The basement walls of my home have developed cracks due to an improperly installed driveway / expansion jointsThe problem analysis was performed by Stratum Structural Systems and confirmed by [redacted] Engineer [redacted] ***The improperly installed expansion joints has also resulted in noticeable bulge in our garage floorI will also note three neighbors have had McKelvey replace their garage floor due to poor construction practices Repair my basement and expansion joints and replace my garage floor

I just purchased a home from them months agoWe have issues with painting and flooring jobs, and they are not trying to resolve anythingWe have complained so many times, and they are not trying to do anythingI seen other homse in the community and they do not look like this and they have the same paint and flooring and the paint and flooring does not look back in that homeThey refuse to compare the two homeMy home does not look up too parI want them to fix my paint and floorsI believe the paint it self is the problem

First I’d like to clarify that the home in question was not purchased on 2/26/as stated in the complaintInstead the complainant entered into contract to have the home constructed on 7/23/and closed on the home on 1/30/McKelvey Homes offered a Quality Builders Warranty which
included a one year limited warranty against defects in material and workmanship and a ten year warranty against structural defectsAs part of this warranty we offer a walk through days after closing and months after closing so Homeowner’s can share with us any issues they believe require our attentionThis issue was first brought to our attention on March 31, over four years after the home closedThe homeowner had already taken it upon himself to have the issue repaired based upon the recommendations he received from other partiesWe were not given the opportunity to see the issue, investigate, or respondBased on these facts, we do not believe we have any obligation to reimburse him for repairs he authorized without giving us the opportunity to address. We would be happy to provide a copy of our warranty should you require it

Built a house with them in Was an extremely awful process in which no one took accountability for what McKelvey and the vendors they forced us to use said or Did
Here is a list of issues we encountered (This does not include issues since the purchase):
Prices we were originally told were changed the day we went to sign our Contract:

While working with Bev there were multiple times in which we asked for things to be added and Bev would not add them or added them incorrectly
I would have to send a list of items to Bev for things we talked about and she got upset and told me that I was hounding herMost of the time we would only get a couple of answers
We were told the price of the counter tops were included in the promotion at the beginning but later in the process we were told it was an upgradeWe had an email from Mckelvey stating it was included so it was taken back off
Upgrade on Kitchen Cabinets
aBev kept trying to charge us for the 3rd Tier upgrade package and then charging us per room
bBev slammed her fists on the table and told me that I better apologize to her when if she was right
cWe had to take this up to Phil before we could get this sorted out
We had to have Pre Construction walks because a lot of the changes we asked for where not on the start order or the contract correctly
We were never told that there was going to be an Electrical Box in our front yardEven after it was placed thereWe found it by driving by
aWe asked for any type credit on the lot premium ($5k) but we were told that they would not do that
We were told by multiple people that the lot would be flatDue to how the house and the covered patio sit, the yard is not even close to as flat as it was when we picked it
Covered Patio was built on a foundation and sits out of the ground
aMark stated that this is the way that Mckelvey builds them
bSuzie told our Realtor that is should have been common sense due to the pour of the house (I told them the day the foundation was poured I did not like it)
cMarks boss told me that there would be 2-steps off of the covered patio
dSuzie told our Realtor that it would be step
Several Issues once the house started to be built
afoot addition was not added to the laundry room or pantry
bWindows were not moved down due to that
cegress window was added when it should have been upgraded
dWrong windows were installed at front of the house
eDrink Bar wall was not built correctly
fWe were never told that we had to pay for the steps off the covered patioIt just showed up on a change order
gDue to location of plumbing in the basement the door was moved from the finished to the unfinished partIt changed some of the styling in the ceiling but we were not told about this, it was already done when we went for our electrical walk
Things that Mckelvey has done
Did not charge us for upgraded mortar (We were not told what was an upgrade and what was notWe were just given a box of mortar sample and we were told to pick from it.)
Added some plants around the electric box
Conceded $on the fireplace which was later not given to us do to the change from 8ft to 6ft
Framed the bathroom in the basement (This was not on the blueprint it was just a mistake)

McKelvey's refusal to accept responsibility or offer redress says much about their customer care. The homeowner closed on their home in March 2016.  Prior to closing we conducted a walk through with them and created a list of items not accepted.  At that time they signed the attached Purchaser’s Acceptance Agreement.  You will notice the paint and flooring are not on the list of...

items not accepted or punchlist.  The homeowners brought the concerns to our attention at a later date.  We have had our painting company representative, the paint manufacturer’s representative, two of our construction superintendents and our director of field operations at their home on various dates inspecting the paint.  All of these experts have tried to explain to the homeowners that there is nothing wrong with their paint.  During our visits we noticed extensive water  stains on the walls which appear to be due to the occupants of the home splashing water as much as 6 feet away from the sink. We have explained that if you splash water on flat paint it will leave marks or stains.  That is not a flaw in the paint it is the nature of it.   We have also had the flooring company to their home twice as well as both of our construction superintendents to look at the wood flooring.  The knots and distressed look of the floor is exactly how the floor the homeowner selected is supposed to look.  Though the homeowner claims we are not trying to do anything, as you can see we have given this a lot of attention.  We even repainted their laundry room as a good will gesture.  Within weeks it was stained again.  We believe this is a homeowner maintenance issue and is not a warrantable item
