I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  
[Provide details of why you are not satisfied with this resolution.]
The response from McKays Automotive is unacceptable for the following reasons.   First, no refunds on services performed 5 months ago is false, as the service was not performed and a 24 month 24,000 warranty on all repairs that are performed, this repair however was not done.  Second, requesting that the vehicle should have been brought back to McKays to have the service performed at no charge is ADMITTING the fluid was not flushed and replaced originally.  Third, asking for a sample of the fluid after the fact is irrelevant as this cannot be done therefore not a valid excuse for denying a refund.  Fourth, the brake fluid was observed to be old and dirty, NOT BURNT, which invalidates McKays Automotive denying a refund based on that excuse.   I am resubmitting my request for a full refund of $99.95 + TaxKind regards, [redacted]

We would be happy to inspect and confirm the fluid because it WAS supposed to be flushed and it should be clean and almost clear when done. We perform the service immediately if necessary. Kurtis McKay

Mr. [redacted] brought his 2005 [redacted] in and we did repair all of the brakes and the parking brakes. We also flushed the brake fluid because it was very contaminated.We test drove the vehicle after the repairs and everything was in good working order.  After Mr. [redacted] drove it for a few days the...

orange abs and the red brake light came on and he brought it back in to our service department. We attached our computer and read the fault code as a C0246.  We then went through the reset procedure and the fault code came back immediately. After researching the fault code and performing testing we concluded that there is an internal fault within the Electronic Brake Control Module or ECBM. This is NOT related to any of the repair work that was done on the vehicle and therefore cannot have any warranty. We replaced brake pads and rotors and other mechanical parts of the braking system. We did not perform any repairs on the electrical part of the braking system.I priced the replacement of the EBCM (which is and expensive part) and he did not like the price. I completely understand that this is coincidental and certainly was not expected however, the maintenance repairs that we performed had nothing to do with this failure. I have included the following which may explain how the EBCM works.DTC C0246-C0254 Circuit Description The ABS relay supplies battery voltage to 6 valve solenoids. The electronic brake control module (EBCM) microprocessor applies the grounds needed to activate each solenoid. The low side of each solenoid coil has a feedback circuit to the EBCM microprocessor. When a solenoid is commanded OFF, the feedback voltage is high. When a solenoid is commanded ON, the feedback voltage is low.DTC Descriptors This diagnostic procedure supports the following DTCs:DTC C0246 EBCM Control Valve CircuitDTC C0247 EBCM Control Valve CircuitDTC C0248 EBCM Control Valve CircuitDTC C0251 EBCM Control Valve CircuitDTC C0252 EBCM Control Valve CircuitDTC C0253 EBCM Control Valve CircuitDTC C0254 EBCM Control Valve CircuitConditions for Running the DTC The ignition is ON.The vehicle speed is greater than 6 km/h (4 mph) .Conditions for Setting the DTC The EBCM detects an internal malfunction.Action Taken When the DTC Sets C0246, C0251, C0252, C0253 and C0254 If equipped, the following actions occur:The EBCM disables the DRP/ABS.The ABS indicator turns ON.The red brake warning indicator turns ON.C0247 and C0248 If equipped, the following actions occur:The EBCM disables the ABS.The ABS indicator turns ON.Conditions for Clearing the DTC The conditions for setting the DTC are no longer present and you use the scan tool Clear DTCs function.Diagnostic Aids  In the spirit of customer Service, I would be willing to install a new Electronic Brake Control Module at no labor charge if Mr. [redacted] purchases the unit either through McKay's or if he finds one on his own.   I do not accept this due to the fact that I do not have confidence in your company doing any other work on my car.  This story started off with me bringing my car back to your company to do the work that was under warranty and they rejected it because they felt like the problem was not the gaskets but the oil was leaking from somewhere else.  When they did the diagnostic, I truly believe they caused issues with my drive belt as well.  What I would like to have is the money that I spent on the repair and I can go to a repair facility that I trust.  Again I gave your company the opportunity to right their wrong, but was rejected.  They were not able to identify where the leaks were coming from so why would I trust them to do any other repairs on my vehicle.  I have received written statements from [redacted], and waiting on a statement from Pronto warranty.  I would like to avoid legal action, but my lawyer counseled me on exploring this option if this is not resolved in a timely manner.  This has already been a month and the more I drive around with this issue the more damage I am doing to my car  Thanks

Mr. [redacted] brought his [redacted] to us after having work done at another shop. We removed the upper engine cover to inspect his claim that the valve cover gasket was leaking. The valve cover had oil in one location and the oil was coming from above the valve cover (from the pcv system) and leaking down...

onto the valve cover. We showed this to him and he watched as we put the cover back on and he took his car. On Monday the car was towed back in because the belt had come off of the engine. We investigated and found that the tensioner bolt had been broken off and that is why the belt came loose. We contacted his extended warranty company and they declined to pay for the repairs (not covered)The bolts are aluminum and are delicate to extract and we referred him to the dealer. the valve covers are not leaking as they have oil residue on them coming from the pcv system. The oil leaking cannot cause other issues as this is a normal occurance on a [redacted] engine. We did not perform any other repairs or services on this vehicle and will not be held responsible for poor maintenance or other repair facilities work.The customer's statement that our unwillingness to repair a faulty item caused other trouble with the vehicle that will cost him thousands of dollars is absurd! The valve cover repair does have a 2 year/24,000 mile warranty through [redacted]--if [redacted] needs to replace the gasket it can be handled through 1-800-[redacted] with proper documentation and paperwork. Regards, Kurtis [redacted]

They said it was unlikely that the work done would cause the EBCM to suddenly be faulty, but not impossible. I also had them check all the other things McKay's had repaired. They invited me in to the garage to look at my brake fluid, which McKay's claims to have flushed. That fluid was nearly black and filled with small particles like dust.  It looks to have never been changed, but I was charged for a brake fluid flush. So if they did it, they did a poor job. That fluid should be clear or nearly clear and it is filthy. It is difficult for me to trust what I am being told here. To me, a flush means I end up with new, clean fluid when I drive away. Maybe I don't properly understand the term flush. At any rate, I do not see anything changing here, but if they would like to have a look at my brake fluid to verify my claims, that would be agreeable.Thanks

The valve cover Gasket is apart of the Valve cover assembly which should have been replaced as a whole in the first place.  I spoke to the [redacted] agent and she mentioned this fact and was curious why [redacted] didnt offer to replace the whole valve cover assembly due to the fact that this was the right direction, she mentiond that replacing the valve cover gasket is like a bandaid and would not fully fix the issue.  Ultimate [redacted] has dropped the ball tremendously I have been told this by [redacted] and now an associate that works for the company that insures there work.  [redacted] lack of diligence and knowledge of [redacted]'s has caused more harm to my car.  I have had my car for 5 years and the majority of issues I have had has all derived from [redacted]'s.  At this point I would just like a refund of the services that [redacted]'s have rendered.  Obviously they are not able to identify when a part is bad, and their refusal to fix the issue has cost me as far as missing time at work, and coming out of pocket for repairs.

We cannot offer a refund for services performed 5 months ago. The correct action would have been to bring the vehicle back to us to perform the flush at no charge.  We had no opportunity to view the fluid to determine if it had been flushed and had become burnt in that 5 month period or if it...

had not been serviced properly. We cannot and never will simply give a refund because of someones opinion or demand with out concrete proof. Even a sample of the fluid would have sufficed but nothing at all was offered except demand for a refund for a service performed months ago!  I would be happy to discuss this issue with the customer at his convenience. Regards, Kurtis M[redacted]
