I was charged for drafting summons and petitions for divorce, message to the court to electronically file pleadings, and drafting for financial disclosure statement from ***. I had already filled out the summons, petitions, and financial disclosure statement prior to meeting with Mr.. I personally handed him a copy. Mr. initially told me that he had filed the summons and petitions for divorce with the court. However, when I checked in the court system, my records were not there. He drafted a financial disclosure statement but I did not receive it. Instead I was asked for more money to receive these items and to file with the courts. I was charged $644 for this. I immediately asked for the rest of my retainer back.
I am the attorney who handled this matter as well as the managing attorney in the office, so I am writing in response to your letters dated December 18, 2019, and December 26, 2019. Please forgive my slow response. My wife and I had a child born on December 18, so I was out of the office for a week. With regard to our position on the claim, we represented Ms. for a short time earlier this year. She presented in our office with several forms that she had found online and filled out herself. Consistent with standard practice for any law office and with what I told her before she hired us, I prepared new forms as Ms.’s attorney and was nearly prepared to file them with the Court when Ms. contacted our office to inform us that she no longer wished for us to represent her. During that unscheduled call, I informed her that the papers were either filed or about to be filed, as they had already left my desk for finalization by my assistant. As soon as she informed us of her wish, we stopped billing on her file and stopped the papers from being finalized and filed. Since the papers were never filed and were still in draft form, we are unable to release them for liability reasons, so I informed her that there would be additional fees if she wished to re-hire us to finish and file the papers. She informed me that she did not wish to do so, so the file was closed and the unused portion of Ms.’s advanced attorney fee was returned. As such and in light of the fact that her contract allows 30 days for objections to fees, the fees charged were reasonable and we will not be issuing a refund. I was told by Mr *** that the files had already been submitted to the courts. If the paperwork was already being sent to the courts, then I should not need to send more money to finish the work. I already provided completed paperwork to send to the courts. The paperwork did not need to be redone. I paid for service I did not receive. I would like a refund.

I am in receipt of your follow-up letter dated Tuesday, December 31, 2019, and I am providing this email as a response thereto. While I appreciate Ms.’s confusion about paying for work that was not completed, it is critical to remember that it was Ms. who instructed my office to stop all work immediately because she no longer wished for us to represent her. Had she called and told me that she wanted to change attorneys but wanted me to file the papers she knew I was working on, I would have been able to do so without any further charge. Since she instead asked that the file be closed immediately, her later request for us to finalize paperwork required some work to reopen the file, review the papers and complete the work that had been started and stopped. As for Ms.’s complaint about her having the papers completed when she hired us, I was very clear with Ms. that I would be preparing pleadings, as I do for every client in her situation. Allowing a client to prepare legal documents diminishes the value of an attorney’s experience. Thank you for your attention to this matter

In regards to the petitions and summons draft, there is no way that the paperwork could possibly have taken 1 hour to complete. Mr. complimented me on the fine job that I had done preparing the documents which took about 10 minutes to complete. Secondly, I called in for the status of the documents to find out if papers had been filed. I was told by *** that they had been. So I waited a few days to hear anything. Then I called the county clerk. They told me nothing had been filed and no messages had been received. Furthermore, *** talks about the financial disclosure paper. I never received any correspondence about the financial disclosure statement. I was never contacted by Mr. about anything. I would like my money back. I am not satisfied with the services I never received and would like a refund.
