detail commentary and justifications for deniability.   Matter 1.)   Determination:   This client, [redacted], filing this complaint in deniability of the matchmaking services rendered through Beyondchai.com. In affirmative and accordance with the terms and conditions (http://beyondchai.com/terms-condition/) as agreed upon during the registration process, the company, beyondChai.com has went above and beyond the due obligations.   During the membership period, Ms. [redacted] was sent 32 matching profiles – significantly more than afforded with her subscribed masala package. Snipped to the package details are noted below and also made available on our website - https://beyondchai.com/packages/       In retrospect, the client willingly expressed interest in 4 of the 32 proposed profiles. While BeyondChai respects client’s choice and decisions to accept and reject the proposed profiles however this warrants acknowledgement of the efforts exerted by the matchmaker.   Our guarantee that garners a refund is inclusive of not receiving 1 qualifying ‘match’ as mentioned in our FAQ page and the T&Cs:     The below commentary is a snippet from client’s communication log and testament to receiving the matches.     Although it is unfortunate that those two matches didn’t lead to the desired goal for the client, they still met the criteria for a match. It is common knowledge that we, as a company nor as individuals have any control over the feelings and actions of others after two people interact. We cannot minimize the very many hours that were spent on this client as she received and went above the 1 match disqualification of a refund.   All these policies and agreement of our rules can be validated and further expressed in our Terms and Conditions (http://beyondchai.com/terms-condition/):   Use of the Matchmaking Service:   “…We are not responsible for the actions, words, or conduct, whether online, offline or otherwise, by any user of the Services. We are not responsible for any errors or delays in communications between users. We are not responsible for the Content of messages, or in-person communications, between users…”   “…As confident as we are in our match-making abilities, Beyond Chai does not guarantee that using the Services will result in a marriage, and we do not guarantee that using the Services will result in any type of relationship or relationship potential between you and another person or group of people. We guarantee that you will be introduced to eligible singles who meet your individual criteria for a life-partner…”   Our terms and conditions are found and easily accessible at sign-up and at the bottom of all our Beyond Chai webpages. Every member with Beyond Chai must agree that they have read and accepted this information before sign-up is completed and they receive service;   Represented below is a snippet of registration process, requiring all clients to acknowledge AND compliance with the terms and conditions.       Matter 2.)   Sub-complaint: No update of change in refund policies   The client made a complaint to us about honoring our original refund policy of a 100% refund. Effective January 2017, we changed this refund policy to refunding only 50% if they meet the qualifications. A complaint was made that she joined the website under the guise of receiving the original 100% if she didn’t receive her entitled service. It was mentioned many times that, had she qualified, we would have honored that original refund policy, as we do with all customers that signed up prior to that change in policy. This is why there is no update of the specified change to these clients.   Matter 3.)   Sub-complaint: Minor Accusations:   The client also reports: a.) Staff Leaving, b.) Matches Disappearing, c.) Matches outside criteria, d.) Insufficient research on candidates(sects), e.) General Disorganization, f.) Lack of Professionalism.   a.)Staff Leaving   This is something that is out of the hands of any company, we are sorry that she had to switch matchmakers, although her new matchmaker was swiftly exchanged and no trouble was had regarding this in specific. Nothing, including proposal information and listing was lost in the transfer as there was communication and review when the client was re-assigned. We have a logging of all activity and proposal information on their account. Anything that was not continued-on from her previous matchmaker was judged per the new-matchmaker’s judgement and expertise.   b.)Matches Disappearing   Matches do not ‘disappear’. A proposed candidate on our website may choose to not respond or change their mind according to their whims. We are not responsible or liable for this as mentioned in our above highlighted Terms in Conditions in Matter 1. There is further detail on this in the full Terms and Conditions page.   c.)Matches Outside Criteria   Of the 32 proposed, there were several matches that exceeded the quantity afforded by the subscribed package. As with any other matchmaking service, we will occasionally ask if a client is open on bending in their specifications in hopes that we may still be able to connect two people regardless of preconceived notions that sometimes change through time. This is especially relevant in the case that a proposal may match in everything except what the client may have listed as a minor qualification of importance. As per the mutual understanding of the client and the matchmaker, if not all, most of the matches proposed were within the desired criteria and did not fall into “deal breakers”.   d.) Insufficient research on candidates   Refer to above report clarification. Additionally, we do not require every single matter that a client wants to know about another member to be listed on profiles. We cannot force people to give information beyond what they are willing to give. This will be at this members disadvantage shall they choose not to disclose certain things. Members are free to reject members on this basis. If there is a matter we are not informed about that comes up which doesn’t meet your specifications later on in either getting to know or getting more information, we are not responsible as listed in our Terms. In our terms and conditions (mentioned in matter 1), we only guarantee providing the connection between two mutually agreeing parties.   e.) General Disorganization   One noted specified incident of disorganization that can be said to be the inconvenience was the switch matchmakers, we made this as swift and easy for the client as possible, communicating right away of the change and transferring profiles. We try our best to streamline these processes when these incidents arise. This is a normal company interaction across industries.   On another note, the client may be referring to the process whilst the customer had disagreement and misunderstanding of our policies. In the midst of her disappointment and misunderstanding, it must have been very frustrating to go back and forth trying to get the situation to come to a conclusion.   f.) Lack of Professionalism   Throughout our service, we train our matchmakers and staff to present our best sense of professionalism according to Beyond Chai Standards. Any isolated incidents or complaints should have been reported to administration. We do not have any of these on file besides the case of this current complaint.     Concluding Remarks Based on the factors noted above and in compliance with our terms and conditions as agreed upon by the client, and after careful analysis of the client, we have respectfully denied the clients right to refund. While it is unfortunate the client could not be successful in materializing a relationship but in accordance with our terms and conditions, we do not guarantee formation of relationship, marriage, or engagement. In accordance with the fair business practices, we have went above and beyond reasonable expectation to help client be successful in their journey to marriage.
