Revdex.com Complaint: [redacted] Pursuant to Revdex.com Complaint: [redacted] First, as explained in McGraw-Hill FCU’s response of 2/27/17, [redacted] has been habitually late since the inception of his lease in July resulting in his leased vehicle being placed for repossession three separate times This chronic and consistent lateness has resulted in expenses incurred by MHFCU and ultimately its membership since MHFCU is a not-for-profit financial institution The charge of $was paid by [redacted] to redeem his car from the repossession company This fee is paid directly to the repossession company and not a fee imposed by MHFCU Second, despite many requests from MHFCU and MHFCU sending the reoccurring payment forms to [redacted] , [redacted] failed to complete and return the completed forms to MHFCU To date we have not received any of the completed forms to set up reoccurring payments [redacted] continues to avail himself of the onetime online electronic payment, WebPay, on the MHFCU online banking system Third, [redacted] is correct he always lived in the state of NY However under Section of the lease contract, the lessee [redacted] is required to notify the owner and lien holder of a change in address/location of the vehicle in writing [redacted] failed to comply MHFCU after much searching for the vehicle only learned of the change in address/location of the vehicle through an investigation conducted by the repossession company [redacted] failed to comply with the lease contract Based upon the previous detailed payment history and breach of contract MHFCU strongly believes the redemption fee paid to the Repossession Company should not be returned to the member Should you wish any additional information I can be reached at [redacted] Kathleen P [redacted] Vice President of Lending

contract on, [redacted] has been habitually late and breached the contract, Section Prohibited Use of Vehicle by moving the vehicle out of the state for days or greater [redacted] moved from [redacted] to [redacted] This is expressly prohibited by the lease contract The member’s chronic delinquency since 9/10/to present resulted in the vehicle being placed for repossession on three separate occasions Only the last placement resulted in physical repossession of the vehicle Each time the vehicle was placed for repossession MHFCU incurred costs most of which were not covered by the member In the last instance when [redacted] again became $delinquent the vehicle was found and repossessed This is the only time the member was required to pay the repossession fees of $675.oo to redeem his vehicle from the Repossession Company Below please finds the payment history and subsequent delinquencies for [redacted] On 7/10/15, [redacted] was approved for month lease financing from McGraw-Hill Federal Credit Union (MHFCU) and became a member of the MHFCU Member’s due date is the 10th of every month with the last lease payment on (10/10/2018)Contracted lease amount is $382.22Member paid the first payment at dealer advancing the next payment due date to 8/10/ Member missed the payment on 8/10/and 9/10/becoming months delinquent Member was notified of the delinquency and on 9/11/15; [redacted] transferred his payment of $from his bank account to only pay the 8/10/Member was still days delinquent as the 9/10/payment was past due On 10/16/ [redacted] made an electronic payment through MHFCU’s WebPay which was a member initiated payment of $toward the lease paying the 9/10/payment and a partial payment toward the payment due 10/10/ Member continued to be days delinquentMember made another payment on 10/27/bringing his account currentMHFCU did not receive any payments from [redacted] for 11/10/or 12/10/ Member initiated two separate WebPay electronic from member stating member was “looking into the reoccurring payment issue” Repossession order was temporarily delayed pending outcome of member issue MHFCU sent member a reoccurring payment form to be completed by member and returned to MHFCU so reoccurring payments could be setup on his account MHFCU received a member initiated WebPay electronic payment (not a reoccurring payment) in the amount of the $on 4/13/As of 4/23/MHFCU did not receive the completed reoccurring payment form to set reoccurring payments on MHFCU’s WebPay nor payment to bring the account current MHFCU Collector sent an email stating such and requesting payment in fullMHFCU member services team sent another reoccurring payment form to member Member is now days delinquentOn 5/10/member initiated WebPay electronic payment (again not a reoccurring payment) in the amount of the $Member is now days delinquentMHFCU continued to try to contact member about payment and/or voluntary surrender of the vehicle Member failed to make the contracted monthly payment and account continued to fall deeper in arrearsMember was days delinquent at 7/25/16On 7/25/member contact MHFCU concerned about MHFCU reporting delinquencies on his credit reportMHFCU collector discussed the current days delinquency status of [redacted] ’s account Member became irate and disconnected without any payment to bring the account current 7/29/to 8/14/MHFCU continued trying member at home and place of employment to no avail MHFCU tried to verify employment but company would not verify [redacted] was employed by themOn 8/5/MHFCU placed vehicle out for repossession again On 8/15/Repossession Company could not locate vehicle at residence or work8/18/received update from Repossession Company it could still not locate vehicle On 8/23/and 8/31/Repossession Company conducted late night search of residence and surrounding area and still could not locate vehicle Company left cards and messages on member’s telephone with no answer or response from member On 8/31/Repossession Company notified MHFCU it had been searching for the vehicle for days and recommended this case be sent to an investigator Member called MHFCU on 9/6/stating he was just advised the vehicle was placed for repossession and the company was searching for the vehicle Member claims he does not know why payments are not made monthlyOn 9/8/member initiated WebPay electronic payment in the amount of the $ Repossession order was cancelled Again member fell delinquent failing to make his 12/10/16, 1/10/and 2/10/payments Vehicle was placed out for repossession yet again Delinquency letters sent 12/29, 1/9/with the intent to repossess on 1/23/Many emails were sent and telephone calls placed with member hanging up on collector Vehicle was placed for repossession on 2/2/ Repossession Company opened an investigation and found member moved to NY from NJ a violation of the lease contract Vehicle was repossessed at the NY location on 2/9/ Cost for member to redeem car was $amount to bring lease current + $repossession fee to Repossession Company Member redeemed vehicle on 2/10/17.Based upon the aforementioned history and breach of contract THEIR dates are all wrongI made a copy of the letter and mailed it in times at different dates and they still did not get to change my addressThey continued to send my statement to my previous address and I was therefore unable to send a paymentAfter continuous follow up calls to get it right, I was told that if I make a payment I can get my card back to current statusStill to this day the card has no credit limit on it whatsoeverThey continue to bill me $late fees as well and the other day I received a letter that I'm being sued for the money I oweI will make a payment if they reinstate my card and continue doing business, but they lied to me over and over and neglected to make the necessary changes in the system for my new address and took away my credit limitIn turn, now trying to ruin my credit score!

McGraw Hill to send the repossession company a release form, followed by another $for the company who picked up my car$to get my car back from repossession, all while my account was current and up to date. *** ***

To Whom It May Concern:In regard to complaint reference XXX from *** * *** *** *** *** *** **ty, ** ***,Our records show that *** ***, since December of has continually been late on his credit card payments and did not pay a minimum payment from such time until June of 2016, after which the Credit Union had, earlier that month, removed his credit line due to nonpayment.*** *** made a payment in June of of $However, he was not getting his credit card statements and after repeated attempts by the Credit Union, he refused to update and sign an address change formIt was not until mid-July that *** *** finally changed his address, and at the end of that month made another payment of $towards the outstanding balance of the credit cardThere was no correspondence from *** *** again until September of when he contacted us to advise us that he knew he was two months behind in payments, but “couldn’t make a payment until next month”The credit union contacted him in October to remind him of the payment and he made a payment of $at the end of October.In November, 2015, Member Service received a notice from the member, that he was angry that his limit was still revokedWe informed *** *** at that time that he was in a collections status since the time his limit was revoked, back in JuneIn December, 2015, the Collections department received a message from *** ***, inquiring why his limit was still revoked and could not understand how we could do that; they informed him that he was still in collection status, as he was still delinquent; advised that we have the right to remove limit for nonpayment and he would have to be current with payments and out of collection status for a few months to get limit backThere had been no payments since October.In January, 2016, Collections emailed *** *** for payment; *** *** emailed back, “You're company month after month by taking away my credit limit and making my credit card impossible to useTherefore, I stopped payingHave a nice day.”Currently, this account is non-active and is in litigation for nonpayment.*** ***’s account could not be reinstated while it was in a collection statusAs long as *** *** did not pay his credit card on a regular basis and on time, he gave up his right to having the credit reinstatedThe Credit Union’s Policy on credit cards states: 1. We stand by what we stated, and if he wants to complain further, then he will need to contact either the CFPB, the NCUA or send a letter directly to the credit union. Member was still 30 days delinquent as the 9/10/15 payment was past due.  On 10/16/15 [redacted] made an electronic payment through MHFCU’s WebPay which was a member initiated payment of $400.00 toward the lease paying the 9/10/15 payment and a partial payment toward the payment due 10/10/15.  Member continued to be 30 days delinquent. Member made another payment on 10/27/2015 bringing his account current. MHFCU did not receive any payments from [redacted] for 11/10/15 or 12/10/15.  Member initiated two separate WebPay electronic payments in the amount of the $382.22 each on 12/24/15. Member’s account was brought current. On 1/12/16 member initiated a WebPay electronic payment in the amount of the $382.22.  Unfortunately on 1/14/16 the payment could not be applied as member made an error on the account number and payment was reversed. No other payment was received and account became delinquent again.Member’s account continued in a delinquency status as member failed to make the 1/10/16, 2/10/16 and 3/10/16 lease payments. Each time a payment is missed, the MHFCU system automatically sends past due reminders at 15 and 30 days delinquent.  Additionally MHFCU collection team tried to contact [redacted] on 3/4/16, 3/7/16, and 3/8/16 via telephone and emails. Member did not respond to any attempt to contact him.  On 3/14/16, MHFCU sent a letter and email trying to arrange surrender of the vehicle.  Again no response from member. Member owed $1160.90 in arrears falling 65 days delinquent on 3/15/16.  Vehicle was assigned for repossession.  Repossession order placed on hold as member on 3/17/16 initiated another WebPay electronic payment in the amount of the $777.55 short of the required $1160.90 to bring the account current.  Member still 36 days delinquent.   On 4/05/16 MHFCU collection department notified member vehicle will be reassigned for repossession on or after 4/11/16 if all arrearages are not paid in full.  Member is now 52 days delinquent.On 4/11/2016, MHFCU Collections Department received an email from member  stating member was “looking into the reoccurring payment issue”.  Repossession order was temporarily delayed pending outcome of member issue.  MHFCU sent member a reoccurring payment form  to be completed by member and returned to MHFCU so reoccurring payments could be setup on his account.  MHFCU received a member initiated WebPay electronic payment (not a reoccurring payment) in the amount of the $386.55 on 4/13/16. As of 4/23/16 MHFCU did not receive the completed reoccurring payment form to set reoccurring payments on MHFCU’s WebPay nor payment to bring the account current.  MHFCU Collector sent an email stating such and requesting payment in full. MHFCU member services team sent another reoccurring payment form to member.  Member is now 40 days delinquent. On 5/10/16 member initiated WebPay electronic payment (again not a reoccurring payment) in the amount of the $383.04. Member is now 30 days delinquent. MHFCU continued to try to contact member about payment and/or voluntary surrender of the vehicle.  Member failed to make the contracted monthly payment and account continued to fall deeper in arrears. Member was 85 days delinquent  at 7/25/16On 7/25/16 member contact MHFCU concerned about MHFCU reporting delinquencies on his credit report. MHFCU collector discussed the current 85 days delinquency status of [redacted]’s account.  Member became irate and disconnected without any payment to bring the account current.  7/29/16 to 8/14/16 MHFCU continued trying member at home and place of employment to no avail.  MHFCU tried to verify employment but company would not verify [redacted] was employed by them. I will work with the department on this complaint.....however, I am a little concerned that your first statement is that you attempted to email and MAIL me.....I have received no physical mail regarding tis issue and I don't remember receiving an email prior to today.  Please let me know what...
