhile waiting for her payment, I turned down other potential bookings covering all or some of her datesShe swore she was going to pay and begged me to hold her datesShe chose to send me a check for the 50% with final payment due days PRIOR TO her arrival in the condoShe never made the final payment prior to days of arrival and when we last spoke, she said she was arriving a week prior to the rental (in a few days) and will bring me a check the day she landedShe did not The next day or two, about a week prior to her rental dates, she called me and said her husband was in the hospital and she wanted to go home but didn't know what to do because she was flying in her daughter-in-law and child arriving from Taiwan to stay with herShe wanted me to keep it open for them until she was sure they would not need it; ieif [redacted] could not cancel their flights and/or get one for herself to go home She had difficulties with flights If this was not stress enough, she had to move from her sons studio to a hotel and could not find one she wanted to affordI had much empathy for her and offered to let her go right out to the condo for additional nights FOR FREE.(still without full payment)After a few days she got her tickets and left, never having made her second payment due over a month ago to honor her responsibility [redacted] is the one who did not honor her word and now she wants all her money backI think it is she who owes me legally, the full rental not cancelled with days notice This was the beginning of peak vacationers and I could have rented those days easily if I had my daysMy refund policy is on all my rental sites and when she asked about it in email, I said: (days notice 75% refund60-days 50%Less than days, NO refund)With only days notice, re-renting did not happen, but I had previously told her even with less than days, if I could re-rent her commitment, I would do so and refund all her moneyThat IS THE ONLY TIME I spoke about full refundEven so, I felt for her due to her husbands condition and after later calls from her, said I would do something when I could and had intended to pay her back $of the $she had paidI told her that as soon as I had funds from future bookings I would do so as I could, indicating it may be $here and there until I paid her $She apparently, mistakenly, thought it would be tomorrow Unfortunately bookings fell off the wall, requests have been nil, and I have never seen anything like itThere have been no new bookings and this rental is my only source of income (other than Social Security) to live on I will honor that $for [redacted] as I said, even in lieu of her threats to file a law suit I have never had any real estate actions against me or my company since inception in I feel I went way above and beyond for [redacted] and have taken a far bigger financial loss than she didShe was fully informed how things workI was overlooking my substantial loss, all the while trying to help herNot only do I think I am not legally bound to do this, but legally she owes me for the full paymentShe was the delinquent never honoring her payment agreement, plus she did have full disclosure This is honest, I have documents to prove what I have said and even a witness as to what has been said to [redacted] over the phone Thank you for your understandingI will await your reply Meanwhile, you may want to check out my sites: [redacted] and [redacted] Check out refund policies and please read the latest comments by our guests If you need anything else, just let me know before March 29thor after April 22nd as I will be out of the country at that time The documents mentioned above will be faxed to [redacted] At present, my fax is [redacted] Sincerely, [redacted] (R) McCloskey & Co, Realty [redacted] cell PS: I do not and have not handled any rentals other than my own for over years Final Consumer Response / [redacted] (2000, 7, 2014/03/13) */ (The consumer indicated he/she ACCEPTED the response from the business.) seen in our emails, I offered her other options to make her 50% deposit confirmation; ie. send me a check, pay with credit card via PayPal or have her bank send money. AND there was nothing to stop her from completing the reservation payment on Flip Key. Her email to me even said she did not like them. While waiting for her payment, I turned down other potential bookings covering all or some of her dates. She swore she was going to pay and begged me to hold her dates. She chose to send me a check for the 50% with final payment due 30 days PRIOR TO her arrival in the condo. She never made the final payment prior to 30 days of arrival and when we last spoke, she said she was arriving a week prior to the rental (in a few days) and will bring me a check the day she landed. This was the beginning of peak vacationers and I could have rented those days easily if I had my 30 days. My refund policy is on all my rental sites and when she asked about it in email, I said: (60 days notice 75% refund. 60-30 days 50%. Less than 30 days, NO refund). With only days notice, re-renting did not happen, but I had previously told her even with less than 30 days, if I could re-rent her commitment, I would do so and refund all her money. That IS THE ONLY TIME I spoke about full refund. Even so, I felt for her due to her husbands condition and after later calls from her, said I would do something when I could and had intended to pay her back $500. of the $900. she had paid. I told her that as soon as I had funds from future bookings I would do so as I could, indicating it may be $100 here and there until I paid her $500. She apparently, mistakenly, thought it would be tomorrow.
Unfortunately bookings fell off the wall, requests have been nil, and I have never seen anything like it. There have been no new bookings and this rental is my only source of income (other than Social Security) to live on.
I will honor that $500 for [redacted] as I said, even in lieu of her threats to file a law suit I have never had any real estate actions against me or my company since inception in 1980. I feel I went way above and beyond for [redacted] and have taken a far bigger financial loss than she did. She was fully informed how things work. I was overlooking my substantial loss, all the while trying to help her. Not only do I think I am not legally bound to do this, but legally she owes me for the full payment. She was the delinquent never honoring her payment agreement, plus she did have full disclosure.
This is honest, I have documents to prove what I have said and even a witness as to what has been said to [redacted] over the phone.

Yes, I agree to a refund of 500 dollars asap. I hope that her condo rentals pick up. It is a very nice condo. The refund is greatly appreciated and hopefully will arrive soon.I will inform you when monies are received and matter is closed.
