Cancelled their service for missing my trash pickup weeks in a row, will not refund the rest of the year I already paid for after taking barrel.I had their services for years and they recently had a new driver on the route. He kept missing my home and not taking my trash I called multiple times asking for a manager or owner as the trash was piling up in the summer and a woman swore and hung up on me. She called from blocked number and called me name and hung up. Since I had paid in advance I never got my money back after they came and took my container. I have asked for a refund of what I had paid and they said they will not refund me and if I call again they will send me a bill. I was planning on filing a small claim in court. They owe me 64.50Desired SettlementI simply would like the 64.50 I paid in advance before I cancelled. I have the copy of the last check I wrote. I don't want interest on the money or anything other than my own prepaid money back. If I end up going to court I would seek triple damages for filing and fees ect.Business Response Good Afternoon This letter is in response to the complaint made regarding our waste/recycling serviceson [redacted] We have been in the waste hauling business for many years. Regarding service on [redacted], we provide curb-side collection at the followingaddresses [redacted] Service is scheduled on Fridays and checking ourAugust 9, 2013 Route sheets and driver log we have "no missed pick-ups", also we did not receive a single call from any other customer on the street regarding any missed service. It is possible that the customer in question may have put their waste/recycling out on the curb after the vehicles serviced[redacted]. On Monday, August 12, 2013 our office received a reporting a missed pick-up at the locationIt is our normal procedure to send a vehicle back and make the customer happy. In this case, thecustomer was very upset and used profanity with our [redacted]. We have interviewed our [redacted], who has an outstanding record with our company for over 10 years, and she states that she did not use any abusive language or make any call from a "blocked number" . The end result was the customer cancelled service. On August 16, 2013 we scheduled a "take-out" of equipment at [redacted]Upon arriving at the location, our driver discovered that our equipment (refuse toter value $80.00)) had been defaced with spray painted profanity (please see attached photos). Unfortunately, the spray painthas rendered the equipment unusable for any other customer. In effect the equipment has beendestroyed by the customer. In conclusion, the customer has paid for service from July- September 2013, in normal circumstances, we would more then willing to credit the 2 months ( August/September= $43.04)but in this case, with the destruction of our property, the customer does not warrant a refund until the issue of damaged equipment is resolved. I have a newly paved driveway and the road has just been paid. There are no side walks at all in my neighborhood. Google maps can comfirm this. There was no damage to the container other than the wear and tear of having it for three years and putting trash in it. I record every call to my phone from a blocked number for reasons not related to this case. There aren't many. The message to cancel my service was left on the Mcnamera voice mail. It was recorded and is admissible in court because I was aware I was being recorded. I can assure you there was no profanity. I encourage the business to present that voice mail. I said something to the effect that I have been a customer for years and always give christmas a bonus to my trash person, paper boy, mailman etc and have never called to complain. Suddenly there is a new driver on the route and they keep missing my home and I have to call 3 times in two days. My husband always puts the trash out the night before. I asked them to come back the guy grabbed one bag off of the top (so it was not sticking out over the lid) and did not touch the recycle basket or the rest of my trash in the barrel. I am paying them to pick up my trash. They have also missed my neighbors trash on occasion. I have paid in advance for services I can no longer receive. If they want to bill me they can do so after my earnest money paid in good faith has been refunded. When I called the business it was like calling in to a radio talk show. The lady yelled. "We're having a great day here whew!! Are you having a great day??" When answering the phone. Instead of arguing with me that there is no trash in my barrel in the future just say "We're sorry" and send someone back out to get it. In August it smells and is unsanitary. I want 64 dollars. You can't deduct money from trash that wasn't collected. My agreement of the phone was the driver was supposed to bring out a check for the balance and take my barrel. Instead they took my barrel and I am out money. I have another waste service now and am very pleased with it. Prior to Mcnamera I has [redacted]. I never had problems with them either, but their prices went up. You get what you pay for.Final Business Response As per our conversation, McNamara Waste Service, in the spirit of good faith, would be willing to refund the 2 months (August/September = $43.00) to help resolve this matter [redacted] p.s. please note July services were provided to the customer ($21.50)Consumer Response It has been a month and I still have not received a refund.Consumer Response I still haven't received a check from this business after they agreed to pay me pay what I pre paid.
