signed a Service Order Form for an Abacus Private Cloud Subscription (hereinafter “Agreement”) under the business entity name [redacted] , LLC, which appears to be a law firm you created to service clients in the fashion industryBy fully executing the Agreement with Abacus, via electronic signature, you agreed to pay a Monthly Recurring Charge (“MRC”) for each month of your 36-month Subscription in exchange for Abacus building and delivering a custom virtual remote server including the use of AbacusLaw softwarePage of the Agreement states, in relevant part: “By executing this Service Order Form, Client hereby understands that it is entering into a binding contract with Abacus Data Systems, Inc., and that “If so executed and delivered to Abacus, the document shall be treated as an original and bindingcopy of this agreement.” Page further states: “Client’s Abacus Private Cloud Subscription shall be governed by the Terms and Conditions set forth at https://www.abacusnext.com/abacus-private-cloud-terms-conditions (which is herein incorporated into the Service Order Form byreference).” As described in the Terms and Conditions, “In the event of termination of Client’s Abacus Private Cloud Subscription in its entirety by the Client without cause or as a result of Client’s account being delinquent, Client shall pay Abacus the Early Termination Fee, which shall be equal to Client’s MRC times the remaining months left under the agreement (plus any balance owed as effective date of the termination), due and payable as of the date of early termination.” On August 3, 2017, one week after you executed the Agreement, you indicated via e-mail that you wished to cancel your Subscription, and requested that Abacus advise on the next steps services is what we take pride in so deeply Here at Abacus Data Systems, our mission is to provide fully integrated legal technology solutions alongside exceptional customer service to allow our clients to leverage their time to focus on what they do best; practice Law.To respond to the above claim, it is has to be fully noted that the accusations by the consumer that Abacus Data Systems has acted deceptively and has “deceptive business practices” is not well foundedAbacus Data Systems has not unveiled an “on-line” or web-based version of its AbacusLaw product as it is claimed by the consumerAbacus Data Systems however did unveil Abacus Private Cloud which is a cloud computing platform that provides the mobility and efficiency of a public cloud but is built on infrastructure dedicated exclusively for one organizationSo therefore, Abacus Data Systems did not create an on-line version of AbacusLaw and did not mislead the client in any manner.System updates are released periodically for AbacusLaw as all program run updates; this is done so Abacus Data Systems can stay cutting-edge in a competitive marketFor the stated error messages "Your security profile doesn't allow this actionUser: NDS Profile Administrator" or "Your access level does not allow you to edit this record" or "invalid account number entered.", this is not a restriction or a preventative measure that AbacusLaw has placed on the client, on the contrary it is a permission restriction in the user profile, set by the system administrator (the administrator or person in-charge in AbacusLaw in your firm i.eattorney, office manager)Had the administrator granted the user more permission, those features would have all been accessible to the user, therefore it can be stated that Abacus Data Systems has not introduced any preventive measures or has not handicapped the program in any shape, form or manner and the basis of these claims are not justifiable

Greetings, Thank you for providing the attached documentation, we appreciate your prompt responseConsistent with my statements in the prior response, the e-mail screenshots you included of conversations between you and Abacus associate Dusty Lillo are reflective of the several instances where Abacus went above and beyond its contractual obligations to provide downgrades, billing suspensions, and credits, all of which were provided to address external factors affecting your firm that were not caused by AbacusFor that reason, Abacus disagrees with your statement that services were never providedIn fact throughout a period of over one year, numerous examples of correspondence and support records demonstrate that members of your firm were actively using the products and services, receiving support from Abacus, and making monthly payments without disputeUltimately, as stated in our prior response, Abacus released your firm from its contractual obligations as a good faith gesture due to the untimely passing of your husbandSo while Abacus has already offered tens of thousands of dollars worth of concessions in light of the circumstances surrounding your account, there is no basis upon which to grant a refund of payments that were made and collected while the services were provided. Again no we went periods with no abacus access at all, we had to even mail our hard drive into abacus as the techs could not figure it outAuto billing and asking/confirming that the account billing had been suspended till we were actually receiving services was also confirmed and complained about numeous times And also have all those in documented emails dating over monthsAlso I've attached proof that the account was not closed even after signing July 10th that the business was no more due to his passingThat in fact we did still have credit from over paying and being over billed and it wasn't till Sept that our credit had finally ran out..which all the overpayment and credit is what your company is refusing to refundThe invoice sent to me in Oct staying that we had paid over $for our Sept bill and was days late billing us the balanceI had recieved this reminder of a late payment twice in Oct with our account number/identification on the invoiceThat's proof abacus continued to bill off the credit left on the account even more months past his passing and business closureThat confirms what I've been sayingWe had got a long period going back and forth with tech after tech..if abacus had no part in why we weren't up and running why wasn't our users up and running the 1st tech appointment? Why did we have to mail in our hard drive as they could not figure it outDuring those months Jan to June we did nothing with our on site tech equipment that had changedWhen I pushed at the end to cancel the entire account from frustration of all the hours spent on going back and forth and setting up tech support appointment one after another it was only then when I said we would cancel the whole thing if they just could not figure it out, magically may 26th the tech got the other users finally up and runningAnd I'm sure we had been paying for when the weeks prior the tech could only get running and before that noneSo no I'm sorry I'm moving forward with thisAs I feel abacus did not provide the services that money was taken forWe were without for monthsThere is a very long history of emails and it only allows me to upload at a time hereBut rest assure I have them allSo again I disagree with your logic and will be proceeding forwardThank you for your time.

I have received a full refund from Abacus in the requested amount of $330. I have placed a merchant block on my credit card account preventing Abacus from charging my card again. I have placed filters on my phone number and email addresses blocking notifications of new attempts by Abacus to contact me. If Abacus continues to attempt to contact me in other ways, I will not respond. If Abacus continues to bully and threaten me, I will escalate this complaint as necessary.
