The series of events in MCS' response are incorrectI have not received any missed calls from or messages from MCSFurther more, I am not in receipt of any correspondence or contact from *** *** - other than my initial communication in which they advised me they were confused as to why MCS is attempting to collect a mortgage payment when they were in receipt of the mortgage in the full amount on November **, 2014. Attached, please find the e-mail sent to MCS - to which I am yet to receive any responseI request an explanation as to how the payment in which MCS is requesting would be applied to my mortgage.

In response to the above case number please let me explain the facts.1- first payment was due to Mcs Mortgage Bankers2 first payment was due Dec * as per the note and mortgage on closed loan documents3- loan got sold to new lender with a goodbye letter sent to applicant telling her and giving her information for her January payment to be paid to new lender4- Mcs has spoken to applicant and tried to explain but she does not seem to understand5- We will send today a email from new lender stating that the dec payment was to be paid to Mcs and in fact we also paid some additional taxesIn conclusion if the client looks at her closing package she will see first payment due December *, therefore she can then see that 3 payments should have been made on her mortgage December, January and February She can look at her checkbook and see she only paid Jan and I am assuming FebruaryOn behalf of Mcs I have tried many ways to explain this to the consumer and she has rejected ours and her own attorney at the time of closing.Unfortunately now MCS will have to send a demand letter for the payment which we have tried to avoid. The borrower then will go see an attorney who in fact will confirm to pay the December payment. MCS is been extremely patient but the applicant will also have her credit history show a late payment.I am willing to hold off on proceedings if she agrees to pay what is due and I will also waive any late charges that she has incurred.Thank you

I am responding to complaint #[redacted] from [redacted]. I apologize for the delay but I was getting all the paperwork together and other information to show to [redacted] that the December payment was in fact payable to MCS Mortgage Bankers, Inc. In an effort to resolve this I...

reached out to [redacted]’s attorney who closed the loan for her as I feel he has credibility with his client. Her attorney called her and explained that her December payment was due to MCS and that MCS has sold the loan to [redacted] and they were notifying her when her first payment was due to them. [redacted] called us and told us that she did not hire her attorney for this matter, to which we replied that he represented her at the closing. She did not want us talking to him. In order to show [redacted] that the payment for December was due to us we also received a letter from [redacted]. Finally all the closing documents clearly state the first payment was due December [redacted], 2014. At this point there is nothing else I can offer her to prove she owes us the money. I understand she is frustrated and I personally reached out to speak with her and she has not returned my call. Review: In early May I was contacted by [redacted] from MCS mortgage to refinance my loan at a lower rate. I told him I had spoken to several mortgage companies but my debt to income ratio prohibited the refi. He asked for more details. I told him my existing mortgage balance was approximately 103k and my home equity balance was about 31K. He told me that he could probably get me qualified for an FHA loan with an interest rate of 3.25 %. I questioned this and told him about my other debts which included a car lease, and a boat loan and provided him with my income ($1500 rental income and $2000 social security income month). He told me ; "I can make this loan soar". He sent the disclosure paperwork to me which I signed and then the nightmare began. He said that if I got rid of the lease on the car, my debt would be within range. So, I turned in my car and had to pay $35.00 extra to expedite the payoff paper from gm. I had told him that I only had the copy of my 2012 income tax, I lost my 20l1 return. He said he had to have the transcripts so I contacted the IRS for the transcripts. I received them after 2 weeks. When I sent them to him he told me the transcripts were unacceptable and I needed the schedule E. We contacted the IRS and were told that it could be 60 days before I received them. [redacted] said that was unacceptable. He said that he could have an accountant friend of his fill out the forms for $300.00. The accountant used the transcripts and created a new 1040. I told [redacted] there is no way he could replicate the schedule E.-because if it was off even a penny, it would trigger an audit. He said; " don't worry about it. It will be an internal document." Then he sent me the accountants transcribed 1040's which had an error on them. I called him back and he told me not to use the 1st returns he sent me from the accountant he would send me a corrected copy which he did. Then he insisted that I go to the IRS and have them stamped. After numerous discussions about them, it was no longer necessary. To make a long story a little shorter, I will move on to the pre approval. The appraisal was $550. After which I was told my interest rate would now be 4% instead of 3.25% because the appraisal came in low. Then I had to explain where I got money to put into my checking account in December of the previous year. I told him I don't know, probably from my 401K which I withdraw about 25k a year from - a figure he used for my income from the onset. I asked why the 3000k I paid on my home equity in March wasn't reflected in my revised closing cost work sheet. He was unaware. After 87 phone calls, numerous faxes to various businesses in the Rhode Island where I am spending the summer, trips to the post office, UPS overnight deliveries, numerous texts, I was told by [redacted] that my loan was not approved. This is in spite of the fact that I was in better financial shape after being pre-approved than I was when my loan was declined verbally by him on June **. Since then, I have been notified by my insurance company (Allstate) that MCS mortgage changed the mortgagees from Bank of America and M&T bank to MCS Mortgage. I have documentation of all correspondence and phone logs if required.Desired Settlement: Reimbursement for the $850.00 and MCS mortgage license revoked.

I take any complaint very seriously as MCS has been is business over 18 years and I pride our company on customer service. Clearly from your letter you have several issue that you would like a response to. I would like that opportunity to do just that. I have left a message on the phone number enclosed on the letter ([redacted]) as well as this email.Please let me know a time for me to call you and discuss your concerns. Review: The issue presented in this complaint is MCS following for a mortgage payment I believe they are not entitled to (as well as my current bank holding my mortgage [redacted] and their former employee who participated as my mortgage broker at the time of purchase), additionally, to complain on their communication practices. The facts of the dispute is as follows:

I closed on my property October **, 2014.

I received a letter from MCS mid-November advising my first mortgage payment was due December *, 2014. Within the same week, I received a letter from [redacted] advising my first payment would be due January *, 2015.

In mid-December I received a call from [redacted] of MCS inquiring as to the outstanding mortgage payment. Before finding more information, I initially asked for an extension for payment to January **, 2015. [redacted] advised she would ask her [redacted] and call back. As of that date - I did not receive a call back or correspondence in any form. Additionally, in my conversation with [redacted] I advised per my conversation with Jonathan, our mortgage-broker from MCS at the time (no longer employed at MCS) to disregard this December [redacted] payment, as MCS typically requests the first mortgage payment and passes it along when the mortgage is sold.

[redacted] has on their records they received our mortgage MID NOVEMBER. On this date, I received a call from MCS following for payment over a month after the initial conversation in which I was expecting an answer from MCS.

I spoke with a representative from [redacted] this date - they were also confused as to why MCS would follow for a full month mortgage payment due December [redacted], when it was in [redacted]'s possession mid November . MCS held the mortgage no more than three weeks.[redacted] offered the grace for the first mortgage payment to be due Jan. *, 2015, and have advised I am in good standing with them.

In my conversation with MCS' senior management - I was communicated to in a belittling manner and berated. In any business-clietrelationship - yelling and talking to someone as if they are dumb is unacceptable.Desired Settlement: I would like for MCS to disregard their requested December *, 2014 mortgage payment and provide writing of same. An apology for how this situation was dealt with would be nice - however, not pursuing.
