Gold's Gym stands behind the agreement signed by [redacted] *** The two employees that were involved when the agreement was written have both written statements stating that Mrs [redacted] was aware of the agreement she was signing Those statements are attached We have also attached a text message from [redacted] to her trainer requesting to reschedule her appointment, clearly Mrs [redacted] was aware that she signed up for personal training, hence contacting her trainer Gold's Gym is prepared to help Mrs [redacted] reach the health and fitness goals she has set for herself Thank you

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint I appreciate the prompt response; however, I've reviewed my agreement again and compared it to the version Gold's Gym provided in their response and they do not match I have attached a copy of my original agreement with Gold's Gym for review On my signed agreement, there is no statement regarding the right to raise my rates In fact,the Miscellaneous section of my agreement states that rates would increase to adjust for an increase in sales tax; which to my knowledge would not apply in this case.For these reasons I feel Gold's Gym is unjustified in raising my rates and I would like the former rate to be reinstated and honored Regards, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaintAs the gym stated they attempt to send an email on 3/7/and it was returnEmails are return immediately so why did it take days later to resendAnd because no one called or spoke with me to verify the email or state that it need to be corrected lets me know they had the correct email the entire timeIf your payment dont go through they will call you immediately, why dont they use this same protocal when clients has enrolled and charged for new products and servicesAnother error is that I didnt join 3/7/I enrolled months before 3/7/Another error is I didnt use sessions, however I was charged for sessionsIts sad to see that this gym cares less about not just the clients but also the trainersThats why the trainer that sign me up and the one who trained me no longer works for this gymIts unfortunate this gym lacks quality, empaty, fairness and professionalismI have yet been called, not regarding this issue, about my knee I hurt while training (which I'm sure was ddocumented but thank God for witnesses) or about apologizing for not being treated fairly in regards to the truth about signing up with training sessionsI am very displeased and not satisfied and will be speaking with other professionals to help me resolve this matter, no only for me but for everyone else who has became a victim to this gym untrustworthinessThank You! The hour policy is not to protect the trainer but more so a marketing strategy put in place to hold clients accountable for everything even they are not at faultI have been notified been notified by my trainer by text minutes after my session was suppose to start while standing around waitingSo again Golds Gym what is is place to protect your clients? NothingI understand that unpredictable things takes place in life and prevent us from being as prompt as we would likeAgain like I stated in person and now reporting, I cacancelled sessions due to serving our community as a Investigator with [redacted] and this career is unpredictable in which cause me to sometimes get off at 1am in the morningThis gym has the ability to help its clients and as I was told its according to their discretion

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint I find this response to be utterly disrespectfulPlease find the attached second letter from a second physician that was provided to themI sent the original copy from my oncologist to their corporate office in [redacted] , which was "never received." When I spoke to their onsite Manager, he told me that cancer which debilitated me from exercising did not qualify me from terminating their contract, which is contradictory to their contract(This is confirmed by the multiple veterans across the US who have filed suits against Gold's Gym after losing limbs and being sent to collections after failing to be able to terminate their contract due to medical necessity.) Because I did not want to be sent to collections, I gave my credit card information to the onsite manager to pay go on auto-pay for the remainder of my membership(Which is still utterly absurd!) Even after that, they charged my very valid credit card one time and sent me to collections.So, after it all, I provided them medical proof, on letter head TWICEClearly cancer at the age of which makes you go into cardiac arrhythmia while walking is not medically debilitating enough for those who have to squeeze out every pennyI gave up and paid the unethical crooks, told them to set me up on auto-pay, and they still sent me to collectionsEveryone knows someone who has been touched by cancer--I surely hope that they would not treat a loved one this way, because it's despicable Regards,

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint Attached is documentation of receipts proving that both the Membership Agreement and the Personal Training Agreement were initially signed and paid for on the same day (July 3, 2015)The date of July 9, is shown on the Personal Training Agreement because the initial trainer explained that the date on the contract reflected the first personal training session, of the contract signed on July 3, Therefore, the statement by Ashley S [redacted] , "the gym membership was purchased before the Personal Training agreement" is incorrect Also, during the time of initially signing both contracts on July 3, 2015, it was never explained by the employees or manager that the Day Money Back Guarantee was voided if a Personal Training Agreement was signedOnly after I followed the directions to cancel within 28-days via Certified mail and informing Mario ***, the gym manager, (via email) of my cancellation request did they respond with the following: S [redacted] *** [redacted] 8/6/ [redacted] We received your cancellation request for your membership for the day money back guaranteeHowever, once a member signs a personal training agreement it voids the day money back guarantee optionThis is because a member cannot cancel a membership agreement if they are currently involved in a personal training agreement as wellWith that being said, in the state of Texas everyone has business to cancel any agreement or contract and receive a full refund with no penaltySince it is past that day window for both your personal training agreement and your gym membership agreement we cannot cancel either on at this timeThe only two ways a member may get out of a personal training agreement before the contracted year is up, is if they become permanently disabled or if the move miles or more away from any Gold's Gym in the Houston areaIf you have any more questions feel free to contact myself or Mario at the number listed below Shannon [redacted] Operations Manager Gold's Gym The Woodlands FM Magnolia, TX Phone # 281-259- [redacted] Fax # 281-259- Prior to submitting my cancellation request, I did sit down with Mario ***, the gym manager at the time, to complete the PT/Signature Program Cancellation Request Form (attached) on July 8, At this time I did downgrade my Personal Training package, however, it was never explained that a Personal Training Agreement voids a Day Money Back Guarantee cancellation request The PT/Signature Program Cancellation Request Form also states that, "Gold's Gym requires a day written notice in order to cancelThis request will start your daysThis means, if you have a payment that falls within the day period, you will be responsible for that paymentIn the event member qualifies to buyout of agreement, member is liable to pay buyout within days of cancellation requestMember's account will not cancel until buyout has been processed Request must be resubmitted if buyout is not processed within days." Due to the fact that Gold’s Gym will not honor the Day Money Back Guarantee, as it explains in writing and explained to me by their employees, I will continue to pay for services so that my credit is not affected negativelyHowever, I stand by my initial complaints and am not satisfied with the way Gold’s Gym does business Regards, [redacted]

Gold's Gym is very consistent in holding members to the terms of their agreement, just as we take seriously our part in providing a first class work out environment to uphold our end of the agreement Mr [redacted] signed both the Membership and Personal Training agreements confirming that he read and understood the terms of his agreement I have attached both the Membership agreement and the Training agreement where you can see the 3rd page of the training agreement is the "Buyers Agreement Acknowledgement" Both agreements contain the specific requirements for cancellation and the responsibilities of the member Mr [redacted] received a copy of each when he joined and was also emailed a copy Gold's apologizes if it appears the staff is not helpful but they in fact are just doing their job, informing the member that they are held to the terms and conditions of their agreement and the cancellation policies Thank you
